Classification and Evaluation of Positions. The classification, evaluation, reclassification and revaluation of positions covered by this Agreement shall be determined in accordance with the current Classification and Evaluation Agreement made between the City and the Union dated 1979 March 27.

Classification and Evaluation of Positions. The classification, evaluation, reclassification and revaluation of positions covered by this Agreement shall be determined in accordance with the procedure set forth in the current Job Evaluation Agreement made between the Employer and the Union.
Classification and Evaluation of Positions. (a) The classification, evaluation, reclassification and revaluation of positions covered by this Agreement shall be determined in accordance with the procedure set forth in the current classification and evaluation agreement made between the Corporation and the Union et al. (b) New employees or employees re-engaged shall be entitled to the standard rate of wage for the position in which engaged. If there is no classification or wage scale in Schedules "A" or "B" of this Agreement covering the position, such shall be negotiated between the Corporation and the Union, as per Article 4.1(a).
Classification and Evaluation of Positions. The classification and evaluation of new and existing positions covered by this Agreement shall be determined in accordance with the procedures set forth in the Pay Equity/Gender Neutral Job Evaluation Agreement (revised April 2010) and the Pay Equity Implementation Agreement both dated June 16, 1999, until such time as the Job Evaluation Joint Committee (JEJC) shall recommend to the parties the following: a) A new or revised Pay Equity/Gender Neutral Job Evaluation Agreement b) A new or revised Job Evaluation Plan c) A template for Class Specifications based on Job Evaluation Plan d) New or revised changes to the Job Analysis Questionnaire in accordance with the new or revised Job Evaluation Plan e) Any other changes as the Job Evaluation Joint Committee may see fit to recommend The Job Evaluation Joint Committee (JEJC), (not the JJEC), shall be comprised of the following: CUPE President or designate Board Representative or designate CUPE Representative from JJEC Board Representative from JJEC Each party may also bring no more than one (1) outside consultant to provide professional advice and support to the discussions. It is understood that until a new Agreement and Plan are agreed to by the parties, the existing Agreement and Plan shall remain in force.
Classification and Evaluation of Positions. 17.01 In the event that a new position is created, the Employer will prepare a job description and/or a classification and enter into discussion with the union to establish a pay rate for the new position. 17.02 Should the Union dispute the job description/class specification or the wage rate for it, then the Union may file a grievance in accordance with Article 13 of this Agreement. Pending resolution of any such grievance, the Employer may proceed to fill the new position on the basis of the challenged job description/classification and wage rate. In the event that there is a change in the wage rate as a result of the grievance, such change will be retroactive to the date the new position was filled.

  • Monitoring and Evaluation a. The AGENCY shall expeditiously provide to the COUNTY upon request, all data needed for the purpose of monitoring, evaluating and/or auditing the program(s). This data shall include, but not be limited to, clients served, services provided, outcomes achieved, information on materials and services delivered, and any other data required, in the sole discretion of the COUNTY, that may be required to adequately monitor and evaluate the services provided under this Contract. Monitoring shall be performed in accordance with COUNTY’S established Noncompliance Standards, a copy of which is attached hereto and incorporated by reference as Attachment “C”. b. The AGENCY agrees to permit persons duly authorized by the COUNTY to interview any clients and all current and/or former employees of the AGENCY to be assured of the AGENCY’S satisfactory performance of the terms of this Contract. c. Following such evaluation, monitoring, and/or audit, the COUNTY will deliver a report of its findings and recommendations with regard to the AGENCY’S conformance with this Contract’s terms and conditions to the AGENCY and/or Board of Directors’ President, and members, whenever applicable. If deficiencies are noted, a written notice of corrective action will be issued to the AGENCY which will specify deficiencies and provide a timeline for correction of those deficiencies. Within the designated timeframe in the written notice of corrective action, the AGENCY shall submit to the COUNTY’S CCC manager (“Manager”), or their designee, a corrective action plan to rectify all deficiencies identified by the COUNTY. d. Failure by the AGENCY to correct noted deficiencies, as outlined in the written notice of corrective action, may result in the AGENCY being deemed in breach of the Contract terms. e. The AGENCY shall cooperate with the COUNTY on all reviews to ensure compliance with all applicable COUNTY guidelines and requirements for general fund recipients.

  • NOTIFICATION OF PUBLIC EVENTS AND MEETINGS 2 A. CONTRACTOR shall notify ADMINISTRATOR of any public event or meeting funded in 3 whole or in part by the COUNTY, except for those events or meetings that are intended solely to serve 4 clients or occur in the normal course of business. 5 B. CONTRACTOR shall notify ADMINISTRATOR at least thirty (30) business days in advance 6 of any applicable public event or meeting. The notification must include the date, time, duration, 7 location and purpose of the public event or meeting. Any promotional materials or event related flyers 8 must be approved by ADMINISTRATOR prior to distribution. 9

  • MANAGEMENT OF EVALUATION OUTCOMES 12.1 Where the Employer is, any time during the Employee’s employment, not satisfied with the Employee’s performance with respect to any matter dealt with in this Agreement, the Employer will give notice to the Employee to attend a meeting; 12.2 The Employee will have the opportunity at the meeting to satisfy the Employer of the measures being taken to ensure that his performance becomes satisfactory and any programme, including any dates, for implementing these measures; 12.3 Where there is a dispute or difference as to the performance of the Employee under this Agreement, the Parties will confer with a view to resolving the dispute or difference; and 12.4 In the case of unacceptable performance, the Employer shall – 12.4.1 Provide systematic remedial or developmental support to assist the Employee to improve his performance; and 12.4.2 After appropriate performance counselling and having provided the necessary guidance and/or support as well as reasonable time for improvement in performance, the Employer may consider steps to terminate the contract of employment of the Employee on grounds of unfitness or incapacity to carry out his or her duties.

  • CLASSIFICATIONS AND WAGES The Employer will pay employees pursuant to the wage schedule attached hereto as Schedule “A” and forming part of this Collective Agreement.

  • DIVERSIFICATION AND RELATED LIMITATIONS 6.1. The Trust and MFS represent and warrant that each Portfolio of the Trust will meet the diversification requirements of Section 817 (h) (1) of the Code and Treas. Reg. 1.817-5, relating to the diversification requirements for variable annuity, endowment, or life insurance contracts, as they may be amended from time to time (and any revenue rulings, revenue procedures, notices, and other published announcements of the Internal Revenue Service interpreting these sections), as if those requirements applied directly to each such Portfolio. 6.2. The Trust and MFS represent that each Portfolio will elect to be qualified as a Regulated Investment Company under Subchapter M of the Code and that they will maintain such qualification (under Subchapter M or any successor or similar provision).

  • Statements of Reconciliation after Change in Accounting Principles If, as a result of any change in accounting principles and policies from those used in the preparation of the Historical Financial Statements, the consolidated financial statements of Holdings and its Subsidiaries delivered pursuant to Section 5.1(b) or 5.1(c) will differ in any material respect from the consolidated financial statements that would have been delivered pursuant to such subdivisions had no such change in accounting principles and policies been made, then, together with the first delivery of such financial statements after such change, one or more statements of reconciliation for all such prior financial statements in form and substance satisfactory to Administrative Agent;
