The SENIORITY, LAYOFF, RECALL clause establishes the rules governing how employee seniority affects decisions related to layoffs and the process for recalling employees to work. Seniority Layoff - Recall. Employees will be laid off or reduced to part-time when necessary in reverse order of seniority providing the senior employee possesses the required qualifications and demonstrated ability to perform the necessary job functions after a thirty (30) day familiarization period. Seniority Layoff - Recall. Section 1. Seniority standing shall be granted to all employees covered by this Agreement. The standing is to be determined on the basis of service to the district from the date of regular employment in the bargaining unit with the Plymouth-Canton Board of Education. Seniority for regular full or part time cafeteria staff shall be defined as total years of service, including time on leave of absence or layoff, in the bargaining unit. All new employees shall be placed on the seniority list as of the first day of employment, upon the completion of a probationary period of sixty (60) working days of employment. Probationary employees may be discharged or disciplined by the Employer without the same causing a breach of this Agreement or constituting a grievance. If two (2) or more employees have the same seniority date, their position on the seniority list will be decided by a lottery system, upon completion of the probationary period. A representative of the Association, designated by the president will meet with the Employer to conduct the lottery. Employees involved may be present at the lottery if they so desire.
Section 2. Seniority shall be terminated if the employee resigns, retires, is discharged, or refuses a recall from layoff.
Section 3. Employees are expected to give two (2) weeks’ notice of resignation.
Section 4. Employees shall be laid off and recalled according to their seniority in their classifications. An employee on scheduled layoff shall have the right to displace a lesser seniority employee who is in a lower classification provided the senior employee is qualified to hold the position held by the employee. At no time will a less senior person be retained and a more senior person laid off provided the more senior person has the qualifications required for the job, with agreement between association president or designee and management. Employees who are reduced in hours by 25% or more shall have the option of displacing the lowest seniority in their classification who has comparable hours, and/or hours as close as possible. Employees who do not qualify for benefits due to the reduction of their hours shall have the option of displacing the lowest seniority in their classification who qualifies for benefits. Seniority Layoff - Recall. Where the qualifications, experience and ability of employees are relatively equal, and where the candidate has satisfactory compatibility with the supported individual, to be assessed by the Employer within fourteen (14) days of work in the position, seniority shall be the governing factor in matters of layoff and recall.
Seniority Layoff - Recall. A. All newly hired employees will be considered to be in a probationary status for a period of forty-two (42) working days. At the discretion of the Superintendent, a probation period may be extended a maximum of twenty-one (21) working days. An employee successfully completing probation shall have a seniority date effective with the date of hire. The extension of a probationary period is not subject to the Grievance Procedures. B. Employees will hold two seniority dates:
1. District Seniority - District seniority is defined as continuous service with the district from the employee’s last date of hire.
2. Classification Seniority - Classification seniority is defined as the length of service with the district in a particular classification. An employee may earn seniority in more than one classification at a time. Seniority shall remain separate for each classification. Classifications are as follows:
a.) Bus Drivers
b.) Cafeteria Personnel c.) Custodians
d.) Maintenance Employees e.) Mechanics

Seniority Layoff - Recall. Insofar as the members covered by the Agreement are concerned, seniority provisions are solely for the purpose of determining a member's position for the drawing of designated holidays and vacations and for the purposes of layoff and recall.
Seniority Layoff - Recall. Section 1: Bargaining unit seniority is understood to mean an employee's most recent date of continuous pro-rated full-time service in a bargaining unit position, so long as the employee is being carried for payroll purposes as a permanent employee. (Note: due to the elimination of the "Grant" classification, service in Grant funded bargaining unit positions prior to July 5, 1992 shall be counted toward bargaining unit seniority as described in this Article.) Bargaining unit seniority will continue to accrue during all types of County approved leave including leave of absence without pay or layoff, up to one (1) year. Approved leave for Union business shall not cause the seniority date to be adjusted.
Section 2: Unit seniority will be used for the purpose of vacation selection as provided in Article 20, shift bidding as provided in Article 6, ▇▇▇▇▇▇ and recall as provided for in this Article.

Seniority, as that term is used in this Agreement, is defined as an employee's continuous service with the Fire Division of the City, as a full time regular employee to be computed from the employee's last date of hire. Seniority Layoff - Recall. 12.01 (a) All new employees shall be considered on a probationary basis for the first four hundred and seventy-five (475) hours of work with the Company within any period of twelve (12) consecutive months. Employees shall be considered probationary employees until they have become eligible for the seniority list and probationary employees shall not have any seniority rights. Upon completing the probationary period, an employee shall be entitled to have their name placed on the seniority list and employees' names shall appear on the seniority list in the order of their respective dates of hiring. Effective March 1, 2011, all employees hired on the same day will be put into a lottery to determine their placement on the seniority list. The retention of probationary employees shall be at the discretion of the Company.
