The Enrolled Property is within the mid- and Lower Reaches of Parks Creek reach of the Covered Area. Baseline Conditions for the Enrolled Property are the conditions described in Appendix 2 of the Agreement for this reach. Elevated Baseline Conditions are certain Baseline Conditions improved as a result of certain Beneficial Management Activities. Elevated Baseline Conditions for this Site Plan Agreement include reducing tailwater impact on Kettle Springs Creek, upgrade screening and passage as part of the mid-Parks Creek project, and increased riparian grazing management. Table 2 summarizes the Beneficial Management Activities required to maintain Baseline Conditions and to achieve Elevated Baseline Conditions on the Enrolled Property for the term of the Site Plan Agreement. Although the Enrolled Property is not adjacent to the Shasta River or Parks Creek, the Enrolled Property is within the Lower Parks Reach of the Covered Area. Baseline Conditions for the Enrolled Property are the conditions described in Appendix 2 of the Agreement for this reach. Elevated Baseline Conditions are certain Baseline Conditions improved as a result of certain Beneficial Management Activities. Elevated Baseline for this Site Plan Agreement are the improved fish passage and flow conditions that will result from the following actions: construct pipeline infrastructure to increase efficiency and reduce tailwater production, construct a new point of diversion on the Shasta River at the Xxxxx Road bridge and abandon existing flashboard diversion structure on Parks Creek, and replacing the existing fish screen with an on channel self-cleaning screen at the relocated point of diversion. Table 2 summarizes the Beneficial Management Activities required to maintain Baseline Conditions and to achieve Elevated Baseline Conditions on the Enrolled Property for the term of the Site Plan Agreement. Description of Baseline Conditions. Baseline conditions for this Agreement are described with reference to each enrolled property. Included in each enrolled property, for the purposes of the baseline descriptions in this section, is the bed and banks of Chewacla Creek adjacent to that property. Nothing is this Agreement shall be construed to change or otherwise impact title to any lands. The baseline is described in terms of locations and numbers of covered species. The aquatic habitat within the enrolled properties is described in Xxxxxx and Xxxxxxx (2000) and Xxxxxxxxxx (2001). Between the upstream Water Board enrolled property and the Xxxxxx enrolled property, Chewacla Creek flows adjacent to multiple properties, the landowners of which are not parties to this Agreement. Populations of fine-lined pocketbook in Chewacla Creek in this area are described in Xxxxxxxx (2001). The following is the baseline description for each enrolled property in terms of locations and numbers of the covered species: Water Board enrolled property Xxxxxxxx et al. (2003) conducted a survey for freshwater mussels at the upstream Water Board enrolled property below Lake Xxxxxxxx Dam. Xxxxxxxx et al. located one (1) live fine-lined pocketbook individual, but located no southern clubshell or ovate clubshell individuals, in Chewacla Creek within the upstream Water Board enrolled property. Thus, the baseline for the upstream Water Board enrolled property is one (1) for the fine-lined pocketbook and zero for the southern clubshell and ovate clubshell. The downstream Water Board enrolled property is adjacent to Chewacla Creek near the Xxxxxx’x Mill Road bridge. Xxxxxxxx (2001) reported none of the covered species or any other member of the Unionidae family at xxx Xxxxxxx Mill Road bridge. Xxxxxxxxxx (2001) also reported none of the covered species at a site just upstream of xxx Xxxxxxx Mill Road bridge (site CH4). Thus, the baseline for all the covered species for the downstream Water Board enrolled property is zero. Xxxxxx enrolled property Xxxxxx (2002) conducted a survey for freshwater mussels at the Xxxxxx enrolled property. Xxxxxx located no live specimens of any of the covered species. Sampling performed by Xxxxxxxxxx (2001) in Chewacla Creek adjacent to the Xxxxxx enrolled property (site CH1B) also revealed none of the covered species.   • Safe Conditions Whenever an employee reports a condition which the employee feels represents a violation of safety or health rules and regulations or which is an unreasonable hazard to persons or property, such conditions shall be promptly investigated.   • Unbundled Loop Modifications (Line Conditioning 2.5.1 Line Conditioning is defined as routine network modification that BellSouth regularly undertakes to provide xDSL services to its own customers. This may include the removal of any device, from a copper Loop or copper Sub-loop that may diminish the capability of the Loop or Sub-loop to deliver high-speed switched wireline telecommunications capability, including xDSL service. Such devices include, but are not limited to, load coils, excessive bridged taps, low pass filters, and range extenders. Excessive bridged taps are bridged taps that serves no network design purpose and that are beyond the limits set according to industry standards and/or the XxxxXxxxx XX 00000.

  • BASIC CONDITIONS The State shall have no obligation to disburse money for the Project under this Grant Agreement until the Grantee has satisfied the following conditions:

  • Unsafe Conditions In accordance with 29 CFR § 1977, occasions might arise when an employee is confronted with a choice between not performing assigned tasks or subjecting himself/herself to serious injury or death arising from a hazardous condition at the workplace. If the employee, with no reasonable alternative, refuses in good faith to expose himself/herself to the dangerous condition, he/she would be protected against subsequent discrimination. The condition causing the employee's apprehension of death or injury must be of such a nature that a reasonable person, under the circumstances then confronting the employee, would conclude that there is a real danger of death or serious injury and that there is insufficient time, due to the urgency of the situation, to eliminate the danger by resorting to regular statutory enforcement channels. In addition, in such circumstances, the employee, where possible, must also have sought from his Employer, and been unable to obtain, a correction of the dangerous condition.

  • GEOGRAPHIC AREA AND SECTOR SPECIFIC ALLOWANCES, CONDITIONS AND EXCEPTIONS The following allowances and conditions shall apply where relevant: Where the company does work which falls under the following headings, the company agrees to pay and observe the relevant respective conditions and/or exceptions set out below in each case.
