Dual Rate Supervisors/Dual Rate Table Games Inspectors. Where an employee is acting in the capacity of a Supervisor, it is understood that their supervisory duties are management responsibilities and are not the subject of this Collective Agreement. Where an employee is acting in the capacity of a Table Games Inspector, it is understood that their duties are not management responsibility and are the subject of this Collective Agreement. The Employer will make efforts to ensure that scheduled hours in the Dual role will be equalized over a reasonable period. It is understood that this is subject to both operational considerations and the skill and ability to perform the available work and employees must identify to the Employer where they have concerns over the scheduling so that these may be addressed. Where a Dual previously held a base position at OLG Casino Brantford and wishes to return to that position, he or she will provide at least two (2) weeks notice and when operationally possible, and has the skill, ability and qualification, will be returned to his or her base position. Where a Dual has not held a base position, he or she may at any point after six (6) months in the role may apply for any posting in the Casino. At any point, if the employee and the Employer agree or if the employee is not meeting the Employer’s expectations as a Dual Rate Supervisor/Dual Rate Table Games Inspector, the employee will be returned to their primary position without loss of seniority. It is agreed that where an employee has agreed to act as a Dual Rate Supervisor, the Employer will ensure that this person is identifiable as a Supervisor to employees in the bargaining unit. A Dual Rate Supervisor is a Supervisor, and the Employer will not agree to limits on the duties or selection thereof. However, as discussed, the Employer will remain aware of the issues that could potentially arise if these individuals impose discipline. Similarly, it is agreed that a Dual Rate Supervisor cannot be a Union Xxxxxxx. In selecting vacation, it is understood that Dual Rate Supervisors/Dual Rate Table Games Inspectors should select independently of Supervisors and their primary position as this role forms part of the system of ensuring that there is adequate coverage. This system will have regard to their seniority in the primary role. Duals vacation pay calculation will be paid as a blended rate based upon the ratio of time spent as a Dual. Under penalty of false swearing, a principal of the contracting firm shall certify that the proposal for rental rates and proposal for wage rates do not exceed current costs for like services. The Owner will in no event consider a rental rate in excess of eighty percent of the rate set forth in the latest edition of the "Compilation of Nationally Averaged Rental Rates for Construction Equipment" of the Associated Equipment Distributors unless the rates proposed in excess of eighty percent are supported by proof satisfactory to the Owner that the excess rates are reasonable. If the equipment is owned by the Contractor the costs shall be charged at a maximum of eighty percent of market monthly rental rates for the amount of time used. If applicable, transportation costs may be included. The decision of the Owner shall be final, binding and conclusive on all parties. Rental rates shall be payable only for the actual time the equipment is required on the Site.

Neither Xxxxxx Xxx nor the Paying Agent shall have any liability or responsibility to any Person for (i) the Paying Agent’s selection of New York City banks for purposes of determining any Reserve Interest Rate or (ii) its inability, following a good-faith reasonable effort, to obtain the applicable rates or quotations or to determine the arithmetic mean of such quotations, all as provided for in the Prospectus.
