CONSTRUCTION TIME. The scheduled date of Substantial Completion of the Construction Work (the “Completion Date”) and any applicable milestone dates shall be determined at the conclusion of the Design Phase and shall be set forth in the “Preliminary Construction Schedule” attached to the Construction Amendment as Exhibit E.
CONSTRUCTION TIME. (a) The CONTRACTOR agrees to complete all work and construction called for and as defined in the Contract Documents, to the satisfaction of the OWNER within the time for completion as specified in these Contract Documents.
CONSTRUCTION TIME. The construction phase is estimated to last 24 months. The remainder of subconsultants providing services are as follows: Traffic Subconsultant. Provide traffic control plans and striping plans for the entire pipeline alignment and geotechnical boring in Caltrans right of way. Tasks include: • Assemble existing traffic volume data for the pipeline routes. • Meet with the City of San Diego to discuss Traffic Control requirements. • Meet with the City or La Mesa and Caltrans to discuss the project and Traffic Control requirements for the project. • Prepare Traffic Control Plans for boring within Interstate 8. The plan will be prepared to permit closure of the Number 1 travel lane on Interstate 8 adjacent to the center median. The plan will be prepared to conform to Caltrans requirements. • Prepare Traffic Control Plans for Lake Xxxxxx Boulevard from approximately 1,100 feet north of Wisconsin Avenue to Wisconsin Avenue, Wisconsin Avenue west or Lake Xxxxxx Boulevard, crossing under Interstate 0, Xxxxxxxx Xxxx, 70th Street, Mohawk Street, 00xx Xxxxxx xxx Xxxxxx Xxxxxx. A total of twenty-five (25) Traffic Control Plan Sheets are proposed including title sheet, detail sheet and notes. • Prepare Striping Plans to restripe the following roadways: o Lake Xxxxxx Blvd. from 1,100 feet north of Wisconsin Avenue; o Wisconsin Avenue west of Lake Xxxxxx Blvd.; o Alvarado Road; o 70th Street from Xxxxxxxx Road to Mohawk Street; o Mohawk Street at 00xx Xxxxxx and 00xx Xxxxxx; and o El Cajon Blvd. at 69th Street. A total of three (3) Striping Plan sheets with two (2) strips per sheet are proposed. • Prepare Cost Estimates and Special Provisions for Traffic Control and Traffic Improvements. Tunneling Subconsultant. Analysis of soil conditions and trenchless methods will be selected to help determine a final alignment and tunneling method. Plans and specifications will be provided for the trenchless crossing. Construction period services will be provided; however, due to the unknown scope of work the trenchless consultant will give a scope and fee upon completion of design and funding will be provided from the “Additional Services” task. Corrosion Subconsultant. Design a cathodic protection system for the piping and associated appurtenances. Review 30% submittal and submit Cathodic Protection specification and drawings page numbers and titles. Prepare 60% cathodic protection drawings and technical specifications. CONSTRUCTION TIME. In accordance with Section 2.3 of the Agreement, the Preliminary Construction Schedule, setting forth the Completion Date for the Construction Work and any applicable milestone dates, is attached hereto as Exhibit E and incorporated in the Agreement by this reference.

CONSTRUCTION TIME. 21.1 Time is of the essence in the performance of this Contract. Contractor warrants that the Project shall be Substantially Complete within the Contract Time, provided that there are no unreasonable and unanticipated delays in completion of the design documents, unusual and unreasonable delays in obtaining any approval from a State or local governing agency or authority, or other occurrences which would form the basis for an extension of the Contract Time in accordance with this Agreement. The Contractor shall notify the County in writing of any deadline by which the Contractor needs design documents, approvals, or other information sufficiently in advance of such deadline so that any delay can be avoided. 21.2 The Contractor shall perform the services required herein as expeditiously as is consistent with reasonable skill and care for the orderly progress of the Work and as required hereinabove. In the event of any delay in achieving Substantial Completion of the Project resulting from any act or omission of the Contractor or any Trade Contractor, the Contractor shall pay the County the sum of one hundred fifty dollars ($150.00) per day for each and every calendar day of such delay in achieving Substantial Completion beyond the Contract Time. Any sums due and payable hereunder by the Contractor shall be payable, not as a penalty, but as liquidated damages representing an estimate of delay damages likely to be sustained by the County, estimated at or before the time of executing this Agreement. When the County reasonably believes Substantial Completion will be inexcusably delayed, the County shall be entitled, but not required, to withhold from any amounts otherwise due the Contractor an amount then believed by the County to be adequate to recover liquidated damages applicable to such delays. If and when the Contractor overcomes the delay in achieving Substantial Completion, or any part thereof, for which the County has withheld payment, the County shall promptly release to the Contractor those funds withheld, but no longer applicable, as liquidated damages. The term “Substantial Completion” as used in this Agreement shall mean that stage in the progression of the Work, as certified in writing by the Architect, when the Project is sufficiently complete in accordance with this Agreement that the County can enjoy beneficial use or occupancy of the Project and can utilize it for its intended purpose. CONSTRUCTION TIME. Builder agrees to commence excavation of the Building within working days after acceptance of this Contract and after all contingencies beyond the control of the Builder which may prevent commencement are satisfied or waived, including, but not limited to, financing, insurance, lot ownership, Builder's receipt of down payment (if any), escrow verification, building permits, change orders, plan revisions or subcontractor agreements. The Builder shall be the authority for the proper usage, arrangements and placements of fixtures, equipment and materials in accordance with recognized standards. The Building shall be completed in a good workmanlike manner in quality equal to the standards of the industry as expressed in the Construction Industry Quality Standards published by the Metropolitan Builders Association of Greater Milwaukee, Inc.
