Problem Solving Procedures. When an alleged misapplication, misinterpretation, or violation of this Memorandum of Understanding is suspected, an employee may make a statement which contains: • The facts upon which the problem is based; • Reference to the specific section of this Memorandum of Understanding which is alleged to have been violated;
Problem Solving Procedures. A. Nothing contained herein shall be construed to prevent any individual teacher from presenting a problem and having the problem adjusted without intervention of the Association, if the adjustment is not inconsistent with the terms of this Agreement, provided that the Association has been given an opportunity to be present at such adjustment.
B. This article is not intended as a substitute for procedural rights under the Tenure Act. Though not absolutely necessary, it would be both professional and helpful to inform your immediate supervisor or supervisors of your intent to appeal to the next highest official by providing them with a copy of your appeal to that person. The teacher may, if he wishes, send a copy of the correspondence to the next highest official, when presenting problems to immediate supervisor.
C. Any problem must be filed within 45 school days of the occurrence or reasonable knowledge thereof. Probationary teachers hired after August 1, 2004 have no access to the following grievance process beyond the Board level in regards to dismissal due to an unsatisfactory evaluation.
1. FIRST STEP: (Elementary) Elementary Principal (Secondary) Secondary Principal (Adult High School) Director or Designee Beginning with the first step:
a. If on any occasion when an administrative official fails to respond to a problem in the designated time limit, the problem will be automatically advanced to the next step.
b. If any administrator in the line of problem solving finds that he is not in a position to solve a problem, he will initial the written record and forward immediately to the next higher supervisor.
1. Teacher presents problems to immediate supervisor. (If a problem involves more than one school building, it may be filed directly at the second step.)

Problem Solving Procedures. When an alleged misapplication, misinterpretation, or violation of this Memorandum of Understanding is suspected, or there are concerns with any unresolved conflict regarding conditions of employment (this includes any perceived impacts from the implementation of AI), including disciplinary actions, an employee may initiate the following problem-solving procedure:
Problem Solving Procedures. Prior to implementation of the Procedures for Grievance, unit members are encouraged to attempt to identify and resolve a problem informally. Both the unit member and the District have the right to a conferee at the problem solving conferences. No reprisals shall be invoked against any unit member for processing a grievance. The parties are encouraged to work together at all stages of the grievance procedure to resolve grievances.
Problem Solving Procedures.
15.13.1 If the evaluator and unit member have an unresolved disagreement 1865 over the evaluation/observation procedures, the unit member may elect

Problem Solving Procedures. Nothing in this Agreement shall be interpreted to prohibit the use of the Problem Solving Procedures set forth in Section XXII of the Manual with respect to any matter that is not a Grievance as defined in Sec. B1 above. An Employee shall be entitled to Union representation during the Problem Solving Procedure or any portion thereof.
Problem Solving Procedures. 1589 15.13.1 If the evaluator and unit member have an unresolved disagreement over 1590 the evaluation/observation procedures, the unit member may elect to implement 1591 the following Problem Solving Procedure:
1592 15.13.1.1 Within five (5) days of the request, the evaluator, the unit 1593 member, and a person of each party’s choice shall meet to 1594 discuss the problem.
1595 15.13.1.2 If the disagreement cannot be resolved, written summary 1596 reports will be submitted to the Superintendent by the 1597 evaluator and the unit member within five (5) days.
1598 15.13.1.3 The District’s established grievance procedures may be 1599 utilized for processing disputes that may arise over the evaluation 1600 procedure, but shall not be used to challenge the professional 1601 judgments of the evaluator.
