Changes in Subscriber Carrier Selection. 17.1 Each Party will abide by applicable state or federal laws and regulations in obtaining End User authorization prior to changing End User’s Local Service Provider to itself and in assuming responsibility for any applicable charges as specified in §258 (b) of the Telecommunications Act of 1996. Either Party shall make authorization available to the other Party upon reasonable requests and at no charge.

Changes in Subscriber Carrier Selection. 21.1 Each Party must obtain end user authorization prior to requesting a change in the end users' provider of local exchange service (including ordering end user specific Unbundled Network Elements) and must retain such authorizations pursuant to FCC and state rules. The Party submitting the change request assumes responsibility for applicable charges as specified in Subscriber Carrier Selection Changes at 47 CFR 64.1100 through 64.1170 and any applicable state regulations. 21.2 When an end user authorizes a change in his selection of local service provider or discontinues service, each party shall release the customer specific facilities. AT&T OKLAHOMA shall be free to connect the end user to any local service provider based upon the local service provider’s request and assurance that proper end user authorization has been obtained. Further, when an end user abandons a premise (i.e., vacates a premise without disconnecting service), AT&T OKLAHOMA is free to reclaim the facilities for use by another customer and is free to issue service orders required to reclaim such facilities per the local service provider’s request. When a CLEC resale end user has abandoned a premise (i.e., vacates a premise without disconnecting service, CLEC will cooperate with the new local service provider to confirm that the premise is abandoned by providing a timely response to the new local service provider. 21.3 Neither Party shall be obligated by this Agreement to investigate any allegations of unauthorized changes in local exchange service (“slamming”) on behalf of the other Party or a third party other than as required by federal or state law. At CLEC’s written request, AT&T OKLAHOMA will investigate an alleged incidence of slamming involving CLEC, and only in such CLEC authorized instances shall AT&T OKLAHOMA charge CLEC; providing such charge shall be a cost-based or mutually agreed fee for providing the investigation.
Changes in Subscriber Carrier Selection. 18.1 Both Parties hereto shall apply all of the principles set forth in 47 C.F.R. § 64.1100 to the process for End User selection of a primary Local Exchange Carrier. BellSouth shall not require a disconnect order from an Al-Call Customer or another LEC in order to process an Al-Call order for Resale Service for an Al-Call End User. Until the FCC or the Commission adopts final rules and procedures regarding a Customer’s selection of a primary Local Exchange Carrier, unless already done so, Al-Call shall deliver to BellSouth a Blanket Representation of Authorization that applies to all orders submitted by Al-Call under this Agreement that require a primary Local Exchange Carrier change. Both Parties hereto shall retain on file all applicable documentation of authorization, including letters of authorization, relating to their End User’s selection as its primary Local Exchange Carrier, which documentation shall be available for inspection by the other Party hereto upon reasonable request during normal business hours.

Each Party shall deliver to the other Party a representation of authorization that applies to all orders submitted by a Party under this Agreement requiring a LEC change. A Party's representation of authorization shall be delivered to the other Party prior to the first order submitted to the other Party. Each Party shall retain on file all applicable letters and other documentation of authorization relating to its End User’s selection of such Party as its LEC, which documentation shall be available for inspection by the other Party at its request during normal business hours and at no charge.
