The Board has the right to establish and add a new impact area for any new program, which does not fit into an existing area (e.g. a new trade area or a new interdisciplinary area).
Impact Areas. For the purpose of reducing staff, teachers shall be grouped into the following impact areas.
1. K-6 the targeted position and the grade level above and below will constitute the impact area. For those positions at either end of the impact area the closest two grade levels shall be included in the impact area.

1. Length of employment: defined as current and continuous years of service for the School Unit (and including current and continuous years of service for SAD47/China Schools if employed as of July1, 2009).
2. Academic preparation: defined as course work, degree level, specialized training and experience in other locations.
3. Authorization (for Educational Technicians only): defined as current areas of authorization as recognized by the Maine Department of Education.
4. Job performance from performance evaluations. In the event of a reduction in force, the employee whose position is to be eliminated may displace the employee with the least seniority in his/her current impact area, unless the Superintendent determines that the least senior employee by reason of training, qualifications or job performance from performance evaluations is more capable of meeting the needs of the School Unit than a more senior employee in the same impact area, in which case the least senior employee may be retained.

Teachers holding multiple certificates will still be placed in an impact area by the certificate they are working under at the time of the reduction in force.

One-on-one Ed Tech’s may be hired to meet individual student needs as identified by an IEP or a Section 504 team. Since each student situation is unique, each one-on-one position will be considered separately. However, a terminated employee may be recalled to fill a position with similar job requirements. The employer shall give the Association and the affected individual at least ten (10) working days notice of any layoff. One-on-one employees will give ten (10) working days notice of resignation.
a. This provision does not apply to an Educational Technician who was already employed in this bargaining unit by RSU 39 and was transferred to a one-on- one position. Such an employee shall continue to accrue seniority in his / her specific impact area and shall be subject to the RIF procedure.
Impact Areas. A. PreK-8 (kindergarten through grade eight, including Title 1 classroom teachers). When the need arises to eliminate a classroom teacher K-8, the impact area to be considered is K-8, which includes grades 7 & 8.
