Assignment Vacancies and Transfers. A. Except as provided in this section, the District shall advertise within the bargaining unit the availability of all positions. A notice of each vacancy shall be sent to all school and project locations. A copy of it shall be posted at the District Office. The President of the Association shall be given an electronic copy of the notice at the time of posting.

Assignment Vacancies and Transfers. A. Employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subjects, grades and/or other classes outside of their certificates and/or their major or minor fields of study or qualifications in specialty areas. Prior to any re-assignment, employee(s) and the Superintendent or the Superintendent's designee will discuss re-assignment or transfer options. Employees shall be notified in writing no later than June 15th of any changes in their programs and schedules for the ensuing school year, including regular assignments, and any special assignments. In an emergency situation, employees may be requested to change assignments after the June 15th deadline. B. When an employee desires a transfer or re-assignment for the following school year, the following procedure shall be used: 1. The employee shall complete a request form by April 1st or ten (10) days following District notification to the Association of the vacancy applied for, whichever is later. 2. Employment of any new employee for a specific position shall not be made until all those qualified teachers who have a pending request for transfer or re-assignment have been considered by the Superintendent. 3. Upon written request by the employee, at least thirty (30) days prior to the beginning of the school year, the Superintendent or designee shall notify in writing and by personal conference each employee whose request for transfer or reassignment was not granted and the reason(s) for not granting the request. C. To assure that employees are given due consideration in filling any vacancies or newly created positions which occur at any time within the District, the following procedure shall be used: 1. All vacancies and new positions (teaching summer school and extra-curricular non- sport) must be publicized through a written notice to the President concurrent with public posting. All postings must contain a tentative building assignment of the anticipated vacancy. 2. Said notice of vacancy or new position shall clearly set forth the qualifications for the position and the procedures and timelines for applying. 3. The District will make all possible effort to hire the best qualified person to fill vacancies and new positions. 4. All in-district applicants will be given a screening interview. Assignment Vacancies and Transfers. To assure that pupils are taught by Employees working within their areas of competence, Employees shall not be assigned, except in accordance with the regulations of the State Board of Education and the Reduction in Force Procedure contained in this Agreement. Returning employees shall be notified no later than August 15th, prior to the first contracted day, of any change in their programs and schedules for the ensuing school year, including teaching and any special assignments, unless in the case of a vacancy caused by a resignation after August 1st. In the event that an assignment and/or schedule change occurs following August 15th, but prior to the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide one (1) or three (3) days paid at per diem per affected Employee(s) for planning and preparation in accordance with the following: One (1) day paid at per diem if there is a change in the Employee’s scheduled class assignment(s) within the Employee’s curricular area. Three (3) days paid at per diem if the change is a grade level change at the elementary or if the change is an assignment to a new curricular area at the High School or Junior High. If the change in assignment and/or schedule occurs in special education following August 15th, but prior to the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide three days paid at per diem for planning and preparation and one (1) day paid at per diem for training in the new position. In the event that an assignment and/or schedule change occurs on or after the first day of the school year, the District shall arrange for a conference with the affected Employee(s) and provide one (1) or three (3) days of substitute time per affected Employee(s) for planning and preparation in accordance with the following: One (1) day of substitute time if there is a change in the Employee’s scheduled class assignment(s) within the Employee’s curricular area. Assignment Vacancies and Transfers. 8.1 Before the District may hire any person from outside the District, the District shall post an opening for at least one week and shall provide an opportunity for current employees within the bargaining unit to apply for such position. The District agrees to appoint the best-qualified applicant to the position. Current District employees who are not hired for the position will receive an explanation as to why they were not selected. 8.2 New or vacated positions created by the District that operate within the bargaining unit, which require the assignment or reassignment of at least one (1) hour of duties, shall be posted by the District as an opening for at least one week. The District shall provide an opportunity for current employees within the bargaining unit to apply for such position. 8.3 The District is allowed to create temporary positions for up to 90 working days.   • VACANCIES, PROMOTIONS AND TRANSFERS A. Whenever a teacher is interested in being considered for assignment to any professional position in the district, he/she shall file written notice of his/her interest to the Assistant Superintendent of Human Resources. The Board declares its intention to give full consideration to present staff members in all vacancies in which they have expressed an interest. 1. It is agreed that any vacancy occurring during the current school year shall only be filled on a temporary basis for the remainder of that school year. By May 1 of each year, a list of all vacancies shall be posted in a designated area in each administrative unit. Any teacher with proper qualifications may, within seven (7) calendar days of May 1 and all subsequent postings until August 1 of each year, apply for and shall be granted an interview before such vacancy is filled, with the exception of when reductions in grade levels/subject areas occur in a building allowing first right of refusal to displaced staff for any open positions in his/her individual building. Vacant positions will be posted for three (3) work days after August 1 and prior to the first reported student instructional day of each year. 2. Any teacher requesting transfer between administrative units shall notify the Assistant Superintendent of Human Resources by April 30 for transfer in the subsequent year. Involuntary transfers within a building will occur prior to extending consideration to voluntary transfer requests. Before vacancies are filled, the qualifications of each teacher who has requested transfer shall be reviewed. 3. It is agreed that any teacher making written request to be assigned a position whose FTE is less than their current assignment has no guarantee of a future increase in FTE except as provided by the process defined elsewhere in this Article. 4. A vacancy shall be defined for purposes of this contract as a position presently unfilled, one to be open in the future or a new position, and which has no teacher on leave of absence or layoff status with the claim to the position. B. Since the frequent transfer of teachers from one school and/or grade level to another is disruptive to the educational process and interferes with optimum teacher performance, the parties agree that unrequested transfers of teachers are to be minimized.
