Jury Duty and Subpoena Leave. Leaves of absence with pay shall be granted for jury duty. Any compensation received for jury duty performed on contracted days shall be deducted from the employee's salary. The employee shall notify the District when notification to serve on jury duty is received. Leaves of absence with pay shall be granted when an employee is subpoenaed to appear in a court of law. If any witness fees are paid, that amount shall be deducted from the employee's regular pay. Any transportation, meal, or lodging expense reimbursement shall be retained by the employee.

Instructional personnel serving on jury duty shall retain their jury-duty pay without loss of their regular school pay if an application for leave is submitted with a copy of the summons and the application is approved. Instructional personnel required by subpoena to miss a regular work day to serve as a witness in court in connection with duties as an employee in the School District of Okeechobee County, Florida, or in a court action in which they are not party to the litigation, shall receive regular pay provided that an application for leave is submitted with a copy of the subpoena and the application is approved. All such leave requests must clearly indicate the reason for the court summons. If an employee is called for jury duty or is subpoenaed as a witness in a court case, the employee will be entitled to paid leave for the hours of work necessarily lost as a result of such service. Fees received by the employee for such service shall be kept by the employee and the employee’s salary will be reduced by a like amount. (This does not apply to travel or subsistence expenses.) This entire provision does not apply in any case where the employee or the Association is a complainant in any case against the District.

Any compensation received by a staff member for jury duty performed on a contract day is to be reimbursed to the District. The District shall grant a maximum of two days leave (witness fees to be reimbursed to the District) to staff subpoenaed as witness in court or other legal proceedings; provided that a leave with pay shall not be granted to a staff member for a cause brought or supported by a staff member union or association or for a case in which staff member has a direct or indirect interest in the proceedings.
