Construction Timeline. Project Construction is anticipated to start in September 2013 and complete in December 2014. The proposed construction schedule details early completion of the DPAC amenities by September 2014, for use starting with the 2014-15 DPAC Broadway season. Use of the completed DPAC amenities will require partial certificate of occupancy as the construction of the DPAC amenities is part of the construction of the overall project. Project Construction will require close coordination with DPAC to ensure ingress/egress and operations are not impacted. Logistics and communications plans have been developed to address these issues prior and during the project construction. The DPAC amenities will coordinate with the existing DPAC in terms of transitions and appearance. Entry to the DPAC restrooms and the President’s Club will be seamless from the main second floor lobby. An added feature of the President’s Club is the separate entry available from the ground level without first entering DPAC. The flooring, ceiling and wall finishes of the new DPAC amenities will match or complement the existing DPAC finishes. ▇▇▇▇▇▇▇ Design, architect for the DPAC, is responsible for the complementary architectural design of the proposed development. The DPAC Amenities will cantilever outward on the second level to overlook the Plensa sculpture and DPAC plaza. This cantilever will be constructed of the glass curtainwall system similar to the DPAC, hence reinforcing the connection between the two spaces. On the interior, restroom finishes and fixtures will be the same as within the DPAC. The President’s Club Lounge will have carpet and wood flooring, floor-to-ceiling glass for views, and separate restroom facilities in addition to being constructed to accommodate audio-visual equipment throughout, beverage stations and seating/furnishings.
Construction Timeline. A. Attached as Exhibit D-2 is ▇▇▇▇▇▇’s baseline schedule to commence and complete the demolition of the Existing Improvements and complete the construction of the Project.
B. Commencing no later than one (1) month after the Commencement Date of the Lease, and on a monthly basis thereafter until the Substantial Completion of the Project, Tenant shall provide Landlord with a written report, including the current critical path method (CPM) schedule reasonably detailing Tenant’s compliance with the baseline construction schedule indicated in Exhibit D-2. The written report and schedule(s) shall be forwarded in electronic format showing all schedule logic for Landlord’s evaluation. In the event that ▇▇▇▇▇▇ fails to meet any of the milestones reflected in the baseline schedule, or anticipates failing to meet any of the milestones, the monthly report shall (i) identify the cause of the delay and anticipated impact on Tenant’s baseline schedule, (ii) document Tenant’s prior and ongoing efforts to achieve compliance with the milestone as soon as reasonably practicable, and (iii) update the baseline schedule and, if applicable, describe ▇▇▇▇▇▇’s plan to achieve compliance with the Longstop Completion Date.
C. In the event that Tenant fails to achieve Substantial Completion of the Public Facilities on or prior to the date that is 18 months after the Commencement Date, as such deadline may be extended pursuant to the terms of the Lease and this Exhibit (due to Force Majeure or otherwise), Tenant shall pay Landlord liquidated damages for each day of delay in the amount of $500.00 until the date of Substantial Completion of the Public Facilities. The payment of sums due under this provision (if any) shall be required no more frequently than monthly.
D. Tenant shall achieve Substantial Completion of the Project by the Longstop Completion Date. Tenant’s failure to achieve Substantial Completion prior to the Longstop Completion Date shall constitute an Event of Default, subject to the notice and cure periods set forth in Section 19.1(k) of the Lease. If Tenant fails to achieve Substantial Completion of the Project by the Longstop Completion Date, as such date may be extended for Force Majeure, then Tenant shall be required to pay to Landlord, as liquidated damages and not as a penalty, the Delayed Completion Damages, which shall be due and payable on the first (1st) Business Day following the Longstop Completion Date and on the same day of each month thereafter until the d...
Construction Timeline. The Foundation shall provide the City’s Project Manager with a construction timeline prior to commencing construction, for review and approval by the City’s Project Manager. The Foundation will forward, in electronic form, all relevant schedule documents and the City’s Project Manager shall respond as soon as possible, but no later than four (4) business days beginning with the business day following the submission to the City of all relevant materials. Similarly, any additional communications between the City and the Foundation concerning the construction timeline shall be as timely as possible but at the most four (4) business days. Any changes to the construction timeline must be approved, in writing, by the City following the same submittal requirements and review and approval timeline as the original timeline. Full lien waivers must be given to the City prior to the start of any construction. Construction work within the Parks Building cannot exceed four (4) months, measured from the first date construction begins. Construction of the Interpretive Center must be completed within that four (4) month period and no later than June 30, 2023.

Construction Timeline. The Trailhead Park and ▇▇▇▇▇▇▇▇ Creek Regional Trail shall be constructed and must be complete prior to final acceptance of the public infrastructure, which may occur after issuance of building permits if Developer has entered into a compliance agreement with the City contemplated in subsections 3.4.4.9 and 3.4.4.10 herein.
Construction Timeline. Attached to the Hospital Construction Agreement as an exhibit shall be a proposed construction timeline for the construction of the Hospital which sets forth dates by which significant pre-construction and construction actions shall be completed (“Construction Timeline”). Subject to the conditions precedent to the Parties’ obligations with regard to the financing and development, planning, design, construction and equipping of the Hospital, the Construction Timeline shall provide the date by which the selection process by public bid for a general contractor shall commence, the date for selection of the general contractor and the commencement of construction which shall be no later than September 1, 2016. Unless good cause exists as described below, ▇▇▇▇▇▇ shall complete all actions by the dates set forth on the Construction Timeline. Construction of the Hospital shall not begin until financing for the cost of construction has been secured as described in Section 3 of this Agreement and the Hospital Lease has been executed by the parties thereto. As used in the foregoing sentence, “construction of the Hospital” shall mean the point at which the ▇▇▇▇▇▇▇▇ Authority incurs an obligation to pay a contractor or contractors to construct the Hospital. The foregoing notwithstanding, the Hospital Construction Agreement shall provide that the ▇▇▇▇▇▇▇▇ Authority and ▇▇▇▇▇▇ shall negotiate in good faith to modify the date by which any particular action shall occur or be completed if it is reasonably foreseeable that the occurrence or completion of such action will be delayed past the date set forth in the Construction Timeline due to a reason outside the control of the parties, as described in more detail in the Hospital Construction Agreement.
Construction Timeline. In order to ensure timely delivery of the Public Park Improvements, the Owners shall ensure that commencement of construction of Public Park Improvements is underway before any one Owner has achieved the thresholds set forth below. Specifically, the Public Park Improvements must be under construction prior to or concurrent with the occurrence of any one of the following:
4.6.1. Issuance of the 280th building permit for the Citation Parcel; or
4.6.2. Issuance of the 134th building permit for the MS ▇▇▇▇▇▇▇; or
4.6.3. Issuance of the 193rd building permit for the SI Parcels; or
4.6.4. The cumulative issuance of 300 building permits for all of the Parcels. It is the joint responsibility of all Owners to ensure the Public Park Improvements are designed and approved in order to enable commencement of construction prior to the above- referenced triggers. The City may refuse to issue building permits to any Owner if the Public Park Improvements are not under construction as set forth herein, prior to the achievement of the milestones set forth above.
Construction Timeline. (a) Prior to Development Permit issuance for any development shown on the Site Plan attached as Schedule B, the Property Owner shall submit a detailed Construction Timeline to the satisfaction of the Development Officer.
(b) The detailed Construction Timeline shall provide details on the sequence and anticipated timing of construction for all elements of development, including but not limited to grading, paving, water and sewer servicing, stormwater servicing, construction, and landscaping.
Construction Timeline a. PCW, in coordination with the Barnstable DPW, shall develop, finalize, and deliver to the Town a Construction and Sequencing Plan (the “CS Plan”) by June 30, 2025.
b. The CS Plan shall be prepared in consultation with the Town and state officials. It will address the pace of work, traffic management, key milestones and appropriate amounts of ‘project float,’ and proposed work changes. Elements shall include adhering to construction sequencing unless the Town is otherwise notified, minimizing impacts to sensitive areas identified by the Town, and restoring roadways as quickly as possible. The CS Plan shall detail the experienced project management team, which shall routinely coordinate with the Town on project supervision and execution of work.
c. PCW will prepare an Emergency Response Plan (the “ER Plan”). PCW will work with the Barnstable DPW, the Hyannis Fire District and the Fire District with jurisdiction over the Onshore Substation site, with further consultation with other Fire Districts within the Town as appropriate, to incorporate the Town’s recommended procedures unless such procedures are infeasible, in which case, PCW and the Town will confer in good faith in an attempt to agree on appropriate alternatives as needed. PCW will provide a draft of the construction phase emergency response plan to the Town at least ninety (90) days prior to the start of construction and a draft of the operation phase emergency response plan to the Town at least ninety (90) days before the electricity flows into the substation. PCW shall also reach out to Eversource to learn about Eversource’s emergency response plan and practices.
d. PCW shall develop a duct bank schedule and make all reasonable efforts to meet this schedule in the course of the Second Project. PCW will provide the schedule to the Town, and the Town will coordinate with PCW and make all reasonable efforts as necessary to meet this schedule.
Construction Timeline. Planning and construction of the Visp Facility is currently scheduled to commence in [*] and proceed according to the estimated timeline set forth in Appendix F (as amended from time to time). Lonza shall provide Customer with regular updates regarding progress in the planning and construction of the Visp Facility, including prompt notifications of any significant deviations from the estimated timeline. Customer shall also have the right to review construction plans, and conduct a site visit, but shall not have the right to direct or coordinate construction and shall have no obligation with respect to capital expenditures related thereto. If a material delay in construction of the Visp Facility prohibits Lonza from completing delivery of Engineering Batches and Process Validation Batches under the obligations of this Agreement at the Visp Facility, then the provisions of Clause 2.1 shall apply.
