Exclusions from Bargaining Unit. The following Tumwater School District employees are excluded from representation 15 under this Agreement: the Superintendent; Assistant Superintendent; Administrative 16 Assistant; Business Manager; Director of Secondary Programs; Director of Elementary 17 Programs; Director of Special Services; Director of Student, Parent and Staff Support; 18 Director of Special Projects; Director of Human Resources; Principals; Assistant 19 Principals; other District Office Administrators; and casual employees. 20
Exclusions from Bargaining Unit. 1. Any position that is currently included in the bargaining unit may not be excluded from the bargaining unit without the mutual agreement of the parties.
a. Any exclusion shall be determined on the basis that the position involves:
i. any of the functions outlined in the Labour Relations Code as the basis for exclusion from the definition of an "employee"; or
ii. the functions of a director of instruction as provided by the School Act; or
iii. includes any duties regarding the supervision and evaluation of teachers as designated to principals and vice- principals in the School Act.
b. Failure by the parties to reach mutual agreement shall result in the parties referring the matter directly to arbitration pursuant to Article A.6 (P.C.A.6).
c. The Board shall notify the Association of any newly created position offered in the District, including a written description of the position, prior to posting.
d. Any newly created position requiring a teaching certificate shall be included in the bargaining unit unless the position is excluded by mutual agreement of the parties. The provisions of Article A.23.1.a and A.23.1.b shall apply.

2. Any exclusions shall be determined on the basis that the position involved:

Exclusions from Bargaining Unit. 1. The bargaining unit shall exclude all other employees of the College, all students (other than bargaining unit members enrolled in classes), all individuals who are not “public employees” as defined by Revised Code Chapter 4117 and all employees whose employment is dependent on externally-funded sources.
Exclusions from Bargaining Unit. The bargaining unit shall exclude substitute teachers, temporary employees, non-certificated personnel, administrators and any other personnel employed to perform managerial and/or supervising duties.

4. If there is no agreement as to the application of Article A.20.3, the matter may be referred to the step in the Grievance Procedure immediately preceding Arbitration.
Exclusions from Bargaining Unit. QA1. Is there a minimum top-up that puts someone into the Bargaining Unit? AA1. If by “top up” you are referring to a payment by a Faculty Supervisor to a Postdoc, the answer to the question is, no, because the recipient of any such payment would not have a sole source of funding and would, therefore, be included in the bargaining unit.
