Payment for Work Done on Public Holidays. (a) All work done by an employee during their ordinary shifts on a public holiday, including a substituted day, will be paid at 250% of their ordinary rate of pay. Alternatively, if the employee elects, the employee will be paid half-time extra (50%) for all time worked in addition to the weekly rate and have one ordinary working day added to the period of annual leave. This additional annual leave shall not attract the annual leave loading prescribed at Clause 40.6.
(b) The election in Clause 42.2(a) will be made on the commencement of employment and then on the anniversary date each year. The employee may not alter such election during the year except with the agreement of the employer.
(c) Payments and entitlement under this clause are instead of any additional rate for shift or weekend work which would otherwise be payable had the shift not been a public holiday.
(d) For the purposes of this Agreement, the following shall be deemed to be public holidays:

Payment for Work Done on Public Holidays. (a) All work done by an employee during their ordinary shifts on a public holiday, including a substituted day, will be paid at total rate of 250%.
(b) Christmas Day (25 December) will be paid at a total rate of 250%, regardless of the day on which it falls, if worked. Any substitute day declared for Christmas Day will also be paid at a total rate of 250%, if worked.
(c) Payment under this clause is instead of any additional penalty for shift or weekend work, or casual loading otherwise payable under this Agreement.

(ii) Australia Day;
(iii) Good Friday;
(iv) Easter Saturday;
(v) Easter Sunday;
(vi) Easter Monday;
(vii) Anzac Day;
(viii) Queen's Birthday;
(ix) Labour Day;
(x) Christmas Day;
(xi) Boxing Day
(xii) Any other day, or part-day, declared or prescribed by or under a law of a State or Territory to be observed generally with the State or Territory, or a region of the State or Territory, as a public holiday. If, under (or in accordance with a procedure under) a law of a State or Territory, a day or part-day is substituted for a day or part-day that would otherwise be a public holiday because of subclause 33.1(d), then the substituted day or part-day is the public holiday.
Payment for Work Done on Public Holidays. Payment for Work Done on Public Holidays. All work done by an permanent employee during their ordinary shifts on a public holiday, including a substituted day, will be paid at double time of their base rate of pay. Casuals will be paid in accordance with clause 10.4(d).
Payment for Work Done on Public Holidays. An Employee who is required to and does work on any public holiday prescribed in this clause shall be paid the following loading, calculated on the Employee’s base rate of pay for the actual time worked, in lieu of all other shift penalties and weekend penalties as follows:
Payment for Work Done on Public Holidays. (a) An Employee shall be entitled to paid time off or penalty payments for time worked in respect of public holidays in accordance with this clause.
(b) Subject to (c), the public holidays to which this clause applies are the days determined under Victorian law as public holidays in respect of the following occasions:
(i) New Year's Day, Australia Day, Christmas Day and Boxing bay; and
(ii) Good Friday, the Saturday immediately before Easter Sunday, Easter Monday, Anzac Day, Queen's Birthday and Labour Day; and
(iii) Cup Day, or in lieu of Melbourne Cup Day, some other day as determined under Victorian law for a particular locality;
(iv) any additional public holiday declared or prescribed in Victoria or a locality in respect of occasions other than those set out in (b)(i).
(v) If a day or days are not determined in respect of any of the occasions (b)(i), (ii) or (iii) under Victorian law in any year, the public holiday for that occasion will be the day or date upon which the public holiday was observed in the previous year.
(c) Applicability of penalty payments for some public holidays falling on a weekend
(i) When Christmas Day, Australia Day, Boxing Day, or New Year's Day (Actual Day) is a Saturday or a Sunday, and a substitute or additional holiday is determined under Victorian law on another day in respect of any of those occasions (Other Day):
A. Weekend Workers and casual Employees shall receive penalty payments pursuant to clause (e) for time worked on the Actual Day or on the Other Day if the employee does not work ordinary hours on the Actual Day; and
B. all other Employees will receive penalty payments pursuant to clause (e) for time worked on the Other Day.
(d) Substitution of one public holiday for another
(i) An Employer, with the agreement of employees, may substitute another day for any prescribed in this clause other than Christmas Day, Boxing Day, New Year's Day and Australia Day;
A. An Employer and its Employees may agree to substitute another day for any prescribed in this clause (other than Christmas Day, Boxing Day, New Year's Day and Australia Day). For this purpose, the consent of the majority of affected Employees s all constitute agreement.
B. An agreement pursuant to paragraph (A) shall be recorded in writing and be available to every affected Employee.
(e) Penalty Payments in respect of public holidays
(i) An Employee, other than a casual, who performs work (including overtime work) on a public holiday (or where Christmas Day, B...
Payment for Work Done on Public Holidays. (a) Full-time and Part-time employees All work done by an employee during their ordinary shifts on a public holiday, including a substituted day, will be paid at double time and a half of their ordinary rate of pay.
(b) Client linked employees Where regular hours are worked with a client it is required that the worker will work those hours on a Public Holiday if required. These hours worked will be paid at the rate applying to part-time employees. If the organization does not require hours (or part thereof) to be worked the worker will receive Public Holiday at 100% of ordinary hours rate for the regular hours not worked. Regular hours are accepted as any hours where a pattern of work can be demonstrated, e.g.
i) Work every Monday with two clients @ 2 hours each.
ii) Start a new contract one week before the public holiday which requires the worker to work on the Monday from this time forward. OR A pattern of work is not demonstrated if:
iii) A new contract begins the day after a public holiday which requires the worker to work on the Monday from this time forward.
iv) Worked the Monday previous to a public holiday to backfill a position but would not be backfilling that position on the Monday of the Public Holiday and would not be working on the following Monday as part of a weekly pattern of backfilling a particular position.
v) A regular contract is interrupted by an occasion clearly not associated with the occurrence of a Public Holiday, e.g. • Client is in hospital; • Client is away on a pre-arranged holiday for a period greater than the long weekend.
