PRICE BASIS. 7.1 The tariffs reflected in Annexure B shall remain fixed for a 12 (twelve) month period except for diesel/petrol price adjustments as contained in clause 7.3. 7.2 Should the Agreement be extended for a period longer than one year, the tariffs shall be reviewed and negotiated in good faith by the Parties before the one-year anniversary of the Agreement and annually thereafter. The negotiated tariffs will be applicable with effect from the date of anniversary of the Agreement and annually thereafter. If the Parties fail to reach agreement, then the following formula shall be used to determine the tariff adjustment. NP = TP (20 + 80 L1) 100 L1O Where: NP = Revised tariff TP = Original tender tariff 20 = The fixed portion of the tariff that will not be subject to adjustment. L1 = The average of the SEIFSA Index for Road Transport, Table L1, for the latest available 12-month period prior to the date of tariff increase. L1O = The average of the SEIFSA Index for Road Transport Table L1 for the corresponding 12-month period prior to the period as referred to in L1. 7.3 In the case of diesel/petrol price adjustments of more than 10%, ArcelorMittal will on receipt of a request from the Contractor, adjust the tariff, provided the application for the adjustment of the tariff is received and proved to ArcelorMittal's satisfaction within 14 (fourteen) days from the date of the official adjustment of the diesel/petrol price by the governmental authority concerned. The adjusted tariff will be effective from the 1st calendar day of the month following the month in which the diesel/petrol price adjustment occurred. If the application is received and accepted after the 14 (fourteen) days, the adjusted tariff will be effective from the 1st calendar day of the second month following the month in which the diesel/petrol price change occurred. The portion of the tariff that will be subject to diesel/petrol price adjustments is xxxx% 7.4 The base date for determination of the diesel price shall be September (R12.6205 per litre) and the applicable tariff for Gauteng as reflected on the South African Petroleum Industry Associations’ website (xxxx://xxx.xxxxx.xx.za/stats/diesel.htm), shall apply to all diesel/petrol price adjustments due to diesel/petrol price changes. 7.5 All requests for tariff adjustments shall be submitted to the Logistics Procurement Specialist, Group Logistics, ArcelorMittal. PRICE BASIS. 3.1 Unless otherwise agreed, price of the material shall be free on board (stowed), Xxxxxxxxxxxxx Xxxx, Xxxxxxxxxxxxx, Xxxxx or Xxxxxxxxxx Xxxx, Xxxxxxxxxxxxx, Xxxxx or any other port as per RINL VSP as specified in NIT. 3.2 (Applicable for steel products only): The BUYER shall arrange at his own cost and expense to provide materials including dunnaging required for stowing, dunnaging, lashing, shoring and securing of the material inside the hatches/holds of the vessel at load port to the Master of the vessel nominated by BUYER and accepted by SELLER for delivery as per clause 5., herein below. Labour charges involved in the work of dunnaging/stowing/ lashing/ shoring and securing of the materials shall be borne by SELLER. 3.3 SELLER shall under no circumstances be liable for any costs/ charges/ liabilities/ insurance/ freight/ taxes or duties/ levies/ fees whatsoever nature, including by reason of importation of the material in the country of import, arising subsequent to the delivery of the materials as per the agreement on the basis of FOBST. 3.4 Marine Insurance to be covered by the BUYER.

PRICE BASIS. The Contract Price is firm and is inclusive of GST and all taxes, duties (including any customs duty) and government charges imposed or levied in Australia or overseas. The Contract Price includes the cost of any packaging, marking, handling, freight and delivery, insurance and any other applicable costs and charges.
PRICE BASIS. 18.1 Payments will be calculated based on the vehicle category and the total distance travelled daily as set out in the Schedule of rates at item 4 of Schedule 1 to this Agreement for loaded kilometres. Distance travelled will be calculated by the shortest practicable route between the Student's homes and their school/s. 18.2 The Schedule of rates shall be subject to annual review by the Department. 18.3 The annual review shall take account of the previous twelve (12) months (as at the 30 September) CPI as published by the Australian Bureau of Statistics for Sydney, and related industry cost increase, e.g. fuel, insurance. The Department shall then determine an appropriate percentage increase to apply to all contractors each year. Such increase shall be not less than the previous twelve (12) months (as at 30 September) CPI as published by the Australian Bureau of Statistics for Sydney.
