Net Lease; Additional Rent. It is intended by Landlord and Tenant that this Lease be a net, net, net lease and the Annual Net Rent payable by Tenant shall be absolutely net to the Landlord. The Tenant agrees to pay directly any and all costs and expenses in connection with the ownership or leasing of the Premises. Tenant covenants and agrees to pay to Landlord as additional rent (the "Additional Rent"), promptly after Landlord's demand, any such costs and expenses which cannot be paid directly by Tenant, but which are paid by Landlord. The costs and expenses for which Tenant is responsible shall include, but not be limited to, the following:

Net Lease; Additional Rent. Except as expressly provided in this Lease, it is the intent of both parties that the Minimum Rent specified herein shall be absolutely net to Lessor throughout each Lease Year of the term of this Lease, and that all costs, expenses, and obligations of every kind relating to the Leased Property, or the repair, replacement or maintenance of the Leased Property, which may arise or become due during the term hereof shall be paid by Lessee and that Lessor shall be indemnified by Lessee against such costs, expenses, and obligations. In addition to the other covenants and obligations set forth in this Lease, Lessee specifically agrees to pay to Lessor, as Additional Rent, the expenses and charges set forth below:
Net Lease; Additional Rent. It is the intent of the parties that the Basic Rent provided in this Lease will be a net payment to Landlord, that this Lease shall be absolutely net and carefree to Landlord and that Landlord will not be required to pay any costs or expenses or provide any services in connection with the Premises and Tenant will bear all costs and expenses relating to the Premises. Accordingly, Tenant covenants and agrees to pay, without any set-off, compensation, abatement or deduction and in addition to Basic Rent, all costs and expenses relating to this Lease and the Premises (collectively, “Additional Rent”), including, without limitation (a) Taxes; (b) Business Taxes; (c) insurance costs; (d) utility charges; (e) operating expenses; and (f) maintenance, repair and replacement expenses.
Net Lease; Additional Rent. It is the intent of the parties that the Basic Rent provided in this Lease will be, except as otherwise expressly provided in this Lease, a net payment to Landlord and that, in addition to Basic Rent, Tenant will pay Additional Rent for Operating Expenses and Taxes according to Section 4.2, the cost of all utilities consumed at the Premises according to Section 6.2, and the cost of all repairs and maintenance required to be performed by Tenant according to Section 7.1. It is the intention of the parties that, except as otherwise expressly provided herein, this Lease will not be terminable for any reason by Tenant, and that Tenant will not be entitled to any abatement of, or reduction in, any Rent payable under this Lease.

Yearly Fixed Rent, Additional Rent, and all other amounts required to be paid by Tenant under this Lease are sometimes collectively herein referred to as "Rent". Tenant shall remain obligated under this Lease in accordance with its terms and shall not take any action to terminate, rescind or avoid this Lease, notwithstanding any bankruptcy, insolvency, reorganization, liquidation, dissolution or other proceeding affecting Landlord or any action with respect to this Lease which may be taken by any trustee, receiver or liquidator or by any court. Except as otherwise expressly provided herein, Tenant waives all rights to terminate or surrender this Lease, or to any abatement or deferment of Yearly Fixed Rent, Additional Rent or other sums payable hereunder.   • Additional Rent In addition to Base Rent, Tenant agrees to pay to Landlord as additional rent (“Additional Rent”): (i) Tenant’s Share of “Operating Expenses” (as defined in Section 5), and (ii) any and all other amounts Tenant assumes or agrees to pay under the provisions of this Lease, including, without limitation, any and all other sums that may become due by reason of any default of Tenant or failure to comply with the agreements, terms, covenants and conditions of this Lease to be performed by Tenant, after any applicable notice and cure period.

  • Additional Rental Lessee shall pay and discharge, as additional rental (“Additional Rental”), all sums of money required to be paid by Lessee under this Lease which are not specifically referred to as Rental. Lessee shall pay and discharge any Additional Rental when the same shall become due, provided that amounts which are billed to Lessor or any third party, but not to Lessee, shall be paid within thirty (30) days after Lessor’s demand for payment thereof or, if later, when the same are due.   • Base Rent and Additional Rent Tenant shall pay to Landlord Base Rent for (i) the Clean Room Expansion Space in the amount of $22.50 per square foot per annum, (ii) the Storage Expansion Space IV in the amount of $7.83 per square foot per annum, (iii) the Storage Expansion Space V in the amount of $7.83 per square foot per annum , and (iv) the Office Expansion Space II in the amount of $15.14 per square foot per annum, payable in equal monthly installments in accordance with the Lease. Depending upon the date to be utilized, the appropriate party shall provide written notice to the other party and the Clean Room Expansion Space Rent Commencement Date shall be established. Tenant shall commence paying rent on the Storage Expansion Space IV, the Storage Expansion Space V and the Office Expansion Space II on the earlier of (i) the date that Landlord substantially completes the Landlord Expansion Space Work related to the Storage Expansion Space IV and the Storage Expansion Space V (other than the installation of the acoustical drop ceiling described in Section 3(b)(iv) of Exhibit B attached hereto, which shall be performed by Landlord contemporaneously with the Initial Tenant Expansion Space Work) and (ii) the date that Tenant occupies the remaining Expansion Space (the "Remaining Expansion Space Rent Commencement Date"). Depending upon the date to be utilized, the appropriate party shall provide written notice to the other party and the Remaining Expansion Space Rent Commencement Date shall be established. Tenant shall pay to Landlord as additional rent for the Expansion Space the cost of utilities consumed therein, as set forth in the Lease. Any delay caused by or on behalf of Tenant shall not impact the Clean Room Expansion Space Rent Commencement Date or the Remaining Expansion Space Rent Commencement Date.

Unless expressly provided otherwise in this Lease or any other Operative Agreement, in the event of any failure on the part of Lessee to pay and discharge any Supplemental Rent as and when due, Lessee shall also promptly pay and discharge any fine, penalty, interest or cost which may be assessed or added for nonpayment or late payment of such Supplemental Rent, all of which shall also constitute Supplemental Rent.
