Production Information. From the start of production from the Contract Area, the Contractor shall submit a monthly Production Statement to the Designated Authority showing the following information separately for each producing Development Area and in aggregate for the Contract Area: (a) the quantity of Crude Oil produced and saved; (b) the quality characteristics of such Crude Oil produced and saved; (c) the quantity of Natural Gas produced and saved; (d) the quality characteristics of such Natural Gas produced and saved; (e) the quantities of Crude Oil and Natural Gas used for the purposes of carrying on drilling and production operations and pumping to field storage; (f) the quantities of Crude Oil and Natural Gas unavoidably lost; (g) the quantities of Natural Gas flared and vented; (h) the size of Petroleum stocks held at the beginning of the month in question; (i) the size of Petroleum stocks held at the end of the month in question; (j) the quantities of Natural Gas re-injected into the Reservoirs; and (k) in respect of the Contract Area as a whole, the quantities of Petroleum transferred at the Field Export Point. All quantities shown in this statement shall be expressed in both volumetric terms (barrels of Crude Oil and cubic meters of Natural Gas) and in weight (metric tonnes).

Production InformationPromptly following satisfaction of the Condition Subsequent, and continuing thereafter, HSR shall provide to UXP on a daily basis the estimated gross daily production volumes and on a monthly basis copies of the Gas Metering Volume Statements for each HSR-operated well in which UXP has a working interest. Such information shall be the same information as used and relied on by HSR. However, HSR does not represent, warrant, or guaranty the accuracy or completeness of such production data. UXP acknowledges that use of or reliance on such data shall be at UXP's sole risk. HSR shall have no obligation to allocate to or identify the various owners in such gross daily production volumes for purposes of delivering such data to UXP pursuant to this Agreement. Production InformationIt is agreed that the Designer must be informed regarding the following prior to agreeing to design a Production and/or negotiating a fee for design services: • The name of the Director or Choreographer or Musical Director or person otherwise designated as the leader of the Creative Team; • The nature of the Production as envisioned by the Theatre and the Director or person otherwise designated as the leader of the Creative Team; • Any other requirements of the Production; • Details of the proposed Production budgetary allocations; • Details of technical and production equipment and services allocated to the Production; • Planned Production schedules; • Special requests with respect to scenic models, costume sketches, production and technical drawings; • Plans for crewing of the proposed Production; • Proposed length of run of the Production; • Venue name and Category as per the CTA; • And any particular and relevant artistic policies of the Theatre. Subsequent to the engagement of the Designer, the Designer will be informed at the earliest possible opportunity of all major changes in creative personnel, Production and rehearsal schedules, major casting, budgets, scenery, lighting, costuming and sound. In the event that, after the Preliminary Designs have been approved, there are changes to the script and/or concept and/or budget of the Production which go beyond the normal modifications and additions which are understood at the date of signing to be part of the creative process and for which the Theatre requires re- Design or additional designs, the Theatre shall pay to the Designer additional compensation for each and every day required to complete the modifications and/or new designs. In the event that, after the Completed Designs have been approved by the Theatre, there are changes to the script and/or concept and/or budget of the Production which go beyond the normal modifications and additions which are understood at the date of signing to be part of the creative process or the Theatre requests additional designs, drawings or additional time, other than that needed for the execution of the Completed Design, the Theatre shall pay to the Designer additional compensation for each and every day required to complete the modifications and/or new designs.
Production InformationBoth Parties shall use commercially reasonable efforts to notify the other Party of any take or delivery deficiencies. The Parties recognize that each may have access to certain information necessary to confirm gas flows and agree to share such information on a commercially reasonable basis. With respect to non-operated UPR properties, subject to the concurrence of the operator of such property, UPR shall instruct the operator to send duplicate copies of production notices to UPFUELS. With respect to such non-operated UPR properties, for purposes of Section 4.2.4, a UPFUELS Take Default shall be deemed to occur upon the receipt of such notice from either UPR or its operator. UPFUELS shall have until the conclusion of the Day to which such notice applies or the conclusion of the Day such notice is received, whichever is later, to remedy such UPFUELS Take Default. If UPFUELS does not remedy the UPFUELS Take Default by the end of such Day then the penalties set forth in Section 4.2.4 shall apply. With respect to properties where UPFUELS is a shipper on a Transporter or receives Gas from a facility operated by UPFUELS or an Affiliate of UPFUELS, a UPFUELS Take Default will be deemed to have occurred upon the receipt of oral, written or electronic notice from a Transporter or the Affiliate of the failure of any Gas flows and shall notify UPR of such UPFUELS Take Default. If Gas is produced into a Delivery Point(s) where UPFUELS has an OBA or similar agreement in place, then no UPFUELS Take Default shall be deemed to have occurred so long as UPFUELS pays UPR for all Gas delivered pursuant to this Agreement at such Delivery Point.
