Construction Report. Monthly Project Progress Report From the Effective Date and continuing until the Initial Delivery Date, Seller will provide a monthly Project Progress Report containing, at a minimum, the information listed below. An executive summary; Project bar chart schedule (including current status of all events); Assessment of percent construction complete and percent change from immediately previous report; Description of general work status (including short passages as applicable) on: Engineering; Procurement; Permitting (include status of any required regulatory determinations for approval of Federal New Source Review permitting exemptions, expedited permitting processes, and status of acquisition of required ERCs and other emission credits in terms of impact on the Project’s permitting schedule, over-all Project schedule, and ability of Project to meet Expected Initial Delivery Date); Major construction activities in the prior month; Testing; Electrical interconnection status; and Any other required interconnections. Forecast activities for next month; and Potential issues affecting the Project. Seller must notify SCE’s contract manager for the Agreement in writing of its receipt of any additional documents, which fall into the categories, listed (in a – f) below, and make such documents available to SCE within two (2) Business Days of such receipt: All material written commitments regarding construction work at the Project that could impact completion schedule or Initial Delivery Date; Executed work orders for construction of the Project; Construction agreements; Letters of intent; Precedent agreements; and Engineering assessments of the Project or any Storage Unit. APPENDIX 7 TESTING PROTOCOLS INITIAL COMMERCIAL OPERATION and CONTRACT CAPACITY & ANCILLARY SERVICE TESTS [SCE Note: Protocols may need to be adjusted based on storage process technology] Storage Unit This Appendix 7 sets forth the protocols for (i) the Initial Commercial Operation Test that each Storage Unit must successfully complete in order to achieve Commercial Operation and which sets the level of SU Contract Capacity for such Storage Unit, and (ii) the Contract Capacity & Ancillary Services Test. The Initial Commercial Operation Test and the Contract Capacity & Ancillary Services Tests are sometimes referred to in this Appendix individually as a “Test” and jointly as the “Tests.”
Construction Report. For each and every Recreational Improvement (and material alteration or addition thereto) undertaken by Lessee on the Premises, Lessee shall prepare and deliver a construction report. This report shall contain the following elements: (1) type of Recreational Improvement constructed or altered; (2) floor area or capacity of Recreational Improvement constructed or altered; (3) total cost of construction or alteration; (4) completion date for construction or alteration; and (5) a copy of the certificate of occupancy (as applicable). The construction report shall be delivered to the LAWA Designee at the address provided in Section 15.1 of this Lease not later than sixty (60) days following completion of the Recreational Improvement.
Construction Report. Devco shall have delivered to Spring Lane a construction report explaining the reason for the cost overruns, including copies of any change orders made under the EPC Agreement, and evidence reasonably satisfactory to Spring Lane that demonstrates that the Project is capable of achieving Completion in accordance with the Project Schedule, the EPC Agreement, and the Financing Documents.
Construction Report. If, as of the last day of each fiscal quarter ending on or prior to the Covenant Changeover Date, the cumulative Capital Expenditures actually made by the Borrower and the Restricted Subsidiaries for the Subject Project through and including such date are less than 70% of the budgeted cumulative Capital Expenditures for the Subject Project as of such date (as set forth in the most recently delivered Budget hereunder), then upon the Administrative Agent’s written request, the Borrower shall deliver, within sixty (60) days of such request, a report of an independent engineering firm or construction consultant reasonably acceptable to the Administrative Agent with respect to the Subject Project, which report shall be in form and substance reasonably satisfactory to the Administrative Agent and shall include a cost and valuation analysis with respect to the construction of the Subject Project.
Construction Report. A Construction Report in the form contemplated in Section 8.19 and dated as of the Closing Date.
Construction Report. The Administrative Agent shall have received (i) the most recent monthly Construction Report contemplated by Section 8.19, and (ii) the certificate of an Authorized Officer of the Borrower, both in the form contemplated in Section 8.19 and dated within fifteen (15) days prior to the proposed borrowing date.

Owner shall, upon the written request by Customer, at any time and from time to time prior to the In-Service Date of each Additional Project, provide to Customer a written report setting forth details of the progress of construction and completion of the Additional Projects. Owner shall notify Customer in writing of the projected In-Service Date of each Additional Project sixty (60) calendar days prior thereto. Owner also shall promptly advise Customer of any material developments related to the construction and completion of the Additional Projects, including any delays that may delay the anticipated In-Service Date with respect to any Additional Project. Owner shall use commercially reasonable efforts to comply with any reasonable request made by Customer in connection with the construction of the Additional Projects. 3
Construction Report. The Agent shall have received the Construction Reports contemplated in Section 8.19, substantially in the form of Exhibit G, which are due on or before the date of the Notice of Borrowing.
