Implementation Note. Notwithstanding (b), any employee with bargaining unit seniority who is out of the bargaining unit as of the date of the award and who returns to the bargaining unit within 1 year from the date of the award (June 4, 1996) shall not forfeit their seniority.

Implementation Note. The following provision will appear in all collective agreements where both full-time and part-time employees are represented by and will replace any provision related to part-time Transfer of Service and Seniority that existed in the expiring collective agreement: "Effective (the date as set out in the Local Provisions Appendix) and for employees who transfer subsequent to (the effective date as set out in the Local Provisions Appendix): For application of seniority for purposes of promotion, demotion, transfer, layoff and recall and service for purposes of vacation entitlement and wage progression: an employee whose status is changed from full-time to part-time shall receive full credit for his seniority and service; an employee whose status is changed from part-time to full-time shall receive credit for his seniority and service on the basis of one (Iy)ear for each hours worked. The above-noted employee shall be allowed a trial period of up to thirty (30) days, during which the Hospital will determine if the employee can satisfactorily perform the job. Within this period the employee may voluntarily return, or be returned without loss of seniority to his former duties on the same shift in the same department and at the appropriate rate of pay, subject to any changes which would have occurred had he not transferred."

Inthe event of a proposed layoff at the Hospital of a permanent or long-term nature or the elimination of a position within the bargaining unit, the Hospital shall: provide the Union with no less than six (6) months' written notice of the proposed layoff or elimination of position; and provide to the affected if any, no less than six (6) months' written notice of layoff, or pay in lieu thereof.
Implementation Note. For the purposes of accumulation of seniority, transfer of seniority and service, progression on the wage grid and progression on the vacation schedule, all part time employees' service and seniority shall be converted as at October on the following basis: Employee's hours of service x = converted hours of service. Transfer of Service and Seniority Effective October and for employees who transfer subsequent to October an employee whose status is from full time to part time shall receive credit for his/her full service and seniority on the basis of one thousand, seven hundred and twenty-five hours for each year of full time service and seniority. An employee whose status is from time to full time shall receive credit for and on of one year equals one thousand, seven and twenty-five hours worked, and will be enrolled in the employee benefit plans subject to waiting period or other requirements of those plans. Employees hired prior to October will be credited with the service and seniority they held under the Collective Agreement expiring November not applicable Seniority lists of who have shall be maintained by the Hospital for each non-interchangeable group. Each list shall have the employee's seniority date (in hours) and his classification. Seniority lists shall be provided by the Hospital to the Union in January and July of each year and the seniority lists in January of each year shall carry the employee's sick leave credit i.e., the amount of days in their sick back, in addition to other information contained on the seniority list.
Implementation Note. For those headings containing a reference to this note, if the expiring collective agreement applied to part-time employees, the existing provision shall continue, amended as appropriate by any amendment to the full-time provisions. Employees determined as will be paid as per Wage Schedule I f , at the end of the calendar year it is determined that a employee's earnings as per the definition were less than annually, the employee shall receive a retroactive wage payment to the extent that the total of the items included for the pur- poses of earnings under the definition, including wages, does not exceed for the calendar year. If, at the end of the calendar year it is determined that a employee's earnings as per the definition were greater than annually, such employee shall repay to the Hospital the overpayment of wages received in the calendar year to the extent that to do so does not reduce annual earnings below The Hospital may recover the money by payroll deduction, and the employee and the Union agree that this repayment is hereby consented to, for the purposes of the Employment Standards Act.
