Packaging; Labeling. Supplier shall package all Goods in accordance with the packaging specifications set forth in the Purchase Order. If no such specifications are set forth in the Purchase Order, Supplier shall package all Goods in such a manner as to ensure preservation of such Goods during transportation and storage, having due regard for the conditions and environment at the areas through which the Goods will traverse and be delivered, including climate, roads, and requirements for multiple handling. In packaging, marking and transporting Goods, Supplier shall abide by all Laws regarding the transportation of the Goods and the protection of safety, health and the environment. All hazardous Goods shall be clearly labeled. If the Goods include or constitute dangerous, hazardous or toxic items, Supplier shall include Material Safety Data Sheets (or the applicable jurisdiction’s equivalent) and clearly mark or label the Goods with appropriate information, provide necessary shipping certification and otherwise comply with all shipping Laws. Supplier shall ensure that all packaging, invoices, and bills of lading indicate the applicable country of destination, point of destination, Purchase Order number, description and quantity of Goods enclosed, names of Supplier and Newmont, and such other information as may be customary in the industry for packaging of similar goods. Costs arising from Supplier’s failure to follow required packaging, marking and transporting procedures and instructions shall be at Supplier’s expense. If requested by Newmont, Supplier shall give Notice (as such term is defined in Section 18, below) to Newmont of the date of shipping, Purchase Order number, number of transportation units used (railway cars, trucks, containers, or other), bill of lading number, description of Goods, number of crates, and cargo weight. Such Notice shall be given within such reasonable time period after the Goods are dispatched from their point of origin as Newmont may request.
Packaging; Labeling. Unicycive shall use commercially reasonable efforts to ensure that all Product shipments are properly packaged and labeled in accordance with all applicable Legal Requirements.
Packaging; Labeling. Arius shall manufacture, label and package, or shall cause its Contract Manufacturer(s) to manufacture, label, and package, the Product in final form, as determined by Arius in its sole discretion, for distribution by TEAMM with TEAMM labeling and NDC codes. In addition to all applicable legal requirements, the labels shall (i) comply with the requirements set forth in Section 4.5 below, (ii) prominently and clearly display “Arius™” or “Arius®” as appropriate, and (iii) prominently and clearly identify Arius (or its Contract Manufacturer(s), if so requested by Arius) as the manufacturer of the Product. TEAMM shall not repackage or label any Product and shall not alter any Product or any package or label used in connection with any Product except as specifically authorized in writing by Arius. In the event that Arius shall authorize or require repackaging or re-labeling, TEAMM shall comply in all respects with the instructions of Arius, at the expense of Arius.
Packaging; Labeling. CVDI shall manufacture, label and package the Products in final form for distribution by Dade. Dade shall provide camera ready copy for the labels containing Dade trade dress. In addition to all applicable legal requirements, the labels shall comply with the requirements set forth in Section 3.4 below, shall display "CVDI" and shall identify CVDI as the manufacturer of the Products. Dade shall not repackage or label any Products and shall not alter any Products or any package or label used in connection with any Products except as specifically authorized by CVDI. In the event that CVDI shall authorize or require repackaging or re-labeling, Dade shall comply in all respects with the instructions of CVDI, at the expense of CVDI.
Packaging; Labeling. Supplier bears the full responsibility for proper packaging.
Packaging; Labeling. A complete and accurate packing list shall be enclosed with or affixed to each shipment of Goods. Company’s Order number and Contractor’s serial numbers shall be shown on all shipping documents, invoices, and other correspondence. All Goods delivered must be labeled to conform to any labeling requirements of the state, province, nation, or other jurisdiction to which they are delivered. All hazardous materials shall be conspicuously marked to that effect on the exterior of all packages, and proper handling instructions and a Material Safety Data Sheet (MSDS) shall be provided. For any hazardous materials that are contaminated beyond utility (as determined by Company) at the time of delivery, title and risk shall remain with Contractor, and Contractor shall regenerate or dispose of the contaminated products at its sole expense in accordance with all applicable Laws. Contractor shall provide a complete and accurate Xxxx of Lading, Multimodal Transport Document, or Seaway xxxx for all international shipments and all other deliveries for which such a document is commonly provided or is requested by Company.
Packaging; Labeling. Warnxx-Xxxxxxx xxxll ensure that all Products are properly packaged in accordance with the MBR. Warnxx-Xxxxxxx xxxees that its name may be used on a Product label, to the extent required by applicable Legal Requirements.
Packaging; Labeling. Marketing and Promotional Materials. JDS shall be solely responsible for the content of the package label copy, content of labeling, marketing and promotional materials for the Product(s), subject only to Banner’s right of prior approval of package label copy and final packaging materials for compliance with the Regulatory Approval under Section 2.1(a)(ii). JDS covenants and agrees that such materials will at all times comply with the Regulatory Approval and Applicable Law. JDS shall provide Banner with samples of such packaging, content of labeling, marketing and promotional materials upon request. Banner shall have no responsibility or liability for JDS’s packaging, advertising, promotional materials, trademarks or content of labeling, except with respect to any changes, additions, or modifications requested by Banner. JDS shall not make any claims or statements whether in or on its packaging, labeling, promotional materials or otherwise, that is not in compliance with, or that is outside, the scope of the Regulatory Approval.
Packaging; Labeling. Unless DISTRIBUTOR requests otherwise and agreed to by SpectraScience, all Products ordered by DISTRIBUTOR shall be packaged for shipment and storage in accordance with SpectraScience’s standard commercial practices. DISTRIBUTOR shall initiate and complete translating of all advertising and marketing information provided by SpectraScience when required. Translations of all information shall be done in accordance with SpectraScience’s Translation Standard Operating Procedure. Translation of all such materials shall be approved by SPECTRASCIENCE prior to use. Any translations in SpectraScience’s possession as of the Effective Date shall be offered to DISTRIBUTOR free of charge. Any further translations required to distribute the Products in the Territory shall be obtained at DISTRIBUTOR’S expense. DISTRIBUTOR shall own all such translations but SPECTRASCIENCE shall have a non-exclusive right to use such translations.
Packaging; Labeling. Shilpa shall ensure that all Renazorb Shipments are properly packaged and labeled in accordance with all applicable Legal Requirements.
