Presence of a Shop Xxxxxxx. In all cases where the Executive Director, or her designate considers an employee's conduct to warrant a disciplinary action (dismissal, suspension, reprimand), no steps shall be taken other than in the presence of a Shop Xxxxxxx who may, at the option of the employee, act as an advocate. The employee shall have an opportunity to state her side of the case. In the event a xxxxxxx is unavailable within the bargaining unit, the Union will provide a representative for the employee in a timely manner.

The employee shall have an opportunity to state his side of the case.
Presence of a Shop Xxxxxxx. Any employee covered by this Agreement who is called into the Company’s office for a disciplinary action or interview shall be informed by the Company of the right to be accompanied by a Shop Xxxxxxx. Where a shop xxxxxxx is declined by the Employee, this shall be noted on the written discipline and initialled by the Shop Xxxxxxx.

Presence of a Shop Xxxxxxx. When the Employer summons an employee for a disciplinary measure, it shall inform the Chief Xxxxxxx. The Chief Xxxxxxx shall then inform the Employer of the Shop Xxxxxxx who will be present at the meeting. The Branch Manager shall also advise this Shop Xxxxxxx at least twenty-four (24) hours in advance. Should the Shop Xxxxxxx be unable to attend due to force majeure, the employee shall be entitled to be accompanied by another employee of their choosing who has at least one (1) year of seniority or less if no such employee is available. If needed, the person who accompanies the employee shall speak with them prior to meeting with the Employer and afterward, if required, provided that doing so does not affect their work shift. Upon request, the employee or the Employer may record the meeting.
Presence of a Shop Xxxxxxx. Where the Employer considers an Employee’s conduct to warrant disciplinary action (dismissal, suspension, verbal or written reprimand) a shop xxxxxxx or representative shall be in attendance at such meeting.

The non-Federal entity must report all suspected or reported violations to the Federal awarding agency. The contracts must also include a provision for compliance with the Xxxxxxxx “Anti-Kickback” Act (40 U.S.C. 3145), as supplemented by Department of Labor regulations (29 CFR Part 3, “Contractors and Subcontractors on Public Building or Public Work Financed in Whole or in Part by Loans or Grants from the United States”).
