Performance Increase. Salary administration shall be based upon a performance-based system. Employees shall be granted an annual performance pay increase on their eligibility date if the employee is not at the top of the salary range of their classification, and provided the employee’s performance has not been deficient. Employees who do not receive an annual performance pay increase shall receive timely notice of deficient performance or conduct during the evaluation period. Employees shall receive a notice related to the deficiencies as they are noted prior to the completion of the performance evaluation period. “Timely” shall be a reasonable amount of time, taking into consideration the specific alleged deficient performance. Such notice shall provide the employee with adequate opportunity to correct the problem prior to the end of the evaluation period. Employees shall be eligible for performance increases at the first of the month following the intervals of:

(a) Annual periods after the initial date of hire until the employee has reached the top step in his/her salary range. However, should an employee be promoted during the first year of service with the Employer, the employee shall not receive this increase, but shall be eligible for increases in Section 3(b).
(b) The first six (6) months after promotion and annual periods thereafter until the employee has reached the top step in his/her salary range. Performance-based pay shall use the following criteria:
(1) Classification specifications developed and promulgated by the Employer.
(2) An individual position description reduced to writing.
(3) Written memoranda including letters of instruction, when necessary. Work plans where used will not be accepted as a substitute for notice of deficiency.

Performance Increase. As at September 2024 and September 2025 a technician’s Base Salary may be further increased by a set percentage based on Bengalla’s performance in the key business performance metrics of:
a. safety
b. productivity; and
c. cost. (collectively, the Metrics) for the preceding performance year (Currently 1 August – 31 July). Any such increase will be in addition to a technician’s Guaranteed Increase, as set out in Schedule A, clause 1.1 above. The technician’s Base Salary including any Performance Increase from a preceding year will form the basis of any subsequent Guaranteed Increase in the following year. At the end of a performance year Bengalla will assess its performance against each Metric as either achieved or not achieved. The required performance level for each Metric will be set by Bengalla for each performance year in line with Bengalla’s annual approved operating plan for the performance year and advised to technicians. If Bengalla’s performance achieves the required performance level in one or more Metrics a Technician’s Base Salary will increase by 0.15% for each metric where the required performance level is assessed as having been achieved. Any increase to Base Salary to be provided to a Technician as a result of Bengalla achieving the required performance level for a Metric or Metrics will apply from the next 1 September and will be calculated using the Base Salary received by a Technician immediately prior to that date. A Technician will be advised in writing if there is a change to the Technician’s Base Salary. See Schedule A, Table 1 or Table 2 for more information.
Performance Increase. 7.3.1 Upon completion of 18 months employment and subject to an ongoing satisfactory performance assessment by the employee’s supervisor, full time and part-time employees will be entitled to a service increment in accordance with Rate B of the Wage Rate Schedule (Appendix 2) of this Agreement.
Performance Increase. A. Equal to a fixed 1.5% per year (if individual is eligible) for the duration of this contract
B. Based on individual eligibility; increase is added to each eligible teacher’s previous year’s salary
C. Eligibility:
a. teachers must have an “Overall Performance Rating” of “Proficient” or “Excellent” on the most current evaluation cycle to receive the Performance Increase
b. teachers with an “Overall Performance Rating” of “Needs Improvement” on the most current evaluation cycle would receive the relevant Base Salary Increase but not the Performance Increase
D. In the event the weighted average CPI is less than 0.9%, teachers will not receive the Performance Increase until January 1 of the relevant school year; this raise will not be retroactive to the beginning of the school year and will be paid at the relevant amount starting January 1 until the end of that contract year.
E. Part-time teachers employed at the 0.49 level or less will receive one (1) Performance Increase for every eligible two (2) years of service at the 0.49 level or less
Performance Increase. To provide an incentive for the City Manager to produce results above and beyond the expected fulfillment of the City Manager’s regular duties, the City agrees to consider providing a financial incentive for extraordinary performance. Annually, and at the Council’s sole discretion, the City Manager may be eligible for a “performance increase” equal up to 3% of the City Manager’s Base Salary. Any such incentive would be considered a one-time bonus and not a portion of the City Manager’s salary and thus, is not pensionable. The performance increase may be based, in part, on the accomplishment of specific goals set by the City Council pursuant to Section 2.D of the Agreement.

The Purchaser does hereby agree to increase the Purchase Price payable for the Purchased Shares, by making payments to the Vendors over a three year period, based on the following formula: US$1,000,000 (in the aggregate) shall be paid to the Vendors for each US$10,000,000 increase in ARC Revenue as compared to the ARC revenue of the Corporation for its fiscal year ended September 30, 1999, as set out in Schedule 3.3 as may be adjusted by the auditors of the Purchaser, such increase to be computed by independent auditors, in accordance with GAAP. For the purposes of this section "ARC Revenue" shall be defined as gross sales of the Corporation minus purchases and/or sales generated by the Purchaser and its subsidiaries, but inclusive of purchases and/or sales generated by subsidiaries of the Purchaser with relationships with the Corporation that existed prior to Closing, namely, the following subsidiaries: Mr. Cheap's Travel Ltd. and Gotham Media Group, Ltd. as set out in Schedule 3.3. Payments under this section 3.3 shall be made by the Purchaser to the Vendors on an annual basis for the fiscal periods on each of September 30, 2000, September 30, 2001 and September 30, 2002, within 30 days of receipt by the Purchaser of its annual audited financial statements for the applicable year end and in the aggregate, payments under this section 3.3 shall not exceed US$4,000,000 over a three year period.
