In the event the parties cannot agree, the question of inclusion or exclusion may be referred to the relevant labour relations legislation. Where the parties fail to agree and pending a decision from the relevant body administering the labour relations legislation, the position may be filled and worked.

(b) all dependent contractors and owner/operators employed by Companies signatory to this Agreement in the work categories falling within the area of jurisdiction of this Agreement

(a) The Company agrees to recognize the Union as the sole collective bargaining agent for all Owner Operators and Drivers of Owner-Operators (“Driver”, "Drivers", or Owner-Operator Drivers) as referred to in Order No. 10616-U issued by the Canada Industrial Relations Board. The Parties agree to apply to the Canada Industrial Relations Board to amend the current certification to remove “Drivers of Owner-Operators” from the certification.
(b) Every Owner Operator of the Company covered by this Agreement shall be a member of the Union in good standing during the whole of the term of this Agreement as a condition of employment with the Company, save as hereinafter expressly provided.

5.02 When OUC creates a new position which does not fall within Appendix A, and for which the assigned duties might reasonably be deemed to come within the bargaining unit for which the Union is certified, OUC shall consult with the Union to determine whether or not that position ought to be included as a new classification in this Agreement.
CERTIFICATE OF BARGAINING AUTHORITY. 3.01 The Employer agrees to recognize the Union as the Sole Bargaining Agent for: Employees and categories of employees referred to in the Certificate of Bargaining Authority held from time to time by the Union, and where voluntarily recognized by the Company.
3.02 This Agreement shall apply to all employees of the Employer who are employed in classifications set forth under Schedule "A".
3.03 All members of the Union shall receive a copy ofthis Agreement, which is binding upon the bargaining authority and every employee in the unit for which the Union as recognized by this Agreement. The Union shall be responsible for the word processing and electronic delivery of these Collective Agreements to one designated contact at the Employer, and the Employer will be responsible to distribute such agreements so that each and every employee ofthe Employer receives a copy.
