Provincial Responsibilities. The Government of Nova Scotia will: a) ensure that over the period of April 1, 2005, to March 31, 2010, its average annual capital spending on Municipal Infrastructure will not be less than the Provincial Base Amount; b) ensure that the funding under this Agreement provides additional revenues for Municipalities rather than displacing other provincial infrastructure funding; c) jointly sign with each Municipality a Municipal Funding Agreement, that describes the terms and conditions for federal funding, including the use of such funds, substantially in the form as set out in the attached Schedule I; d) include the Eligible Recipient Requirements in Municipal Funding Agreements and enforce all terms and conditions of Funding Agreements in a diligent and timely manner and seek remedies from non­compliant Eligible Recipients; e) ensure that each municipality complete, prior to the fourth year of this Agreement, a Capital Investment Plan; f) over the life of the Agreement, require through Municipal Funding Agreements the development of Integrated Community Sustainability Plans, either by a Municipality or at a regional level; g) require that all Municipalities adopt and use the accounting rules of the Public Sector Accounting Board; h) require through Municipal Funding Agreements that Municipalities’ contributions over the period of April1, 2005 to March 31, 2010 include net incremental infrastructure investments, a commitment not to reduce or clawback any capital infrastructure funding which is currently being made available for infrastructure, and commitments to complete integrated community sustainability plans and make them available to the public; i) enforce penalties through Municipal Funding Agreements if a Municipality is non­compliant with the agreement’s terms and conditions. Penalties may include withholding of payment, reduction of payments, return of payment and/or non­renewal of the Municipal Funding Agreement; j) share information on existing and emerging provincial programs or initiatives that are consistent with the New Deal for Cities and Communities; k) support the development of a ‘toolbox’ for Municipalities – such as guides on capital planning, integrated sustainable planning, debt management, regional co­operation, required accountability reporting;

Provincial Responsibilities. The Province agrees to provide Funds to the Municipality in trust over the term of this Agreement in incremental payments generally in accordance with Schedule 8 subject to the following: (a) receipt of Funds from the Government of Canada as agreed to in the Canada-Nova Scotia Agreement On The Transfer Of Federal Gas Revenues Under The New Deal For Cities And Communities; (b) execution of this Agreement by the Parties; (c) the Municipality's compliance with this Agreement.
Provincial Responsibilities. 5.3.1. The British Columbia Ministry of Agriculture is the lead provincial agency for the strategic development of the aquaculture industry in British Columbia and for interacting with Canada on Aquaculture matters; 5.3.2. The British Columbia Ministry of Natural Resource Operations is the lead provincial agency for the management of the aquaculture sector and for interacting with Canada on aquaculture licensing and tenure matters; 5.3.3. The British Columbia Ministry of Environment is responsible for the management of waste discharge with the exception where this is otherwise regulated as part of the proper management and control of fisheries and fish habitat; 5.3.4. Other provincial agencies, notably the Ministry of Environment shall continue to interact directly with appropriate federal agencies regarding matters within the Ministry of the Environment mandate and may also serve as members of the management committee described below; 5.3.5. British Columbia is responsible for management of provincial Crown land and may issue tenures for the purpose of aquaculture in the Province of British Columbia; and 5.3.6. British Columbia is responsible for the management and regulation of business and labour aspects of aquaculture and for labour on farms in British Columbia.
Provincial Responsibilities. The Government of Alberta will: 3.4.1 accept the transfer of gas tax funds from Canada into its General Revenues. 3.4.2 allocate Funds to Municipalities through Alberta’s Ministry of Infrastructure and Transportation. 3.4.3 carry out its administrative responsibility utilizing existing resources with no administrative or overhead charges against the Funds contribution transferred to Alberta under this Agreement. 3.4.4 sign a Memorandum of Agreement with each Municipality prior to the transfer of funds from Alberta to a Municipality. The template for the Memorandum of Agreement is included in Schedule 6. Alberta agrees to enforce all terms and conditions of the Memorandum of Agreement. 3.4.5 will ensure each Municipality completes a Multi-Year Capital Infrastructure Plan prior to the fourth year of this Agreement. 3.4.6 transfer the funds listed in Schedule 1 to Municipalities in a timely manner and within a Memorandum of Agreement between Alberta and each Municipality. A signed Memorandum of Agreement between Alberta and a Municipality will act as the trigger for the Province to transfer to the Municipality, its share of the gas tax revenue. 3.4.7 ensure that over the period April 1, 2005 to March 31, 2010 its average annual capital spending on Municipal Infrastructure and that of Municipalities within Alberta will not be less than the Base Amount, before the creation of Alberta’s $3 billion Infrastructure Program. The Government of Alberta and the Municipalities will not reduce, eliminate or clawback any funding which is currently being made available for Municipal Infrastructure. Funding for provincial programs is subject to legislated appropriations. 3.4.8 enforce penalties if a Municipality is non-compliant with the Agreement’s terms and conditions. Penalties may include withholding of payment, reduction of payment, return of payment and/or non-renewal of the Memorandum of Agreement. 3.4.9 will ensure, within the term of this Agreement, that each Municipality develops an Integrated Community Sustainability Plan as the basis upon which they will determine plans and priorities to aid in their achieving sustainability. The Parties, in collaboration with Alberta’s Municipalities, will agree to the form and content of the Integrated Community Sustainability Plan before March 31, 2006. 3.4.10 will continue to support Municipalities including: Alberta’s commitment to a five year $3 billion Municipal Infrastructure Program; creating enhanced partnerships with ...

The Credit Union shall not be liable in any manner for such risk unless Credit Union fails to follow the procedures described in materials for use of the service. You assume exclusive responsibility for the consequences of any instructions you give to the Credit Union, for your failures to access the Service properly in a manner prescribed by the Credit Union, and for your failure to supply accurate input information, including, without limitation, any information contained in an application.

  • General Responsibilities Issuer hereby engages Distributor to act as exclusive distributor of the shares of each class of the Funds. The Funds subject to this Agreement as of the date hereof are identified on SCHEDULE A, which may be amended from time to time in accordance with Section 11 below. Sales of a Fund's shares shall be made only to investors residing in those states in which such Fund is registered. After effectiveness of each Fund’s registration statement, Distributor will hold itself available to receive, as agent for the Fund, and will receive by mail, telex, telephone, or such other method as may be agreed upon between Distributor and Issuer, orders for the purchase of Fund shares, and will accept or reject such orders on behalf of the Fund in accordance with the provisions of the applicable Fund’s prospectus. Distributor will be available to transmit orders, as promptly as possible after it accepts such orders, to the Fund’s transfer agent for processing at the shares’ net asset value next determined in accordance with the prospectuses.

  • Mutual Responsibilities It is recognized by this Agreement to be the duty of the Company to explain fully the terms of this Agreement to all its officers, foremen and others engaged in a supervisory capacity and it is recognized to be the duty of the Union to explain fully to its members, its and their responsibilities and obligations under this Agreement.

  • School Responsibilities 1. The School shall have the total responsibility for planning and determining the adequacy of the educational experience of students in theoretical background, basic skill, professional ethics, attitude and behavior, and will assign to the Facility only those students who have satisfactorily completed the prerequisite didactic portion of the School’s curriculum. 2. The School shall provide proof to the Facility, of professional liability insurance policy of at least One Million Dollars ($1,000,000.00) per occurrence or claim and Three Million Dollars ($3,000,000.00) in the aggregate covering the acts of such student while participating in the program at the Facility.
