ASSIGNMENT, VACANCIES, AND TRANSFERS. A. Except as provided in this section, the District shall advertise within the bargaining unit the availability of all positions. A notice of each vacancy shall be sent to all school and project locations. A copy of it shall be posted at the District Office. The President of the Association shall be given an electronic copy of the notice at the time of posting.

ASSIGNMENT, VACANCIES, AND TRANSFERS. A. Employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grades and/or other classes outside of their certificates and/or their major or minor fields of study or qualifications in specialty areas. Prior to any re-assignment, employee(s) and the Superintendent or the Superintendent's designee will discuss re-assignment or transfer options. Employees shall be notified in writing no later than June 15th of any changes in their programs and schedules for the ensuing school year, including regular assignments, and any special assignments. In an emergency situation, employees may be requested to change assignments after the June 15th deadline.

In the event that an assignment and/or schedule change occurs following August 15th, but prior to the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide one (1) or three (3) days paid at per diem per affected Employee(s) for planning and preparation in accordance with the following: One (1) day paid at per diem if there is a change in the Employee’s scheduled class assignment(s) within the Employee’s curricular area. Three (3) days paid at per diem if the change is a grade level change at the elementary or if the change is an assignment to a new curricular area at the High School or Junior High. If the change in assignment and/or schedule occurs in special education following August 15th, but prior to the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide three days paid at per diem for planning and preparation and one (1) day paid at per diem for training in the new position. In the event that an assignment and/or schedule change occurs on or after the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide one (1) or three (3) days of substitute time per affected Employee(s) for planning and preparation in accordance with the following: One (1) day of substitute time if there is a change in the Employee’s scheduled class assignment(s) within the Employee’s curricular area. ASSIGNMENT, VACANCIES, AND TRANSFERS. 8.1 Before the District may hire any person from outside the District, the District shall post an opening for at least one week and shall provide an opportunity for current employees within the bargaining unit to apply for such position. The District agrees to appoint the best-qualified applicant to the position. Current District employees who are not hired for the position will receive an explanation as to why they were not selected.

  • VACANCIES AND TRANSFERS A vacancy shall be defined, for purposes of this Agreement, as a position previously held by a bargaining unit member that needs to be filled, or a newly created PSS position. When all necessary parties agree, vacancies can be filled by organizational advancement or transfer from within the hiring department and shall not require posting. All vacancies will be posted for a minimum of seven (7) working days unless filled by transfer, reassignment, or recall of a laid off staff member. Notice of vacancies will be given to the Alliance President and Chief Alliance Xxxxxxx at the time they are posted on the University's electronic Notices GVSU Business board, and will be simultaneously posted at the University’s electronic employment website. A vacancy will not be filled until after the posting period has expired. Job postings shall include the classification, department, location(s), work schedule and the position description. The search committee will include a PSS member. Typically, vacancies will be posted as an open search available for both internal and external applicants. A job posting limited to internal applicants may occur upon approval. In each instance, all qualified internal applicants will receive an interview. The search committee must present strong justification for not selecting an internal applicant who meets the minimum qualifications of the position. When two applicants are equally qualified for the vacant position, based on current position description and satisfactory work and attendance, the more senior qualified staff member will receive the assignment. At the time of job offer, the University shall notify the selected staff member of any known or impending changes in the position. The Human Resources Office, or their designee, will provide internal applicants not selected for the position with rationale for the decision. Candidates who were interviewed but not selected may contact Human Resources to schedule a meeting with the Search Committee Chairperson, a Human Resource representative, and an Alliance Representative to discuss the reason for non-selection. The Alliance must notify the employer within three (3) working days that the meeting has been the step 1 meeting of the grievance process. If a meeting is requested or a grievance is filed, the position cannot be filled until this process is completed. An internal staff member selected for the position will be required to establish that they can do the job within eight (8) working days. Failure to qualify shall result in returning the selected staff member to their former position and is not subject to the grievance procedure. The staff member shall also have the option to elect to return to their former position within eight (8) working days. When making departmental changes, transfer shall be with the consent of the staff member whenever possible but when there is no reasonable alternative, it may be involuntary. When involuntary transfer is required, the least senior qualified staff member shall be transferred to a similar position (e.g., classification, full or part-time) or be given the option of electing an unpaid leave of absence with eligibility only for the next vacancy in their classification, if qualified. That person shall be disqualified from consideration when the position from which they were transferred is posted. Nothing contained in this Section is intended to prevent the University from making necessary changes in positions, eliminating positions or creating new positions.

  • Assignment and Transfers Except as the Committee may otherwise permit pursuant to the Plan, the rights and interests of the Participant under this Agreement may not be sold, assigned, encumbered or otherwise transferred except, in the event of the death of the Participant, by will or by the laws of descent and distribution. In the event of any attempt by the Participant to alienate, assign, pledge, hypothecate, or otherwise dispose of the Stock Units or any right hereunder, except as provided for in this Agreement, or in the event of the levy or any attachment, execution or similar process upon the rights or interests hereby conferred, the Company may terminate the Stock Units by notice to the Participant, and the Stock Units and all rights hereunder shall thereupon become null and void. The rights and protections of the Company hereunder shall extend to any successors or assigns of the Company and to the Company’s parents, subsidiaries, and affiliates. This Agreement may be assigned by the Company without the Participant’s consent.

  • VACANCIES, PROMOTIONS AND TRANSFERS A. The Board recognizes that it is desirable in making assignments to consider the educational goals of the district and the interests and aspirations of its teachers. Requests by a teacher for transfer to a different class, building, or position shall be made in writing, one (1) copy of which shall be filed with the Association. The application shall set forth the applicant’s academic qualifications. Such requests shall be reviewed once each year to assure active consideration by the Board.

  • Assignments and Transfers No Party may assign any of its rights and benefits or transfer any of its rights, benefits and obligations in respect of any Debt Documents or the Liabilities except as permitted by this Clause 19.
