PREQUALIFICATION OF BIDDERS. Each prospective bidder and subcontractor will be required to file a document entitled “Prequalification Questionnaire.” The foregoing shall be filed on a form provided by the Tennessee Department of Transportation. The form must be filled out completely, and the truth and accuracy of the information provided must be certified by a sworn affidavit signed by an officer, partner, owner or other authorized representative of the applicant who has authority to sign contracts or other legal documents on behalf of the applicant. A prospective bidder must be prequalified by and in good standing with the Tennessee Department of Transportation prior to the issuance of a proposal form. A prospective subcontractor must be prequalified by and in good standing with the Tennessee Department of Transportation prior to being approved as a subcontractor. Each prospective bidder or subcontractor shall notify the Tennessee Department of Transportation if there is any subsequent change in the name, organization or contact information provided. Prospective bidders’ “Prequalification Questionnaire” shall be filed with the Tennessee Department of Transportation at least fourteen (14) days prior to the date of opening bids on any letting in which the applicant intends to submit a bid to the CITY/TOWN/COUNTY OF JURSDICTION NAME, or at least fourteen (14) days prior to the date on which the applicant requests approval as a subcontractor under a contract awarded by the CITY/TOWN/COUNTY OF JURSDICTION NAME. Bidders intending to submit proposals consistently shall complete and submit the prequalification application annually; however, this document may be changed during such period upon submission of additional favorable reports or upon receipt by the Tennessee Department of Transportation of substantiated evidence of unsatisfactory performance. The Tennessee Department of Transportation reserves the right to request additional information and documentation to clarify and/or verify any information submitted in an applicant’s prequalification application. A proposal to be used for non-bidding purposes may be issued to any interested party regardless of prequalification. This proposal Contract will be marked "Void for Bidding". A contractor that has purchased a proposal contract that was marked “void for bidding” can buy another book once they are fully prequalified before the bid date.

PREQUALIFICATION OF BIDDERS. The Contracting Agency will provide a Bid Proposal Form only after a prospective Bidder submits a “Standard Questionnaire and Financial Statement.” This questionnaire enables the Contracting Agency to decide whether or not the Bidder is qualified to perform Highway, road, or other public work. The questionnaire shall be sworn to before a person authorized to take oaths. On the basis of this questionnaire, the Contracting Agency will either specify the type and amount of Work it considers the prospective Bidder prequalified to perform or advise the prospective Bidder of the reasons they failed to be prequalified. To remain prequalified, the Bidder must submit an updated questionnaire once a year and supplements whenever required by the Contracting Agency. A submittal deadline applies to any prospective Bidder not prequalified or from whom a supplemental questionnaire is due. To receive consideration for issuance of a Bid Proposal Form on a specific project, the questionnaire (or supplement) must be received by the Prequalification Engineer no less than 15-days prior to the scheduled Bid opening. The Contracting Agency may withdraw a Bidder’s prequalification or reduce its amount if: 1. The extent of other work the Bidder has under Contract (Contracting Agency or otherwise) justifies such action, or 2. Past or present work on a Contracting Agency Contract has been less than satisfactory. If a Bidder’s questionnaire does not contain sufficient information, the Contracting Agency may refuse to provide a Bid Proposal Form and disregard any Bid submitted. After opening Bids, the Contracting Agency may decide that a prequalified Xxxxxx is not responsible and may refuse to accept the Bid on that basis. Such a refusal will be conclusive unless the Bidder appeals within five days to the Superior Court of Xxxxxxxx County. Any appeal shall be heard within ten days after it is filed and shall provide at least five days’ notice to the Contracting Agency. The Bidder shall ensure that the combination of the Bid amount and other Contract work with the Contracting Agency does not exceed the prequalification amount. If this combination does exceed the prequalification amount, the Contracting Agency may determine the Bidder to be not responsible and refuse to Award a Contract. Two or more prospective Bidders may, in a joint venture, prequalify and Bid jointly on a single Contract. PREQUALIFICATION OF BIDDERS. ‌ Each Bidder shall furnish the Airport Authority satisfactory evidence of his/her competency to perform the proposed Work. Such evidence of competency, unless otherwise specified, shall consist of statements covering the Bidder’s past experience on similar work, a list of equipment that would be available for the proposed Work, and a list of key personnel that would be available. In addition, each Bidder shall furnish the Airport Authority satisfactory evidence of his/her financial responsibility. Such evidence of financial responsibility, unless otherwise specified, shall consist of a confidential statement or report of the Bidder’s financial resources and liabilities as of the last calendar year or the CMR’s last fiscal year. Such statements or reports shall be certified by a public accountant. At the time of submitting such financial statements or reports, the Bidder shall further certify whether his/her financial responsibility is approximately the same as stated or reported by the public accountant. If the Bidder’s financial responsibility has changed, the Bidder shall qualify the public accountant’s statement or report to reflect his/her (Xxxxxx’s) true financial condition at the time such qualified statement or report is submitted to the Airport Authority. Unless otherwise specified, a Bidder may submit evidence that he is prequalified with the State Highway Division and is on the current “bidder’s list” of the state in which the proposed Work is located. Such evidence of State Highway Division prequalification may be submitted as evidence of financial responsibility in lieu of the certified statements or reports hereinbefore specified. Each Bidder shall submit “evidence of competency” and “evidence of financial responsibility” to the Airport Authority with the Bid.

Contractors will be prequalified for different sized tanks and towers based on experience, workmanship, successful Project completions with XXXXX, and Contractor’s financial data. Any Contractor who has any projects in dispute or unfinished because of Contract problems will be considered NOT prequalified.
