JOB SECURITY AND JOB PROGRESSION. (A) The Pennsylvania Public School Code includes certain job security provisions, certification and other regulatory provisions associated with the various classes of employees. The parties hereby aver that such provisions of the School Code represent their complete agreement and that such provisions shall govern the manner in which the job security, job progression and reduction in force practices shall be effected with respect to members of the bargaining unit.

JOB SECURITY AND JOB PROGRESSION. 1. The Pennsylvania School Code includes certain job security provisions, certification and other regulatory provisions associated with various classes of employees. The parties acknowledge that the School Code governs the manner in which job security, job progression, and reduction in force practices are to be effected with respect to members of the bargaining unit. 2. In the event the District determines that a reduction in staff may be necessary, the District will notify the Association in writing as early in the year as possible but no later than May 15th of the school year immediately preceding the school year in which such reduction is to take effect. It is understood that the District will make any determination regarding a reduction in staff based upon only irrevocable professional staff retirements and resignations that have been presented to the District by that date. 3. Employees to be furloughed as a result of the District’s decision to reduce staff will be notified in writing by the District no later than ninety (90) days prior to the date on which such furlough is to become effective. 4. Social Workers, Occupational Therapists, and Athletic Trainers are not considered “temporary professional employees” or “professional employees” in Article XI of the Public School Code. The provisions related to job security and job progression do not apply to Social Workers, Occupational Therapists, or Athletic Trainers.

JOB SECURITY AND JOB PROGRESSION. Nothing contained herein shall be construed to deny or restrict to any educational support personnel employee such rights as he/she may have under the Public Employee Relations Act, Act 195, Act 88, or the Public School Code of 1949, as amended, or other applicable laws and regulations. The rights granted to employees hereunder shall be deemed to be in addition to those provided elsewhere. There will be no outsourcing over the duration of the July 1, 2021 – June 30, 2026 contract. This provision will sunset at the end of the July 1, 2021 – June 30, 2026 contract.

In cases in which suspensions are to be made, professional employees shall be retained on the basis of seniority rights (in the field of certification) acquired within the school district. Any provision of this section that would be in violation of, or inconsistent with, or in conflict with any statute or statutes enacted by the General Assembly of the Commonwealth of Pennsylvania shall not be implemented.

  • Security and Safety A. The Contractor warrants it is and shall remain in compliance with all applicable local, state and federal laws, regulations, codes and ordinances relating to fire, construction, building, health, food service and safety, including but not limited to the Hotel and Motel Fire Safety Act of 1990, Public Law 101-391. The Judicial Council may terminate this Agreement, pursuant to the termination for cause provision set forth herein, without penalty or prejudice if the Contractor fails to comply with the foregoing requirements. B. The Contractor shall assure that each Attendee is advised of all the appropriate precautions that should be taken to provide for the Attendee’s safety while on the Property. The Contractor shall take every reasonable precaution to provide for the security of Attendees and their belongings. C. The Contractor shall immediately advise the Judicial Council’s staff of any known problems that involve the Attendees during the Program including, but not limited to, assaults, burglaries, accidents, and/or illnesses.
