Noxious Weed Control. Developer shall perform the control of noxious weed species within the ROW, easements, and limits of disturbance until Final Acceptance. Control of noxious weeds shall apply in each State as required by that State’s applicable seed laws. Developer shall prepare and submit a Noxious Weed Control Plan to IFA for review and comment prior to the commencement of eradication or removal work. If chemical controls are proposed they shall be applied by a certified pesticide applicator.

Noxious Weed Control. Contractor shall notify the Contract Administrator in advance of moving equipment onto State lands. Contractor shall thoroughly clean all off-road equipment prior to entry onto State land to remove contaminated soils and noxious weed seed. If equipment is moved from one Washington Department of Wildlife project area to another, the Contract Administrator reserves the right to require the cleaning of equipment. Equipment shall be cleaned at a location approved by the Contract Administrator.

Noxious Weed Control. The Purchaser may be required to perform noxious weed control on any of the roads designated as part of the haul route and on landings. Noxious weed control may include grass seeding, equipment washing and herbicide spraying. 1. Grass seeding requirements are as follows: 150 Lbs of a mix approved by forest officer. 2. The Purchaser will be required to pressure wash all logging and construction equipment prior to entry into the permit area. This cleaning will remove all dirt, plant parts, and material that may carry noxious weed seeds into the permit area. Only logging and construction equipment so cleaned and inspected by the Forest Officer will be allowed to operate within the permit area. All subsequent move-ins of logging and construction equipment shall be treated the same as the initial move-in. "Logging and construction equipment" does not include logging trucks and personal vehicles. 3. Any spraying required in this Permit shall be done by a commercial applicator licensed by the State of Montana or by personnel under the direct supervision of the licensed applicator. All herbicide applications shall follow EPA label requirements. Any weed control must comply with the current standards of the County Weed Board and as directed by the Forest Officer. 4. Noxious Weed Control. The Tenant agrees that during the term of the Lease, he will pull up or otherwise destroy noxious weeds of all kinds which shall grow upon the leased lands, and will not sow, or permit to be sown any grain infected by smut or containing any foul seeds or noxious weeds, and will not suffer or permit any such foul seeds or noxious weeds to go to seeds on the said lands. In the event that the Tenant fails to observe the foregoing agreement, the Landlord may, on 48 hours prior notice in writing to the Tenant, enter upon the said lands and pull up or otherwise destroy or prevent from going to seed any noxious weeds or grasses growing thereon, and all costs, charges and expenses of the Landlord in so doing may be added by the Landlord to the rent for such year, and shall be recoverable in like manner as Additional Rent. This clause shall not supersede the provisions in the Weed Control Act and any amendments thereto.

Noxious Weed Control. The Permittee shall be responsible for controlling any noxious weeds introduced by Permittee's activity on State- owned land and shall prevent or eradicate the spread of those noxious weeds onto land adjoining the leased premises. The Permittee's methods of control shall be reviewed by the Department's Area Field Office that has jurisdiction for that locale.
