Data Monitoring. (a) Rogers has no obligation to monitor content or Customer’s and end users’ use of Rogers’ network. However, Customer agrees that Rogers has the right to monitor and investigate content and Customer’s and end users’ use of Rogers’ network electronically from time to time and to disclose any information as necessary to: satisfy any law, regulation or other governmental request or to assist in the pursuit of any legal action against Customer or end users; operate the Service(s) properly; ensure or enforce compliance with this Agreement; or protect Rogers or Rogers’ customers.

For specific information on monitoring, agencies should contact their funder or Continuum of Care representative. If your agency receives DCA funding, agency utilization of the system is monitored on a quarterly basis in addition to being monitored during on-site visits. Data Monitoring. The Managers shall capture and review emissions with the assistance of a consulting company on a per month basis. Emissions data validation to be performed by an independent verifier on an annual basis and for any other intermediate period, as necessary and available. Final verified data to be distributed to all interested parties both internally and externally as necessary (including the Vessel’s charterers at any relevant time with whom the Managers will communicate and share any relevant information and data for the purposes of EU ETS as required by the Owners).

Data Monitoring. If purchased by Customer, all data monitoring protocols and procedures shall follow the standards as set forth in the LTSA between both Parties.
Data Monitoring. Customer shall be responsible for collecting, monitoring and storing the data and alerts regarding the installed Products, to ensure that all operations conform to the required operating parameters of the Products, including cabinet temperatures and other operating parameters. In the event that a Defect in the Product or Product Components or problem in the performance of the Products is identified, or the Products are operating outside of expected parameters, Customer shall make best efforts to make available all related data to Supplier. Supplier shall promptly diagnose, repair or replace all necessary Product components so that the Products function consistent with the Product Specifications. If the performance problem is not covered by the Warranty, Customer shall reimburse Supplier for direct and actual documented expenses incurred, including Supplier’s labor. Supplier will collect all data necessary to be able to report information required by suppliers or manufacturers of Product components used in the Products and will report all such information in a timely manner. For the next generation product, Supplier agrees to provide additional data storage hardware at additional cost to the Customer in order to provide temporary storage, as means of data backup for the purpose of Warranty Claims and Capacity Performance Guarantee Claims in case there is date outage or corruption on Customer’s side.
Data Monitoring. Xxxxx has no obligation, but has the right at any time and from time to time, to monitor use of the Services (electronically or otherwise) as necessary to satisfy any law, regulation or investigate any information, data, files, pictures or content in any form or use of Services as necessary to operate the Services or to protect the rights or property of itself or others that are directly related to providing the Products and Services. Such monitoring shall include but not be limited to bandwidth consumption and how it affects operation and efficiency of the network and Rogers Services.
