Layoff Procedure--Waive Seniority. In the event of a layoff, the Employer and Association may mutually agree to allow individual Employees to waive their seniority rights for the purpose of the layoff. With the approval of the Employer and Association, Employees may, at their option, without prejudice to seniority and other rights under the Agreement, waive their seniority in the instance of the Employer instituting a layoff during the period of this Agreement. Such waiver, if authorized by the Employee, shall not be construed to be a waiver of seniority or any other right under the contract including the Employee's right to be recalled from such layoff. If such an agreement is reached, the following form shall be used: Individual Agreement The undersigned hereby agrees to waive his/her seniority for purposes of the Xxxxxxx Community Schools impending institution of a layoff under the Agreement. This waiver is given, however, without prejudice to the assertion of seniority for all other purposes contained in the Agreement, including recall rights and other contractual privileges or benefits conferred under the Agreement. This waiver pertains solely to the order in which said Employee might be laid off during the period of this Agreement.   • Equal Seniority If two (2) or more employees subject to layoff have equal class seniority, the determination as to who shall be laid off will be made on the basis of the greater hire date seniority, and if that be equal, then the determination shall be made by lot.
