Public Holidays. (a) The Project recognises the following gazetted Public Holidays: (1) New Year’s Day (2) Australia Day (3) Good Friday (4) Easter Saturday (5) Easter Monday (6) ANZAC Day (7) May Day (8) Queen’s Birthday (9) Picnic Day (10) Darwin Show day (11) Christmas Day (12) Boxing Day (13) or a day declared in lieu of any such day or days above other than Christmas Day and Boxing Day (14) any additional day gazetted by the relevant Northern Territory Minister. (b) Employees, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays. (c) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls. (d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle. (c) Employees may An employee who is required to work on any of the foregoing holidays shall be paid at the rate of one and one half (1 ½) times her regular straight time pay for all hours worked on such holiday, in addition to the Public Holiday Pay for that day in accordance with the Employment Standards Act, 2000, as amended from time to time.
17.02 Subject to staffing exigencies, a nurse who works Christmas/ Boxing Day shall not be required to work New Year’s Eve Day/New Year’s Day. The Employer will endeavour to rotate the requirement to work Christmas/Boxing Day with New Year’s Eve Day/New Year’s Day on a Public Holidayalternate years. Where Time off at Christmas shall be shall be defined as being off December 24th ,25th ,26th and time off at New Years shall be defined as being off December 31 and January 1st. Request for time off at Christmas or New Years shall be submitted in writing to the Employer requires an Employee by November 15th. The master schedule may be adjusted to work on a Public Holidayallow for scheduling requests over the Christmas/New Year’s period, they will provide one week’s notice of such a requirement. Where an Employee does not wish between December15th to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsJanuary 15th.
(d) Payment for all time 17.03 Time worked on a Public Holiday the holidays listed in 17.01 (a) between 0001 hours and 2400 hours shall be at time deemed to be work performed on the holiday and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday all work shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, rate of time and one half the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclestraight time hourly rate of pay.
(e) An Employee other than 17.04 Where a shift worker who works holiday falls during a full-time nurse’s scheduled vacation period, her vacation shall be extended by one day unless mutually agreed to schedule a different day off. Where a holiday falls on a Public Holiday shall full-time nurse’s scheduled day off, an additional day off may be paid for at least four (4) hours at the applicable ratescheduled.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Where the project employs Such public holiday will occur on a large number of Non-Local Employees, with the exception of day between Christmas Day, Boxing Day and New Year’s Day, Year‘s Day as determined by the Projects managing contractor may elect to keep the Site open employer. This subclause shall apply in substitution for work on all Public Holidaysany local public holiday or half public holiday proclaimed in local government area.
(ci) Employees may be A full-time employee who is covered by paragraph (ii) of subclause (a) of Clause 22 - Annual Leave and Leave Loading, and who is required to and does work on a Public Holidaypublic holiday prescribed by subclauses (a) and (b) of this clause shall be paid for the time actually worked at the rate of time and one-half in addition to his/her ordinary weekly rate. Where In respect of the Employer requires an Employee to work time worked on a Public Holidaypublic holiday, they will provide one week’s notice payment shall be made for a minimum of such four hours‘ work, and any balance of the day or shift not worked shall be paid at ordinary rates.
(ii) Where a requirement. Where an Employee does not wish to work public holiday falls on a Public Holidayrostered day off of a full-time shift worker as defined in Clause 11 - Definitions, he or she must notify their Employer at least who receives four weeks annual leave in accordance with paragraph (ii) of subclause (a) of Clause 22 - Annual Leave and Leave Loading, such shift worker shall be paid one day‘s pay in addition to the appropriate ordinary weekly rate.

(d) Payment for all time worked Employees engaged upon a seven-day shift roster and who are required to work on a Public Holiday any public holiday prescribed by subclause (a) of this clause shall be at paid, in addition to their ordinary pay for that day, an allowance of 50 per cent of their ordinary day‘s pay for work performed within ordinary hours and double time and a half for the hours worked, except that any all time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s outside ordinary pay cyclehours.
(e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate.

(iii) In each calendar year, where no additional public holiday (or part thereof) in accordance with subclause (i) above is proclaimed and observed, the Employer shall grant an extra public holiday, to be observed on the August Bank Holiday, or on a day between Christmas Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays.
(civ) Employees The Employer may be required request an employee to work on a public holiday.
(v) The employee may refuse the request (and instead have a Public HolidayHoliday off without loss of Base Rate of Pay) if the employee has reasonable grounds for doing so. Where the Employer requires In determining whether an Employee employee has reasonable grounds for refusing a request to work on a Public Holidaypublic holiday, they will provide one week’s notice regard must be had to the matters set out in Section 114 of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday fallsthe Act.
(dvi) Payment This Agreement expressly contemplates that the Employer will require work on public holidays and the parties acknowledge that the nature of the work performed by the employee, the type of employment of the employee (for all example, whether full-time, part-time, casual or shift work) and the nature of the Employer’s business, will require work on public holidays, from time worked to time.
(vii) An employee who is required to and does work on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday public holiday prescribed in this clause shall be paid at three times in lieu of all other shift allowances and weekend penalties as follows:
a) Full-time Employees and Part time employees: In addition to the relevant Employee’s Base Hourly RateRate of Pay of Pay, time and one half (150%) for all nominal hours worked. In additionAlternatively, if the Employee will receive payment for employee elects, in addition to the Public Holiday Base Rate of Pay of Pay, half-time extra (8 hours at 50%), plus the Employee’s Ordinary Hours Base Hourly Rate) time of in the Employee’s ordinary pay cycle.
(e) An Employee other than a shift worker who works lieu on a Public Holiday time-for-time basis. Such time shall be taken as mutually agreed between the employer and employee and in any case no more than 9 months after the accrual. Where the leave is not taken it shall be paid for at least four (4) hours at the applicable rateout.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

(cii) Employees may be If an employee is required to work on any part of a Public Holiday. Where public holiday the Employer requires an Employee payment shall be the portion of the employee’s relevant daily pay that relates to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment for all the time actually worked on a Public Holiday shall be at time and a the day plus half for the hours worked, except that amount again. Provided that any time worked after 8 in excess of three hours on a Public Holiday shall that day will be paid at three times double time in accordance with the relevant Employee’s Base Hourly Rateovertime payment set down in clause 8(b) in the case of waged employees. For holidays that fall outside their work period but on a day normally worked, they shall be paid on a pro-rata basis calculated in relation to the applicable ratenumber of weeks actually worked in the calendar year as a percentage of 52 for all public holidays.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

Public Holidays. (a) The Project recognises Public holidays shall be allowed to employees on full pay. (e) An Employee other than a shift worker Provided that an employee who works on a Public Holiday shall has accrued additional leave referred to in paragraph
(a) and (c) of this subclause can elect at any time to be paid an amount equivalent to the value of the accrued additional leave in lieu of taking additional leave, provided that the amount is a minimum of one week’s accrued additional leave and that the salary for at least four (4) hours at the applicable rateperiod of additional leave and that the salary for the period of additional leave paid out will be calculated as if the period was actually taken.
(fii) Where In addition to those public holidays prescribed in paragraph (b) of subclause (i) of this clause, employees are entitled to an extra public holiday each year. Such public holiday will occur on a Public Holiday occurs during day in the Christmas-New Year period as determined by the employer following consultation with the Employees and the Union, or other elected representative as nominated by the employee, or other suitable day as agreed between the employer and the Employees and the Union, or other elected representative as nominated by the employee. Such public holiday shall be regarded for all purposes of this clause as any other public holiday. The foregoing does not apply in areas where in each year -

(c) Employees may be such days. In addition, employees who are required to work on a Public Holidaythe above public holidays shall be entitled to an alternative holiday for working on these days.
17.2. Where the Employer requires an Employee employee is not required to work on one of the holidays referred to in 17.1, it being a Public Holidayday that would otherwise have been a working day for the employee, they will provide one week’s notice the employee shall be paid their relevant hourly/daily rate of such a requirementpay for that day.
17.3. Where an Employee does any of the holidays specified in 17.1 of this clause occur during the currency of the full time employees’ annual holiday, these employees shall have these public holidays paid and not wish to work taken from their annual holiday entitlement.
17.4. Where Christmas Day (25 December) and New Year Day (01 January) fall on a Public HolidaySaturday or Sunday the following shall apply:
(a) An employee who works on the Saturday or Sunday which would otherwise be a working day for the employee on which Christmas Day and/or New Year’s Day falls shall be paid double their relevant hourly rate (T2) for all hours worked, he or she must notify their Employer at least one (1) week before that Public Holiday fallsand will have entitlement to an alternative holiday for working on these days.
(db) Payment for all time worked An employee who works on the officially recognised Christmas Day and/or New Year day i.e. the transferable day, which would otherwise be a Public Holiday shall be at time and a half working day for the hours workedemployee, except that any time worked after 8 hours on a Public Holiday shall be paid at three times double their relevant hourly rate (T2) for all hours worked and will have entitlement to an alternative holiday for working on these days.
17.5. The parties agree that alternative days shall be taken within six months following the relevant Employeepublic holiday. An alternative day is to be taken by the employee on a day that is agreed between the Employer and employee.
17.6. If both parties cannot agree on when an alternative holiday is to be taken, then the day may be taken:
(a) on a date determined by the employee, taking into account the Employer’s Base Hourly Rate. In addition, the Employee will receive payment view as to when it is convenient for the Public Holiday (8 hours at employee to take the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleday.
(eb) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at within 12 months of the applicable rateemployee’s entitlement to the alternative holiday having arisen.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

42.3 Where an employee who is not a shift worker is required to and does work on all Public Holidays.a public holiday, the employee shall:
(a) choose to be paid and in such case the employee would receive their ordinary pay for the day plus payment for actual time worked at single time; or
(b) choose to take the equivalent time off and in such case the employee would receive their ordinary pay for the day and the equivalent time off for the actual time worked; or
(c) Employees may be subject to mutual agreement between the employee and the employer, aggregate the equivalent time off with annual leave entitlements.
42.4 Where an employee who is a shift worker and is required to and does work an ordinary rostered shift on a Public Holiday. Where public holiday, the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment for all time worked on a Public Holiday employee shall be at paid double time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cyclesuch shift.
(e) An Employee other than 42.5 Where an employee, who is a shift worker whose shift includes a gazetted public holiday, who works is then not required by the employer to work that gazetted public holiday, shall have a day added to their annual holidays, or be paid a days pay additional to their weekly wage.
42.6 In addition One (1) day of cultural/religious significance (e.g. National Aboriginal Day) to the employee may be deemed a public holiday by mutual agreement between the employer and employee. Thisis to be negotiated with the Coordinator in the first three (3) months of employment. Any additional cultural/religious days requested by the employee must be traded off against the centre's nominated public holidays listed under Clause 42.1.
42.7 For those workers employed for 28 hours or more per week, when a public holiday falls on their regular weekly day off or during annual leave, another day can be taken off at a time mutually agreed upon by the employee and the Centre Coordinator.
42.8 Part –Time employees regardless of their normal days of work will not be disadvantaged by where specified public holidays fall. Where specified public holidays fall on an employee’s usual day of work they are entitled to their usual rate of pay for that day. Where specified public holidays fall on a Public Holiday shall weekday that is not a usual day of work for that employee they are entitled to accrue overtime on a pro- rata hour for hour basis. This will be paid for at least four (4) hours at recorded as a time –in-lieu accrual and the applicable rateprovisions of Clause 14 apply.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

3.3.2 Any of these days may be moved to another day by agreement between the Employer and the majority of directly affected Employees. In those circumstances the agreed day becomes the Public Holiday and the former day becomes an ordinary working day.
3.3.3 The provisions of the FW Act will apply to Employees working on a public holiday.
3.3.4 If the Employee is working shift work, shifts may be rostered on public holidays. If an Employee works a shift on a public holiday in accordance with their roster, no additional payments apply as the remuneration provide under Clause 2.8 and/or the additional annual leave entitlement in Clause 3.1 comprehends such work.
3.3.5 If a new public holiday not listed in clause 3.3.1 is gazetted by the Queensland State Government in any year:
(a) The Project recognises the following gazetted Public Holidays:
(1) New Year’s Day
(2) Australia Day
(3) Good Friday
(4) Easter Saturday
(5) Easter Monday
(6) ANZAC Day
(7) May Day
(8) Queen’s Birthday
(9) Picnic Day

(13) or Employees working shift work who are rostered to work a day declared shift on that new public holiday will receive an additional payment at their Normal Annual Salary for that shift in lieu of any such day or days above other than Christmas Day and Boxing Day
(14) any additional day gazetted by the relevant Northern Territory Ministerto their normal pay for that shift.
(b) EmployeesEmployees working shift work who are not rostered to work a shift on that new public holiday (and who do not subsequently work on the day) will receive an additional payment at their Base Salary for the Employee’s normal shift length.
3.3.6 Under clause 3.3.5, other than casual Employees, are entitled a shift which commences on the new public holiday but finishes on another day will be considered a shift rostered on that new public holiday. A shift that finishes on the new public holiday but commenced on another day will not be considered a shift rostered on that new public holiday.
3.3.7 If the Employee is working a Monday to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s DayFriday day work roster, the Projects managing contractor may elect to keep the Site open for work on all Public Holidays.
Employer will, if practicable, give one (c1) Employees may be required months’ notice of any request to work on a Public Holidaypublic holiday. 3.3.8 Notwithstanding clause 3.3.4, an Employee’s roster cannot contain rostered shifts on Christmas Day and Boxing Day (from Night Shift commencing on the evening of 24 December until the commencement of Night Shift on 26 December). However the Employer requires can seek Employees to volunteer to work shifts during this period.
3.3.9 If an Employee to work works on a Public HolidayChristmas and/ or Boxing Day, they will receive payment at the rate of 300% of their Normal Annual Salary rate for all hours worked in addition to the Employee’s normal pay.
3.3.10 Employees who have undertaken and provide one week’s notice evidence of such a requirement. Where an Employee does not wish recognised active service in the Australian Defence Forces shall be permitted to work on a Public Holiday, he or she must notify their Employer at least access one (1) week before that Public Holiday falls.

(a) If you are not rostered to work on the public holiday, you will be paid your Base Hourly Rate multiplied by the ordinary hours per shift under your roster;
(b) EmployeesIf you are rostered to work on the public holiday, other than casual Employees, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where you will be paid your Base Hourly Rate multiplied by the project employs a large number of Nonrostered hours of the shift.

d) The alternative day will be paid at the amount the employee would ordinarily have earned on the day taken. Alternative days are to be taken within twelve months of accrual at a time mutually agreed between the employer and employee. Where the employee has not taken the alternative day after 12 months, the employer and employee may agree to replace the holiday with a payment.
e) Should any of the holidays specified in sub-clause (b) of this clause occur on an employee’s normal work day during the currency of the employee’s annual holiday, then such annual holiday may be extended by one day for every such holiday and the employee shall be paid for at least four (4) hours at the applicable rateevery such day.
(f) Where an employee is rostered to work on a Public Holiday occurs during public holiday and willfully defaults, the employee shall not be entitled to any payment.
g) If a period public holiday falls on the rostered day off of R&R leavea full-time employee or an employee who works 5 normal days per week, Employees they shall receive payment be paid an ordinary day’s pay.

j) Where a part-time employee’s days are not fixed ie: rotating rostered duties, the employee shall be entitled to public holiday provisions if they have worked on the day of the week that the public holiday falls on more than 40% of the time over the last three months. 8.04 Full time employees shall have no proration of Ordinary Hours’ holiday pay. 17.2. Where the Employer requires an Employee employee is not required to work on one of the holidays referred to in 17.1, it being a Public Holidayday that would otherwise have been a working day for the employee, they will provide one week’s notice the employee shall be paid their relevant hourly/daily rate of such a requirementpay for that day.
17.3. Where an Employee does any of the holidays specified in 17.1 of this clause occur during the currency of the full time employees’ annual holiday, these employees shall have these public holidays paid and not wish to work taken from their annual holiday entitlement.
17.4. Where Christmas Day (25 December) and New Year Day (01 January) fall on a Public HolidaySaturday or Sunday the following shall apply:
(a) An employee who works on the Saturday or Sunday which would otherwise be a working day for the employee on which Christmas Day and/or New Year’s Day falls shall be paid double their relevant hourly rate (T2) for all hours worked, he or she must notify their Employer at least one (1) week before that Public Holiday fallsand will have entitlement to an alternative holiday for working on these days.
(db) Payment for all time worked An employee who works on the officially recognised Christmas Day and/or New Year day i.e. the transferable day, which would otherwise be a Public Holiday shall be at time and a half working day for the hours workedemployee, except that any time worked after 8 hours on a Public Holiday shall be paid at three times double their relevant hourly rate (T2) for all hours worked and will have entitlement to an alternative holiday for working on these days.
17.5. The parties agree that alternative days shall be taken within six months following the relevant Employeepublic holiday. An alternative day is to be taken by the employee on a day that is agreed between the Employer and employee.
17.6. If both parties cannot agree on when an alternative holiday is to be taken, then the day may be taken:
(a) on a date determined by the employee, taking into account the Employer’s Base Hourly Rate. In addition, the Employee will receive payment view as to when it is convenient for the Public Holiday (8 hours at employee to take the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleday.
(eb) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at within 12 months of the applicable rateemployee’s entitlement to the alternative holiday having arisen.

Public Holidays. (a) The Project recognises the following gazetted Public Holidays:

(6) ANZAC DayIf a Public Holiday falls on a day that a Caregiver is not rostered to work then no additional payment or day in lieu will be provided.
(7) May DayWhere a Caregiver is not required to work on a public holiday or a day observed in lieu thereof and as a result works fewer than his/her contracted hours in that fortnight the deficit will be deducted from the Caregiver’s public holiday leave entitlements and paid to the Caregiver. Provided that where a Caregiver has insufficient accrued public holiday leave entitlements to cover the deficit then either:
(a) a deduction will be made from another form of paid leave (other than annual leave); or
(b) if the Caregiver has insufficient accrued paid leave (other than annual leave), the Caregiver will be deemed to be on leave without pay.
(8) QueenThe Employer recognises Caregivers’ entitlement to be absent on a public holiday as per s.114 of the Act, and entitlements for payment for absence on a public holiday as per s.116 of the Act; and will ensure that no Caregiver’s Birthdayminimum entitlements to public holidays under the NES will be reduced through the operation of this clause.
(9) Picnic DayAt any time public holiday leave may be:
(a) cashed out; or
(b) taken as leave, whether or not in conjunction with other leave types
(10) Darwin Show dayAccrued public holiday leave will be paid out on termination.
(11) Christmas DayA Caregiver employed regularly as a store person, gardener, driver or maintenance person:

42.2 The employer shall pay the employee’s relevant daily pay (cor average daily pay where appropriate) Employees may for the above holidays to all permanent employees performing work coming within the scope of this agreement who have been employed by the employer at any time during the fortnight ending on the day on which the holiday occurs. Except that where a permanent employee is employed part-time, they shall not be paid for any such holidays, which fall on a day of the week on which they would not otherwise work.
42.3 A part year early childhood teacher whose ordinary hours of work fall on a public holiday shall be paid for the number of hours usually worked on that day. For holidays that fall outside their work period but on a day normally worked during their work period, they shall be paid on a pro-rata basis calculated in relation to the number of weeks actually worked, or to be worked, in the relevant calendar year as a percentage of 52 for statutory holidays falling outside their work period on a day that they otherwise would normally have worked.
42.4 The provisions of the Holidays Act 2003 shall apply where an employee is required to work on a Public Holidayany part of public holiday. Where the Employer requires an Employee to work employee works on a Public Holidaypublic holiday, they whether or not that day would otherwise be a working day for the employee, s/he will provide one week’s notice be paid the portion of such a requirement. (e) An Employee other than a shift worker who works on a Public Holiday 42.5 Any alternative holiday to which the employee becomes entitled shall be paid for taken at least four (4) hours at a time agreed between the applicable rateparties. If the parties cannot reach agreement as to when an alternative holiday is to be taken the employer may give the employee 14 days’ written notice of the requirement to take the alternative holiday.

You are generally not required to work on all Public Holidays.these days. If, for some reason, however, work is done on a Recognised Holiday:
(ca) If the Recognised Holiday falls on a day that is part of your otherwise normal rostered hours, you will, in addition to your Annualised Salary, be paid for the hours worked at your Irregular Overtime Rate;
(b) If the Recognised Holiday falls on a day that is not part of your otherwise normal rostered hours, that work is a special form of Irregular Overtime, and you will be paid at the rate of $140 per hour for all hours worked on the Recognised Holiday. The above amounts are both the minimum and maximum that you will receive for hours worked on Recognised Holidays. They apply instead of and in total substitution of all other payments and entitlements however arising. All other public holidays are treated as normal working days and payment for working these days, when rostered, or missing them when not rostered, is built into your Annualised Salary. 14.02 An employee is allowed 8 hours* at straight time pay for the day upon which a Public Holiday is observed, regardless of whether or not such a day is a scheduled working day. An employee scheduled to work on any observed Public Holiday shall have the option of receiving 8 hours* at straight time pay as provided above or shall be allowed one day in lieu at straight time pay. Employees working on a rotating schedule (1as per Article 12.01(a)(ii) are entitled to twelve (12) hours for the following public holidays: New Year’s Day

Where the project employs a large number of Non-Local Employees, with the exception of Christmas Day, Boxing Day and New Year’s Day, the Projects managing contractor may elect to keep the Site open 14.03 Employees will be paid double their hourly rate for work on all Public Holidays.
(c) Employees may be required to work scheduled hours worked on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle.
(e) An Employee other than a shift worker who works on a Public Holiday shall be paid for at least four (4) hours at the applicable rate.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.

(13) or a Section 18.04 By agreement between an employee and the employer an alternative day declared may be taken as the Public Holiday in lieu of any such day or of the days above other than Christmas listed in section 18.01. All ordinary time worked on the actual Public Holiday, if substituted, will be paid at ordinary time rates. All time worked on the substituted Public Holiday will be paid at double time and a half.
Section 18.05 Section 18.04 does not apply to Good Friday, Anzac Day and Boxing Christmas Day.
(14) Section 18.06 Permanent employees wanting to celebrate any additional Public Holiday on the designated day gazetted will need to apply for leave without pay, annual leave or rostered day off if it has been agreed to substitute the Public Holiday as in section 18.04.

e. If CPA requests an employee to work on a Public Holiday. Where public holiday, the Employer requires an Employee employee may refuse the request if they have reasonable grounds, as defined by the NES.
f. The allowances applicable to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Holidays are set out in clause 8.4 Public Holiday fallsPenalties.

16.2 Subject to the provisions of the Holidays Act in respect of the Christmas and New Year’s 's public holidays and Waitangi and ANZAC Day, the Projects managing contractor may elect public holidays listed in clause 16.1 shall be observed on the days upon which they actually fall. The Company does not agree to keep workers transferring the Site open for work on all Public Holidayspublic holidays to another day of their choosing.
(c) Employees 16.3 Pursuant to section 12 of the Xxxxxxxx Xxx 0000 a public holiday will be deemed to be a day that would otherwise be a working day for the worker if the worker has worked that particular day of the week for at least 7 out of the previous 13 weeks immediately prior to the holiday in question. If a Worker believes that they are an exception to the 7/13 rule they should raise this in writing with their manager as soon as practicable
16.4 The Employer may be required require a worker to work on a Public Holiday. Where public holiday pursuant to the Employer requires an Employee to work roster on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment for all time worked on a Public Holiday shall be at time and a half in accordance with the Holidays Xxx 0000. Where the public holiday is deemed to be a day that would otherwise be a working day, the worker will be entitled to a holiday on pay on another day that that worker would be otherwise be rostered to work, as an alternative holiday. Alternative holidays are to be taken in accordance with the annual leave provisions of the Agreement.
16.5 No payment or alternative holiday shall accrue to a worker if a public holiday is not deemed to be an otherwise working day for the hours workedworker and coincides with a rostered day off. Where a public holiday is deemed to be a normal working day for the worker, except that any time worked after 8 hours on and coincides with a Public Holiday shall rostered day off, the worker will be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment their ordinary rate of pay for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleday.
(e) An Employee other than 16.6 Easter Sunday is not a shift worker who works on a Public Holiday shall be paid for statutory holiday. However, in accordance with the Shop Trading Hours Xxx 0000:
16.6.1 The Employer will give at least four (4) hours at the applicable rateweeks and no more than eight weeks’ notice if a worker is expected to work on Easter Sunday each year.
(f) Where a Public Holiday occurs during a period of R&R leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate16.6.2 The notice must advise workers that they are entitled to decline to work on Easter Sunday.

The date of the extra public holiday shall be nominated by the employer before 1 July each year. This extra public holiday shall apply in substitution for any local public holidays proclaimed eg Race Day/Show Day and in substitution for any Bank holiday proclaimed in New South Wales. This subclause shall take effect from 1 January 2005.
19.3 Employees wishing to be absent from duties on Race or Show day may elect arrange for annual leave or leave without pay to keep the Site open for be taken subject to agreement being reached with his/her manager.
19.4 Public holidays shall be allowed to employees without loss of ordinary pay.
19.5 An employee who is required to and does work on any public holiday prescribed in this clause, shall be paid in lieu of all Public Holidays.other shift allowances, weekend penalty rates, casual loading and part-time loading, as follows:
19.5.1 Full-time employees:
(ca) Employees may be required to work on a Public Holiday. Where the Employer requires an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that Public Holiday falls.
(d) Payment half time extra for all time worked plus one day’s pay in addition to the weekly rate;
(b) alternatively, if the employee so elects – one half time extra for all time worked in addition to the weekly rate and have one ordinary working day added to the period of annual leave.
19.5.2 Permanent part-time employees who are contracted to work 30 or more hours per week on a Public Holiday shall be at regular basis and who are regularly rostered on a particular day and a public holiday happens to fall on such day:
(a) time and a one-half extra for the hours all time worked, except that any in addition to the weekly rate;
(b) alternatively, if the employee so elects – one half extra for all time worked after 8 and the equivalent number of hours worked added to annual leave;
19.5.3 Permanent part-time employees who are contracted to work less than 30 hours per week on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycle.regular basis and who are regularly rostered on a particular day and a public holiday happens to fall on such day:
(ea) An Employee other than a shift worker who works on a Public Holiday shall be paid time and one-half extra for at least four (4) hours at all time worked, in addition to the applicable weekly rate.;
(fb) Where a Public Holiday occurs during a period alternatively, if the employee so elects – one half extra for all time worked and the equivalent number of R&R hours worked added to annual leave, Employees shall receive payment for eight (8) Ordinary Hours at the relevant Employee’s Base Hourly Rate.;

However, a request to take such a holiday on Remembrance Day will be granted. These days may be taken in half days. For employees working other than casual Employeesan eight (8) hour day, are entitled to observe these days as holidays without deduction of Ordinary Hours’ pay. Where the project employs a large number of Non-Local Employeeshours scheduled for the day on which the absence occurs shall be considered one (1) day for the purpose of this clause. For those employees working a compressed work week the number of hours deducted when using an additional day shall be the number of hours scheduled to be worked. One of the above additional days will be designated by the Employer by December 1st of the previous year. This designated day will be immediately before or after a Public Holiday unless otherwise determined subsequent to consultation at the Labour/Management Committee. Should this day not be designated by the Employer the day may be taken subject to the convenience of the Department and applies only to employees who have completed three (3) months of continuous service. The benefit of the second and third additional days must be taken within the calendar year it is granted, with applies only to employees who have completed three (3) months' continuous employment service, and is taken at the exception request of the employee and subject to the convenience of the department.
19.02 When Christmas, New Year's Day or July 1st falls on a Saturday or Sunday, the following Monday shall be observed as the Public Holiday. When Christmas Dayfalls on a Saturday or Sunday, the following Tuesday shall be observed as the Boxing Day and New Year’s DayPublic Holiday. When Christmas falls on a Friday, the Projects managing contractor may elect following Monday shall be observed as the Boxing Day Public Holiday.
19.03 When a Public Holiday occurs during a vacation period, that day shall be charged to keep the Site open for work on all "Public HolidaysHoliday" and not to employee's vacation time.
(ca) Employees may be required A shift employee scheduled to work on any observed Public Holiday shall be allowed one day in lieu for the Public Holiday except when permitted to take the day off as a Public Holiday. Where the Employer requires When a shift employee's scheduled day off falls on an Employee to work on a Public Holiday, they will provide one week’s notice of such a requirement. Where an Employee does not wish to work on a Public Holiday, he or she must notify their Employer at least one (1) week before that observed Public Holiday fallsthe employee shall receive one day in lieu. A shift employee shall be allowed to accumulate lieu days for a period of twelve (12) months from date earned.
(db) Payment for all time worked on a Public Holiday shall be at time and a half for the hours worked, except that any time worked after 8 hours on a Public Holiday shall be paid at three times the relevant Employee’s Base Hourly Rate. In addition, the Employee will receive payment for the Public Holiday (8 hours at the Employee’s Ordinary Hours Base Hourly Rate) Afternoon shift employees in the Employee’s ordinary pay cycle.

19.06 Employee is not allowed pay for Public Holiday when absent without pay on either the work day before or the work day after the Public Holiday except in cases of employee granted leave for Union business.

(g) Days where IKEA is prohibited from trading, and the day has not been declared a public holiday, will be rostered as a non-working day and additional hours will be rostered on other days during the fortnightly cycle for all permanent co-workers. A co-worker who regularly works on a period day IKEA is prohibited from trading may request to their direct manager to:
(i) Take annual leave instead of R&R leave, Employees shall receive payment for eight having the day rostered as a non-working day; or
(8) Ordinary Hours at ii) Work additional hours rostered on other days during the relevant Employee’s Base Hourly Ratefortnightly cycle.

"Holiday" for employees on night shift means the day on which the majority of ordinary hours of the shift are worked. An employee who without reasonable cause is absent without leave on the working day immediately preceding or the working day immediately following a holiday will not be entitled to payment for such holiday. Subject to this clause, the employee will be credited with a total of 83.6 hours payment at ordinary time for holidays in each calendar year, or on a pro-rata basis for part of a calendar year, equivalent to 7.6 hours payment at ordinary time in respect of 11 holidays ("total annual entitlement"). The treatment of holidays will be as follows: If a holiday falls when an employee is rostered on duty and the employee not be required to work, then the employee will have that day off without loss of ordinary pay, and 12 hours will be deducted from their total annual entitlement in respect of the day off. If a holiday falls when an employee is rostered off duty, then the employee will have no deduction from their total annual entitlement in respect thereof, and where the employee has sufficient total annual entitlement, the employee may elect to keep take time off of one 12 hour day at a time mutually agreed with MSDA within 6 months of the Site open for work on all Public Holidays.
(c) Employees may holiday occurring, in which case 12 hours will then be required deducted from the total annual entitlement. MSDA will make reasonable efforts to work on a Public Holiday. Where manage the Employer requires an Employee to work on a Public Holiday, they will provide one weekarrangements in this clause such that the number of hours deducted from the employee’s notice of total annual entitlement under such a requirement. 17.2. Where the Employer requires an Employee employee is not required to work on one of the holidays referred to in 17.1, it being a Public Holidayday that would otherwise have been a working day for the employee, the employee shall be paid their relevant hourly/daliy rate of pay for that day. In the case of part time employees who do not work a regular pattern or fixed shifts they will provide one week’s notice must have worked on that day fifty percent or more of such a requirementthe time in the last six weeks for the day to be considered an otherwise working day.
17.3. Where an Employee does any of the holidays specified in 17.1 of this clause occur during the currency of the full time employees’ annual holiday, these employees shall have these public holidays paid and not wish to work taken from their annual holiday entitlement.
17.4. Where Christmas Day (25 December) and New Year Day (01 January) fall on a Public HolidaySaturday or Sunday the following shall apply:
(a) An employee who works on the Saturday or Sunday which would otherwise be a working day for the employee on which Christmas Day and/or New Year’s Day falls shall be paid double their relevant hourly rate (T2) for all hours worked, he or she must notify their Employer at least one (1) week before that Public Holiday fallsand will have entitlement to an alternative holiday for working on these days.
(db) Payment for all time worked An employee who works on the officially recognised Christmas Day and/or New Year day i.e. the transferable day, which would otherwise be a Public Holiday shall be at time and a half working day for the hours workedemployee, except that any time worked after 8 hours on a Public Holiday shall be paid at three times double their relevant hourly rate (T2) for all hours worked and will have entitlement to an alternative holiday for working on these days.
17.5. The parties agree that alternative days shall be taken within six months following the relevant Employeepublic holiday. An alternative day is to be taken by the employee on a day that is agreed between the Employer and employee.
17.6. If both parties cannot agree on when an alternative holiday is to be taken, then the day may be taken:
(a) on a date determined by the employee, taking into account the Employer’s Base Hourly Rate. In addition, the Employee will receive payment view as to when it is convenient for the Public Holiday (8 hours at employee to take the Employee’s Ordinary Hours Base Hourly Rate) in the Employee’s ordinary pay cycleday.

Public Holidays. 38.1. The Company will observe Easter Saturday and the public holidays and part-day public holidays provided for by the NES. Where you live and work in a different State, Territory or locality, you will be entitled to the public holidays and part-day public holidays in the State, Territory or locality where you usually work.
38.2. Public holiday conditions will apply on these days or part-days. If you work in South Australia, you will not be entitled to public holiday conditions on Sundays unless the Sunday is one of the public holidays noted above.
38.3. If you work (not live) in a place in which a public holiday or part day public holiday has been declared or prescribed, you can have the day or part-day off and be paid; or, if you are required to work, you will receive the prescribed penalty or overtime rates where you are eligible.
38.4. You will usually be entitled to a paid day or part-day off on days or part days declared as public holidays. However, we may ask you to work so long as the request is reasonable. You can refuse to work if our request is not reasonable or if you have reasonable grounds to refuse to work. Some of the things that we will take into account when considering what’s reasonable will include:
a) The Project recognises what work you do;
b) the Company’s business requirements;
c) your personal circumstances, including any family or carer responsibilities; and
d) how much notice the Company gives you.
38.5. Public holidays for employees on particular hours arrangements
a) If you work full-time under one of the following gazetted Public Holidaysarrangements:
