Jury Duty and Subpoena Leaves. 9.6.1 Bargaining unit members shall be granted paid leave for jury duty which is served and which is not voluntary (e.g., Grand jury service for which a person volunteers). The bargaining unit member shall provide the district human resources office with a copy of the jury duty notice as soon as it is received. The district reserves the right to discuss with the bargaining unit member the practicality of seeking exemption and/or deferment when jury duty would disrupt classroom instruction. The district will compensate a bargaining unit member who actually performs jury service by paying said bargaining unit member for service missed due to jury service. Such compensation shall be at the hourly rate appropriate to the class or service missed. Bargaining unit members shall submit to the district any fees received for jury duty, excluding travel and subsistence expenses, except when assigned classes are not missed. The district requires the bargaining unit member to perform his/her duties scheduled on the day of the jury service which does not conflict with the jury service. 9.6.2 Whenever any bargaining unit member is served with a subpoena which compels attendance as a witness, unless a party or an expert witness, said member shall be granted leave of absence with pay equal to the difference between the bargaining unit member’s regular pay and any amount received for his/her appearance.

Jury Duty and Subpoena Leaves. An Employee who is required to serve as a juror shall receive regular wages. In order to receive payment for such duty, the Employee must submit certification of service and assign all fees, except mileage and parking allowance, received for such duty, to the district. When released from a duty during working hours in the A.M., the Employee shall report to work and work in the P. M. schedule. An employee who is subpoenaed as a witness in a court or administrative hearing will be given leave with pay for the absence (without deduction from other leave allowances), unless the employee is a party to or beneficiary of the action, or is testifying against the District. To be entitled to paid leave, the employee must also notify the District promptly upon receiving the subpoena, and must remit to the District any witness fees paid to the Employee, except expense reimbursements.

  • Jury Duty and Subpoena Leave Leaves of absence with pay shall be granted for jury duty. Any compensation received for jury duty performed on contracted days shall be deducted from the employee's salary. The employee shall notify the District when notification to serve on jury duty is received. Leaves of absence with pay shall be granted when an employee is subpoenaed to appear in a court of law.   • Jury Duty Leave A regular, limited-term or probationary employee who is called for jury duty or for examination for jury duty shall be compensated at the employee's regular rate of pay for those hours of absence due to the jury duty which occur during the employee's regularly scheduled working hours provided the employee deposits the employee's fees for such hours of jury duty, exclusive of mileage, with the County Treasurer. Fees for jury duty performed during hours other than regularly scheduled working hours may be retained by the employee. Any hours worked beyond the regularly scheduled workday shall be subject to the workweek and overtime provisions (Article I). Employees summoned for jury duty will be granted a leave of absence with pay for time lost from their regular work schedule while on said jury duty upon presentation of the appropriate summons to the department head by the employee. B. An employee who receives jury fees for jury service upon presentation of the appropriate court certificate of service, shall either: 1. Retain such jury fees in lieu of pay for the period of jury service if the jury fees exceed his/her regular rate of compensation for the period involved; or 2. Remit to the Appointing Authority the jury fees if less than his/her regular rate of compensation for the period involved. C. Jury fees for the purpose of this Article shall be the per diem rate paid for jury duty by the court not including the expenses reimbursed for travel, meals, rooms or incidentals. D. An employee summoned as a witness in court on behalf of the Commonwealth or any town, city or county of the Commonwealth or on behalf of the Federal Government shall be granted court leave with pay upon filing of the appropriate notice of service with his/her department head except that this Section shall not apply to an employee who is also in the employ of any town, city or county of the Commonwealth or in the employ of the Federal Government or any private employer and who is summoned on a matter arising from that employment. E. All fees for court service except jury fees paid for service rendered during office hours must be paid to the Commonwealth. Any fees paid to an employee for court service performed during a vacation period may be retained by the employee. The employee shall retain expenses for travel, meals, rooms, etc. F. An employee on court leave who has been excused by the proper court authority shall report to his/her official duty station if such interruption in court service will permit four or more consecutive hours of employment. Court leave shall not affect any employment rights of the individual. G. No court leave shall be granted when the employee is the defendant or is engaged in personal litigation.

  • Subpoena Leave Each Faculty Member shall be granted leave at full pay when subpoenaed as a witness, other than as a defendant or plaintiff, in a criminal or civil trial which has resulted directly from an incident which took place during any District sponsored activity including all class and laboratory sessions, Associated Student Body sponsored events, Athletic contests or required meetings held either on or off the college's campuses. Such leave shall be restricted to personal appearance under a subpoena issued by a court of competent jurisdiction, and only in matters as defined above. All leave for appearances as a witness other than those described above shall be granted only under the provisions of Section 11.4 Personal Necessity Leave, or, with the approval of the appropriate Vice President as unpaid leave.
