Pay for Acting in Senior Capacity. (a) Any employee covered by this Agreement who is required to accept the responsibility and carry out the duties incident to a position or rank senior to that which the employee normally holds shall be paid at the rate for the senior position or rank while so acting. (b) Employees who are on a compressed work week, i.e. Fire Prevention Branch, are not eligible for pay for acting in a senior capacity when a senior ranking Branch is on his/her regular day off. 9.2 The Department will record the number of shifts in each year, during which each employee acted in a senior capacity. During each immediately following year, each such employee will receive at the time of taking his/her annual vacation an additional payment over and above the employee’s regular salary. Such additional payment shall be based upon the difference in the daily rates for such employee's confirmed rank and for the higher rank at which the employee acted, which amount shall be multiplied by the number of shifts during which the employee acted in the higher capacity during the previous year, and shall be further multiplied by 4.38%, 6.58%, 8.77% or 10.9% depending upon whether such employee is entitled to 8, 12, 16 or 20 duty shifts of annual vacation in the year in which the additional payment is made.
Pay for Acting in Senior Capacity. (a) Any non-clerical employee placed temporarily in a higher-rated position than the employee's own regular position, shall be paid the higher rate of pay while so placed. (b) On every occasion that a clerical employee is temporarily required to accept the responsibilities and carry out the duties incident to a position covered by this Agreement which is senior to the position which the employee normally holds, the employee shall be paid for every day that the duties of the senior position are carried out at the minimum rate in the scale for such senior position, except where the salary received is equal to, or exceeds, the minimum of the senior position, in which case the employee shall receive the next higher rate in the pay range of the senior position. (c) Appointments of employees to a level of higher responsibility must be authorized in writing by the Director or designate.
Pay for Acting in Senior Capacity. When an employee is appointed to temporarily accept the responsibilities and to carry out the duties incident to a position which is senior to the position which he/she normally holds, he/she shall be paid for every day the duties of the senior position are carried out at the minimum rate in the scale for such senior position which represents an increase over his/her normal rate. (It is not intended that this clause apply when, in a senior person's absence, his/her work is handled by a number of persons.) An employee has the right to refuse a temporary appointment to a senior position. All temporary appointments of this nature must be authorized in writing by the Department Head and approved by the Secretary Treasurer.

However, where the salary received in the employee’s own position is equal to, or exceeds the minimum of the senior position, the next higher rate in the pay range of the senior position shall be paid. (b) Partial Acting Pay Where an employee is temporarily required to accept a portion, but not all, of the core duties and responsibilities of a senior position, the employee shall be paid two (2) pay steps above their rate of pay provided this does not result in a higher rate of pay than would have been paid for full acting. In such cases, the employee would be entitled to a rate of pay equivalent to full acting pay.
Pay for Acting in Senior Capacity. 7.1 Any employee qualified according to the Department Promotional Policy (Appendix “C”) who is required to carry out the duties incident to a position or rank senior to which they normally hold, shall be paid the rate for so acting for each hour worked in a senior capacity.

Acting assignments which were not anticipated to exceed six (6) months shall be examined after four (4) months to determine if they are now expected to run longer than six (6) months. Acting assignments that are expected to continue beyond six (6) months shall be posted in the usual manner provided that the acting assignment may be automatically extended beyond six (6) months for a period not to exceed three (3) months in duration in order to either post and fill the position or to cover the balance of the assignment where it is clear the assignment will end within the three (3) month period. (d) Pay for Partial Acting Assignments Exceeding Six Months An employee who has been in a partial acting capacity for a period of six (6) months and whose assignment continues shall have their rate of pay adjusted to reflect the full acting rate for the position for the balance of the assignment and may be assigned any additional duties and responsibilities associated with the position. (e) Appointments of employees to a level of higher responsibility must be authorized in writing by the General Manager or designate.
