Priority Service. E.1 In the event any driver makes any request for repairs and/or service for his/her bus and such request is based on any problem that could affect the safe operation of that bus, the request shall take precedence over any pending repair or service and shall be given immediate attention before the next scheduled trip of the vehicle.

Priority ServiceIn order to effectuate the underlying objectives of this Agreement, THPP agrees as follows: (a) Throughout the Term of this Agreement, THPP shall take such action as may be necessary, including filing and continuing to maintain tariffs (including the Rules Tariff) with the NDPSC, to permit TRMC to ship the full Reserved Capacity without subjecting TRMC to prorationing or any similar reduction in TRMC’s allocation. (b) Prior to filing any new tariff with a Governmental Authority, THPP shall consult with TRMC as set forth in Section 5(e)(ii). THPP shall ensure that any new tariff does not in any way impinge upon or prejudice any of TRMC’s rights under the terms of this Agreement, including TRMC’s rights under Section 8(a) above. (c) THPP shall provide TRMC with reasonable advance notice before taking any actions to shut down or reduce throughput rates on any Segment of the Pipeline System or any gathering line, and any such action shall be subject to the provisions of Section 2(a)(ii). Upon request by TRMC, THPP shall provide a reasonable explanation for the actions it is taking, and if an action is temporary, inform TRMC of the expected duration. The Parties shall negotiate in good faith arrangements to ensure that such actions do not impair the rights and obligations hereunder.
Priority ServiceSubject to Section 14, but notwithstanding any other provision of this Agreement to the contrary, to the extent permitted by Applicable Law, the Proration Policy shall provide generally that a tender by Customer of Crude Oil not exceeding the Minimum Volume Commitment from the Origin Point to the Delivery Point shall not be subject to prorationing to accommodate nominations of uncommitted volumes from any shipper under Ordinary Operating Conditions.

The PROPERTY OWNER/ AGENT understands that THE COMPANY’S liability under this agreement is limited to providing REMEDIAL CORRECTIONS ONLY and in no way, implied or otherwise, is responsible for damages or repairs to the structure(s) or contents. Priority Service. As a Xxxxxx Comfort Club Agreement member, you will always receive priority for repairs over non-members, generally resulting in same day service. During high-volume periods, please help us take care of you by allowing us to schedule your repairs according to need: repairs for safety issues, repairs for medical needs, especially during extremely high or low temperatures, and repairs for no heat or no cooling will take priority.
Priority Service. Shipper qualifies as a Priority Shipper and as such, Carrier agrees to have available Pipeline Capacity to receive and transport one hundred percent (100%) of Shipper’s Deemed Volume Commitment. Carrier shall enter into no other transportation arrangements with Third Party Shippers that would prevent Carrier from transporting Shipper’s Deemed Volume Commitment. In the event that Carrier provides transportation services to any Third Party Shipper and Carrier receives more Nominations in a Month for transportation of Raw Make on Carrier’s Pipeline System than Carrier is able to transport, then consistent with the Tariff, Carrier shall allocate to Shipper the lesser of Shipper’s Nomination for the Proration Month or its Deemed Volume Commitment.

In the event that Carrier provides transportation services to any Third Party Shipper and Carrier receives more Nominations in a Month for transportation of Raw Make on Carrier’s Pipeline System than Carrier is able to transport, then consistent with the Tariff, Carrier shall allocate to Shipper the lesser of Shipper’s Nomination for the Proration Month or its Deemed Volume Commitment.
