POLICIES, PROCEDURES AND GUIDELINES. HCO (including its Users) must comply with SELECTHEALTH’s then-current policies, procedures, and guidelines for (a) security, (b) protection of PHI, and (c) access to or use of the Services, Data Repository, Licensed Software, or any of SELECTHEALTH’s computer systems, networks, or communication systems. SELECTHEALTH will make the applicable policies and procedures as easy to access as reasonably practicable.

Details of such policies, procedures and guidelines will be provided to Supplier in writing and will be binding on Supplier from the date of issuance so long as they do not contradict the express terms of this Agreement. Such policies, procedures and guidelines will include, but not be limited to, the return or replacement of Products, the reporting of customer complaints and the development and use of promotional materials.

7.2. CASA and its employees agree that such policies, procedures and guidelines will be available to all employees and will be updated as necessary following a reasonable consultation period to be provided through the Workplace Relations Group consultation mechanism outlined at clause 64.

POLICIES, PROCEDURES AND GUIDELINES. The Employer may have policies and procedures that relate to the Employee's job. The Employer will make the Employee aware of the policies and procedures and will make sure they are available to the Employee. The Employee must always be familiar with these and follow them at all times. The Employer may introduce new policies or procedures, or change or cancel existing ones, but must give reasonable notice of any changes. Failure to comply with policies, procedures, guidelines or reasonable instructions from the Employer may result in disciplinary action including termination of employment. In the event of a conflict between the terms of this Agreement and the policies, rules and procedures, the terms of this Agreement will have precedence.

4.3.2 Employees must comply with any obligations or directions set down in such policies, procedures or guidelines. However, such policies and procedures do not create and shall not be read as creating any rights that are enforceable by an Employee either under this Agreement or the Employee’s contract of employment.

Distributor hereby acknowledges and agrees that it has read and understands the ExxonMobil Policies, Procedures and Guidelines (individually referred to as a “Policy”, “Procedure” or “Guideline” and collectively referred to as the “Policies, Procedures and Guidelines”). Distributor agrees to comply with, and to ensure that its employees, contractors, agents, Sub-distributors, Sellers, and permitted assigns comply with, the Policies, Procedures and Guidelines. ExxonMobil may from time to time change, delete, add to, or supplement the Policies, Procedures and Guidelines by providing written or electronic notice to Distributor via a Network update or in accordance with Section 14.2. The obligation on the part of Distributor to comply with such updated Policies, Procedures and Guidelines will be automatically incorporated into this Agreement upon provision of such notice. Distributor agrees to check the Network, or any successor system, at least once every week during the Term of this Agreement, and to read all announcements so provided, including any updates to the Policies, Procedures and Guidelines.
