Public Parking. Operator and the Operators shall use those portions of the fifth floor of the Consolidated Rental Car Facility (within the Common Use Area) identified for public parking solely for public parking in connection with the completion of rental car transactions by rental car customers not arriving at the Consolidated Rental Car Facility by the Common Transportation System (e.g. local renters). The Operators, through the Facility Manager, shall specifically police the public parking areas to ensure that the area is used solely for such purposes. There shall be no charge for public parking unless the Port and a Majority-in-Interest agree on such charge.

Public Parking. The Developer will schedule a meeting with Parks and Recreation, MRA and the Parking Commission to brief Parks and Recreation on the plan for public parking on the site.
Public Parking. Any private parking on the Developer Property may be open to the public, but shall not provide rates lower than those established by the City. Further, as long as the City provides free parking on Sundays, all private parking open to the public on the Developer Property shall be free to the public on Sundays as well.
Public Parking. 3.1 The Owner shall: (a) ensure that during the Public Parking Times there are 15 motor vehicle parking spaces available for public use within the building on the Lands and without limiting the generality of the foregoing ensure that no gate or similar obstruction prevents access to the Public Parking Spaces by members of the public who are not in possession of a key or code to open such gate; (b) post legible English language signage at the vehicular entrance to the Public Parking Spaces; i. indicating the availability of free public parking spaces during the Public Parking Times, subject to any parking time limit that has been prescribed by the District and communicated to the Owner in writing under this Agreement; ii. indicating that access to the spaces is closed at 11:00 p.m.; and iii. identifying a telephone number that can be used after that time to contact a person with authority to open any gate or other obstruction to enable a member of the public to remove their vehicle, if access to the Public Parking Spaces is obstructed by a gate or other obstruction after 11:00 p.m.; (c) keep the Public Parking Spaces clear of all obstructions during the Public Parking Times including obstructions that limit the vertical dimension of the space, and without limiting the generality of the foregoing not store or place on any Public Parking Space any container for garbage or recycled material; (d) ensure that pedestrian access from Bellevue Avenue to the Public Parking Spaces is available through a separate entrance of the Owner’s building during the Public Parking Times; (e) impose no fee or charge of any kind for the use of the Public Parking Spaces by members of the public in accordance with this Agreement, and permit no other person to impose such a fee or charge, but nothing in this section prohibits the imposition of a fee or charge for removing from a Public Parking Space a motor vehicle that has been left in the space after 11:00 p.m. (f) maintain the Public Parking Spaces to at least the same standard as all other parking spaces in the building on the Lands, including the maintenance of parking space surfacing and markings; (g) take reasonable steps to ensure that the parking of vehicles in parking spaces on the Lands that are not Public Parking Spaces does not interfere with the use of the Public Parking Spaces for parking passenger vehicles; (h) take reasonable steps to ensure that tenants and occupiers of the Lands and their invitees do not park moto...

Public Parking. During the Covenant Period, Developer on behalf of itself and its successors, assigns, and each successor in interest to Developer’s interest in the Property or any part thereof, hereby covenants and agrees that at least the minimum number of parking spaces required by the City of San Diego as of the Effective Date shall be provided to tenants and/or guests of the Project in the Project’s parking garage, including parking available to the public.
Public Parking. The Public Parking Facilities shall be operated in such a manner as to provide adequate public parking for the various uses located on the Corridor Site. Except for special arrangements for residential parking or for qualified governmental users granted under this Agreement, the Parking Covenants and Parking Management Plan, parking will be provided to users of the Corridor Site and members of the general public (monthly, hourly, or otherwise) on a first come first served basis.
Public Parking. During the Initial Period and any applicable Renewal Periods and subject to the terms and conditions of this Agreement, Licensor will make forty-eight (48) parking spaces located on Ramp 1 and Ramp 2 in the Parking Garage (collectively, the “Public Parking Spaces” and each a “Public Parking Space”) available solely for the use of the parking of Permitted Motor Vehicles by the general public, including, without limitation, customers of retail tenants at Licensor’s mixed-use project (hereinafter, collectively referred to as the “General Public”), on a first-come, first-served basis, at such hourly rates as determined by Licensor, in Licensor’s sole discretion, from time-to-time, the initial hourly rates being set forth on Exhibit C attached hereto and incorporated herein by reference (as the same may change from time-to-time, the “Rates”). The Public Parking Spaces will be accessible to the General Public on a ticketed basis pursuant to the Ticketing Gate and all fees collected in connection with the Public Parking Spaces will be the property of and for the sole benefit of Licensor. Licensee shall have no right to any fees collected in connection with the Public Parking Spaces. Licensee, at Licensee’s sole cost and expense, will be responsible for monitoring and enforcing the rules and restrictions applicable to the Parking Spaces. The term “Parking Spaces” shall mean collectively the Public Parking Spaces and the Reserved Parking Spaces.
