JOB SECURITY AND JOB PROGRESSION. (A) The Pennsylvania Public School Code includes certain job security provisions, certification and other regulatory provisions associated with the various classes of employees. The parties hereby aver that such provisions of the School Code represent their complete agreement and that such provisions shall govern the manner in which the job security, job progression and reduction in force practices shall be effected with respect to members of the bargaining unit.

JOB SECURITY AND JOB PROGRESSION. Nothing contained herein shall be construed to deny or restrict to any educational support personnel employee such rights as he/she may have under the Public Employee Relations Act, Act 195, Act 88, or the Public School Code of 1949, as amended, or other applicable laws and regulations. The rights granted to employees hereunder shall be deemed to be in addition to those provided elsewhere. There will be no outsourcing over the duration of the July 1, 2021 – June 30, 2026 contract. This provision will sunset at the end of the July 1, 2021 – June 30, 2026 contract.

Whenever the Board of School Directors decreases the size of the staff of professional employees, reductions as a result of attrition will be given first consideration. In cases in which suspensions are to be made, professional employees shall be retained on the basis of seniority rights (in the field of certification) acquired within the school district. Any provision of this section that would be in violation of, or inconsistent with, or in conflict with any statute or statutes enacted by the General Assembly of the Commonwealth of Pennsylvania shall not be implemented.

In the event that additional provisions not inconsistent or in conflict with those enumerated in the School Code shall be agreed upon by the parties with respect to job security, job progression, and reduction in force, such provisions shall be evidenced by a revised Appendix C which shall be executed by the parties and attached hereto and made part of this agreement.

  • Transfer of Seniority and Service For application of seniority for purposes of promotion, demotion, transfer, layoff and recall and service (including meeting any waiting period or other entitlement requirements) for purposes of vacation entitlement, HOODIP or equivalent, health and welfare benefit plans, and wage progression:

  • Training and Orientation (a) No employee shall be required to work on any job or operate any piece of equipment until he/she has received proper training and instruction.

  • CONTRACTOR NAME CHANGE An amendment is required to change the Contractor's name as listed on this Agreement. Upon receipt of legal documentation of the name change the State will process the amendment. Payment of invoices presented with a new name cannot be paid prior to approval of said amendment.
