MAINTENANCE, REPAIRS, AND IMPROVEMENTS. ______During (name) ______________________________ exclusive occupancy of the residence, he/she shall maintain the residence in good condition, normal wear and tear excepted, and shall be solely responsible for all costs of maintenance, repairs, or improvements in the amount of $__________________, or less. For any single item of maintenance, repair, or improvement costing over that amount, except as unavoidable due to emergency, ___________________ shall obtain the prior written consent of ________________ for such work, which shall not be unreasonably withheld. For items costing over the stated amount, __________________________ shall be solely responsible for the stated amount, and the remainder of the cost shall be borne equally by the parties.

MAINTENANCE, REPAIRS, AND IMPROVEMENTS a) Lessee is responsible for normal maintenance of the Premises including, without limitation, performing all minor repairs and . The Lessee will also keep the Premises free of trash to the greatest extent feasible. b) At the commencement of this Lease and annually (in January of each calendar year or in such other month as may be mutually agreed to by the parties) or upon extension, Lessor and Lessee shall agree on major repairs, additions, alterations, replacements and improvements. Such specification shall be in written form and signed by both parties. (See Attachment E.) c) With prior written approval from the Lessor (pursuant to the process described in Section VI (b), above, or at such other times mutually agreed to by the parties), the Lessee may place and maintain improvements including but not limited to any structures, xxxxx, fencing, and perennial plantings upon the Premises. d) In each case, both parties shall agree in writing as to how the costs of such major repairs, additions, alterations, replacements and improvements shall be allocated and whether the Lessee will have the right to remove such improvement at the conclusion of the Lease term in accordance with Section VI(f), below. e) The Lessee shall be responsible for maintenance of all improvements constructed or installed after the date of this Lease. f) Subject to the provisions of any specific agreements between the parties made in accordance with the provisions of Section VI(d), above, at the termination of the Lease, the Lessee may have the right to remove certain improvements constructed or installed after the date of this Lease, or may be required by the Lessor to do so, and return the property to its prior condition. Alternatively, the improvement may remain and become the property of the Lessor. The Lessor shall not be obligated to compensate the Lessee for the remaining improvements; however, the Lessor and the Lessee may establish alternative agreements set forth in writing and signed by both parties.
MAINTENANCE, REPAIRS, AND IMPROVEMENTS. A. The Co-op agrees to maintain common areas and grounds in a decent, safe and sanitary condition in conformity with the requirements of local building codes, state law, and to pay or provide for the payment of all loans, taxes, assessments, and insurance on the premises. (The Co-op will not, however, provide insurance on member's personal property.) B. The members shall maintain the Unit in good condition and shall be responsible for all repairs and maintenance for the Unit. If a member fails to make necessary repairs to keep the unit in good condition, the Board of Managers may make such necessary repairs and charge the member for said repairs, which shall be added to the monthly carrying charge or as otherwise agreed upon by and between the Co-op and the member. Failure to pay for such charges shall constitute good cause for termination of this Agreement as set forth herein. The residents are responsible for all repairs to their personal property or fixture in the Unit. C. The Co-op shall have the right to enter the Unit without prior notice if the Co-op reasonably believes or has reasonable cause to believe that an emergency exists which requires such entrance. An emergency may include a serious breach of the maintenance covenant by either the members, any interruption of a utility or another essential service, or a defect or condition clearly hazardous to the health and safety of the residents or seriously damaging to the Unit. D. The residents will not make any structural or facial alterations in or additions to the exterior of the Co-op property without the advance, written permission of the Board of Managers. E. The residents hereby agree to comply with all rules and regulations as may be specified in House Rules and Procedures, or as may be determined by the Board of Managers.

Lessee shall submit requests for such alterations and improvements in writing, detailing the location, materials and uses. The costs for such alterations and improvements, including labor and materials, shall be borne by either or both parties, per mutual agreement, and reflected in writing. c) Xxxxxx agrees to execute major (capital) repairs as needed on the barn and to maintain all access and interior farm roadways throughout the year.

(c) Lessee shall give Lessor prompt written notice of any defect or condition in the leased premises which Lessor, by other terms of this paragraph, is required to repair or maintain. Lessee shall promptly take all measures and precautions necessary to prevent injuries to persons or damage to property from occurring because of such defects or conditions. Lessor shall effect such maintenance or repairs promptly after receiving notice from Lessee.
