PAYMENT BY RESULTS. 3.1 The Scheme’s continued strong reputation and integrity are of value to the Authority. Accordingly, the Royalty payable in accordance with paragraph 1 of this Schedule shall be subject to a percentage uplift where the percentage of respondents whose Customer Satisfaction Assessments produce an overall response of “Satisfied” falls below 70% as follows: 3.1.1 Where performance against SLA Ref#4 falls in between 60% and 69% (inclusive), the percentage uplift applied to all Royalty rates for the subsequent quarter shall be 10%. After this time, the Royalty rates shall return to their pre-uplift rates for the purposes of calculating any uplift based on the results of the next Customer Satisfaction Assessment. 3.1.2 Where performance against SLA Ref#4 falls below 50%, the percentage uplift applied to all Royalty rates for the subsequent quarter shall be 30%. After this time, the Royalty rates shall return to their pre-uplift rates for the purposes of calculating any uplift based on the results of the next Customer Satisfaction Assessment. 3.1.3 For the avoidance of doubt, the Operator shall not be entitled to pass these uplifts on to the Customer in any form whatsoever, including but not limited to, additional charges, or adjustments to the assessment fees/charges.

PAYMENT BY RESULTS. 13.1 Subject to the provisions of this clause the employer may, at the election of the employer, remunerate employees under an incentive payment system (as an alternative to the time work payment system provided in this agreement). 13.2 An incentive payment system may apply to the whole of the workplace or enterprise covered by this agreement or a section or sections of such workplace or to specified categories of employees within the workplace and, to the extent of any inconsistency, shall prevail over the timework payment system provided in this agreement whilst the incentive payment system remains in force. 13.3 The terms and conditions of any incentive payment system and any agreed modification to such system shall: 13.3.1 be fully explained by the employer to all employees working under such system prior to implementation; and 13.3.2 be made available by the employer in written form to all employees covered by the system, upon request, or to an employee, or to the employee's representative if the employee requests, in a form which enables the system to be understood and assists an employee to calculate their entitlements under the system. 13.4 All information shall be kept in accordance with the requirements of the Workplace Relations Regulations. 13.5 Incentive payments shall be payable to the employee as if the terms of the incentive payment system were terms of this agreement. 13.6 The system may only be modified by agreement between the employer and the majority of employees covered by the system and must be expressly agreed by the employer and a majority of employees if there is to be any reduction in the payments. 13.6.1 The disputed modification shall be communicated to the employer, and all employees at the establishment who are intended to be affected by the modification. 13.6.2 A conference shall be convened as soon as practicable between the parties and, if the parties so choose, their representatives to discuss the disputed modification and to seek resolution of the dispute. 13.6.3 If agreement cannot be reached following negotiations between the parties; any party may refer the disputed modification to the Australian Industrial Relations Commission for conciliation purposes only. 13.6.4 If agreement cannot be reached after conciliation under the auspices of the Commission, or if no party has referred the disputed alteration to the Commission under 13.6.3 within seven days of the conference, any party is entitled to elect to give notice of...
PAYMENT BY RESULTS. 23.1 An employer may remunerate any of his/her employees under any system of payment by results based on rates which would enable a worker of average capacity working under like conditions to earn at least 10 per cent in excess of the appropriate weekly rate prescribed by this Award for an adult employee. 23.2 The union may, at any time, apply to the Commission for alteration of any rate fixed pursuant to subclause 23.1 hereof or any rate which is in operation at the date of the coming into operation of this Award. 23.3 An employee remunerated pursuant to this clause shall, if ready willing and available to work during the ordinary hours of the week, receive at least the weekly rate prescribed by this Award for the class of work being performed. 23.4 All employees working under a system of payment by results and doing the same operation in a factory or workshop whether they be adults, apprentices or juniors shall be paid the same payment by results rate.

PAYMENT BY RESULTS. 23.1 An employer may remunerate any of their employees under any system of payment by results based on rates which would enable a worker of average capacity working under conditions to earn at least 12.5% in excess of the appropriate weekly prescribed by this Agreement for an adult employee. 23.2 An employee remunerated pursuant to this clause shall, if ready, willing and available to work during the ordinary hours of the week, receive at least the weekly rate prescribed by this Agreement for the class of work being performed. 23.3 All employees working under a system of payment by results and doing the same operation in a factory or workshop whether they are adults, apprentices or juniors shall be paid the same by results rate.
