Mid-Year Vacancies. If a vacancy occurs after the 35th day of instruction it will be considered a temporary vacancy until the end of that school year. The vacancy will be posted so staff may request a transfer. A response to the request for transfer will be made within ten (10) school days of the closing of the posting, however the teacher may not move into the vacant position until the beginning of the next school year. In the meantime, a temporary employee will be hired to fill the vacancy until the end of the school year. Under special circumstances, the Superintendent may determine that it is in the best interest of the district to allow the teacher to transfer to the new assignment during the school year. In this situation, the KEA president shall be consulted prior to the start of the new assignment.

Mid-Year Vacancies. It is agreed that any positions which open after January 15, may be filled by substitutes, and the posting of those positions shall be waived for the remainder of the school year. These positions subsequently shall be posted in the fall if the Board intends to fill them.
Mid-Year Vacancies. The Association recognizes that when vacancies occur during the school year it may be difficult to fill them from within the District without undue interruption to the existing instructional program.   • Vacancies Whenever a vacancy in the Board of Trustees shall occur, the remaining Trustees may fill such vacancy by appointing an individual having the qualifications described in this Article by a written instrument signed by a majority of the Trustees then in office or may leave such vacancy unfilled or may reduce the number of Trustees; provided the aggregate number of Trustees after such reduction shall not be less than the minimum number required by Section 2.1 hereof; provided, further, that if the Shareholders of any class or series of Shares are entitled separately to elect one or more Trustees, a majority of the remaining Trustees or the sole remaining Trustee elected by that class or series may fill any vacancy among the number of Trustees elected by that class or series. No vacancy shall operate to annul this Declaration or to revoke any existing agency created pursuant to the terms of this Declaration. Whenever a vacancy in the number of Trustees shall occur, until such vacancy is filled as provided herein, the Trustees in office, regardless of their number, shall have all the powers granted to the Trustees and shall discharge all the duties imposed upon the Trustees by this Declaration.
