Lessee’s Repair and Maintenance Obligations. Lessee shall at all times during the Term, repair and maintain the Premises in good and tenantable condition, and coordinate Minor Maintenance and repairs as delineated in this Article. Upon surrender of the Premises, Xxxxxx shall deliver the Premises to County in good order, condition and state of repair, but shall not be responsible for damages resulting from ordinary wear and tear. Lessee shall provide for trash removal, at its expense, and shall maintain all trash receptacles and trash areas in a clean, orderly and first-class condition. Any proposed remodel of the Library by Xxxxxx, that involves reconstruction of structural building elements, relocation of interior walls, or removal of building finishes, must be approved in advance by the County.

Lessee’s Repair and Maintenance Obligations. In connection with Paragraph 7.1 of the Lease, all repairs and maintenance of the Premises by Lessee as required under the Lease shall be performed in a first class manner by contractors and other personnel reasonably approved by Lessor, shall be performed in accordance with a repair and maintenance plan reasonably approved by Lessor, and shall comply with guidelines and shall meet such standards of quality as may be reasonably established by Lessor from time to time during the Lease Term, including, without limitation, providing Lessor with copies of all permits obtained by Lessee and “as-built” drawings of such work performed by Lessee.

Lessee’s Repair and Maintenance Obligations. A. Lessee shall, at its cost and expense, maintain the Premises, and all improvements located thereon, in good order and repair, in a clean and sanitary condition, and shall make all necessary repairs, including all necessary replacements, alterations and additions, using material and equipment of similar or superior kind and quality to the original improvements. B. Lessee is not responsible for maintaining any contiguous City- owned property (including but not limited to Demens Landing, streets, sidewalks, and offsite parking areas) or for maintaining the City’s public utility system providing utilities to the Premises (e.g., potable water, reclaimed water, sanitary sewer); provided, however, that nothing contained herein may be construed as excusing Lessee from paying any applicable fees for such utilities.
Lessee’s Repair and Maintenance Obligations. Lessee shall, at Xxxxxx’s sole cost and expense and in accordance with the terms of this Lease, at all times during the Lease Term keep and maintain the Premises, including all Lessee improvements, Alterations, fixtures and appurtenances (including, without limitation, landscaping and parking areas) now or hereafter on the Premises and keep, maintain and operate the Premises and the Hospital Assets in good and safe condition, repair and working order and shall from time to time make or cause to be made all necessary and appropriate repairs, renewals, replacements, upgrades, remodels, and improvements to the Hospital Assets such that all of the Hospital Assets are in a condition to be used and operated for the purposes, and in accordance with the standards for such use and operation, set forth in this Lease. Lessor shall not have any responsibility during the Lease Term to maintain, repair, alter, improve or reconstruct the Premises or any portion thereof or any of the Hospital Assets. If Lessee fails to make such repairs, Lessor may, but need not, make the repairs and replacements. On receipt of an invoice from Lessor, Lessee shall pay Lessor Lessor’s out-of- pocket costs incurred in connection with such repairs and replacements plus five percent (5%) of such amount to reimburse Lessor for all overhead, general conditions, fees, and other costs and expenses arising from Lessor’s involvement with such repairs and replacements. Lessee expressly recognizes that, because of the length of the Term of this Lease, it may be necessary for Lessee to perform substantial maintenance, repair, rehabilitation or reconstruction of, and additions to, the improvements, Alterations and Hospital Assets to ensure they are kept in the condition required by, and that Lessee complies with the terms of, this Lease. In this regard, Lessee waives and releases (i) all defenses to its maintenance obligations under this Lease, (ii) the right to require Landlord to make repairs and (iii) its rights, including its right to make repairs at Lessor’s expense, under California Civil Code Sections 1941-1942 or any similar law, statute, or ordinance now or hereafter in effect.

Lessee’s Repair and Maintenance Obligations. (a) Lessee shall keep in good order, condition and repair, and shall replace, if necessary, the Property and every part thereof, structural and nonstructural occupied or used by Lessee, whether or not the need for such repairs occurs as a result of Lessee’s use, any prior use, the elements, or the age of such portion of the Property. This includes, but is not limited to, glazing, plumbing, heating, air conditioning, ventilation, electrical and lighting fixtures and facilities, all equipment within the Property, fixtures, walls (interior and exterior), ceilings, floors, windows, doors, plate glass, skylights, landscaping, tree-trimming, and all fences and signs located on the Property, as well as the outdoor seating area. (b) The paint color of the exterior of the Property shall at all times be the colors to which the Lessor has chosen at the time of execution of this Agreement. If Lessor changes the color of the Casino Dock building at any time during the Term, Lessee is required, upon thirty (30) day written notice by the Lessor, to paint the exterior of the Property to be the same color as the new color of the Casino Dock identified in the notice at Lessee’s own cost. (c) To the extent that any such repairs, maintenance, or painting obligations imposed by this Section 9 involve, in the determination of the Lessor, the leased property of another tenant(s) of Lessor who leases space in the same building, such as a common roof, Lessee’s obligations under this Section 9 will be divided proportionately between Lessee and the other tenants of Lessor, if any, based on the number of square feet leased by each.

Lessee’s Repair and Maintenance Obligations. Lessee shall, at all times from and after the Commencement Date, advise the County of any deficiency within the Premises. County shall make all repairs at its own cost and expense, excepting those repairs resulting from Lessee’s neglect in which case County will make the repairs at Lessee’s sole cost pursuant to Section 12.3.
