OBJECTS OF THIS AGREEMENT. A. The intent and purpose of this Agreement shall be to promote and improve industrial and economic relations in the industry, to establish and maintain discipline and efficiency and to set forth herein the basic agreements covering rate of pay, hours of work, conditions of employment and safety. B. The parties hereto desire to co-operate in establishing and maintaining proper and suitable conditions in the industry which will tend to secure suitable terms of employment satisfactory to the Employer and employees, to provide methods for fair and peaceful adjustments of all disputes which may arise between them and xxxxxx goodwill, friendly relations and understanding between the parties. C. The Union and employees hereby agree during the period of this contact: (1) to endeavour to cut absenteeism; (2) to endeavour to cut waste; (3) to co-operate with the Employer in an endeavour to provide the best of service to the Employer’s customers.

The objects of this Agreement is to establish an economically viable and profitable workplace to maximise the opportunity for job security for all Employees with working conditions and entitlements to attract and retain the best people for the job. OBJECTS OF THIS AGREEMENT. ‌ 1.01 The intent and purpose of this Agreement is to promote and improve industrial and economic relations in the industry, to establish and maintain a high degree of discipline and efficiency, and to set forth herein the basic agreements covering rates of pay, hours of work and conditions of employment. 1.02 The parties hereto desire to cooperate in establishing and maintaining proper and suitable conditions in the industry which will tend to secure equitable terms of employment satisfactory to the employer and employees, to provide methods of fair and peaceful adjustments of all disputes which may arise between them and xxxxxx goodwill, friendly relations and understanding between the parties. 1.03 The Union acknowledges that it is the exclusive function of the Employer; a) to maintain order, discipline and efficiency; b) to hire, discharge, transfer, promote, classify, demote or discipline employees, provided that a claim of discriminatory promotion, demotion, shift change or job transfer, or a claim that an employee has been discharged or disciplined without just cause may be subject of a grievance dealt with as hereinafter provided. c) generally, to manage, control, continue, discontinue in whole or in part, the industrial enterprise in which the employer is engaged. d) to utilize outside contractors for special projects and to perform work requiring specialized skills and to utilize temporary employees to supplement the workforce based on cyclical changes in the business, provided such temporary employees do not displace any bargaining unit employees. Any temporary employee who works 488 hours must become a classification A employee or no longer work as a temporary employee.

  • Terms of this Agreement The Parties acknowledge that this Agreement and all of the respective terms of this Agreement shall be treated as Confidential Information of both Parties.

  • Amendments of this Agreement This Agreement may be amended by the parties only if such amendment is specifically approved by (i) the Directors/Trustees of a Fund, or by the vote of a majority of outstanding voting securities of a Fund, and (ii) a majority of those Directors/Trustees of a Fund who are not parties to this Agreement or interested persons of any such party and who have no direct or indirect financial interest in this Agreement or in any Agreement related to the Fund's Rule 12b-1 Plan, cast in person at a meeting called for the purpose of voting on such approval.

  • Benefits of this Agreement Nothing in this Agreement shall be construed to give to any person or corporation other than the Company, the Rights Agent and the registered holders of the Right Certificates (and, prior to the Distribution Date, the Common Shares) any legal or equitable right, remedy or claim under this Agreement; but this Agreement shall be for the sole and exclusive benefit of the Company, the Rights Agent and the registered holders of the Right Certificates (and, prior to the Distribution Date, the Common Shares).

  • SCOPE OF THIS AGREEMENT 2.1. This Agreement, including Parts A through L, Tables One and Two and exhibits, specifies the rights and obligations of each Party with respect to the establishment, purchase, and sale of Local Interconnection, Collocation, resale of Telecommunications Services and Unbundled Network Elements. Certain terms used in this Agreement shall have the meanings defined in PART A – DEFINITIONS, or as otherwise elsewhere defined throughout this Agreement. Other terms used but not defined in this Agreement will have the meanings ascribed to them in the Act and in the FCC’s and the Commission’s rules, regulations and orders. PART B sets forth the general terms and conditions governing this Agreement. The remaining Parts set forth, among other things, descriptions of the services, pricing, technical and business requirements, and physical and network security requirements.

  • Amendment of this Agreement No provision of this Agreement may be changed, waived, discharged or terminated orally, but only by an instrument in writing signed by the party against whom enforcement of the change, waiver, discharge or termination is sought, and no amendment of this Agreement shall be effective until approved in a manner consistent with the 1940 Act and rules and regulations thereunder and any applicable SEC exemptive order therefrom.

  • Copies of this Agreement This Agreement shall be executed in four counterparts; each party holds one and the rest are used for the transaction of related formalities. Each of the copies shall be deemed as the original one and has the same effect.
