RENTAL OF THE VEHICLE. The Lessor rents the Vehicle to the Renter, who hires the Vehicle for the duration of the Rental Period, subject to the terms and conditions contained in the Rental Agreement.

RENTAL OF THE VEHICLE handover of the Vehicle, return of the Vehicle 1.1 The rental of the Vehicle shall be established on the basis of the RA entered into by and between the Lessor and the Renter. The RA shall be entered into for a fixed period of time, and shall become valid and effective at the moment of its signing by both Parties. 1.2 The RA shall be terminated: o upon expiry of the agreed rental period; or o by a written agreement signed by both the Lessor and the Renter; or o by a written termination notice by the Lessor due to the withdrawal of the Vehicle from service for car rental purposes or due to a material breach of the RA by the Renter, without a notice period, where a material breach of the RA is deemed to include but not be limited to the Renter’s delay with payment of the agreed rent or use of the Vehicle in violation of the law, the terms of the RA and these GTC; or o by a written termination notice by the Renter for the reason and under the conditions set out in Section 7.4 of the GTC. If the Renter materially breaches the Renter’s obligations under the RA and the GTC, including but not limited to cases where the Renter uses the Vehicle in violation of the RA and/or the GTC, or in a manner that causes damage to the Lessor, or if there is a risk of significant damage to the Vehicle, the Lessor shall be entitled to withdraw from the RA immediately. The Lessor shall also be entitled to withdraw from the RA if the Renter fails to pay the invoiced amounts properly and in time despite the Lessor’s reminders. The Lessor shall be entitled to withdraw the Vehicle from service for car rental purposes due to the end of financing of the Vehicle. In such case, the RA shall be terminated by a termination notice without a notice period by the Lessor, and the Renter shall be obliged to promptly return the Vehicle upon the Lessor’s request. In such case, should the Renter wish so, the Lessor undertakes to enter into a new RA with the Renter for the same or similar type of vehicle under similar terms and conditions of the original RA. 1.3 The termination notice shall take effect upon its delivery to the other Party. 1.4 The RA may only be extended in writing upon the Renter’s request delivered to the Lessor no later than 2 days before the expiry of the agreed rental period. The rental shall be extended under the same terms and conditions as agreed in the RA, always upon payment of the agreed amount of rent for the next (extended) period. The renter will be bound by these terms and conditions, whether he was driving or not. 2.2 The company in the event of an additional driver, also holds this person equally responsible to any of the above terms and conditions of the contract and therefore they sign the contract with the renter as proof of undertaking. Such a person will have no charge for additional fees, but should have a valid driving license in regards to the contract. 2.3 All fines and penalties incurred in the duration of the hire are strictly for the liability of the driver. This includes valets for cars that are returned in conditions not acceptable as normal. We request that notice is taken that no pets is allowed in any rental vehicle. No smoking in any vehicle is permitted.

RENTAL OF THE VEHICLE. 2.1. The parties agree that the Company rents the Vehicle to the Customer, who in turn hires the Vehicle, subject to the terms set out in this Rental Agreement, with the Customer being bound thereto whether he was the Driver of the Vehicle or not. 2.2. The Company reserves the right to terminate the Rental Agreement for any reason whatsoever, including but not limited to, the Vehicle being illegally parked, abandoned or being used to violate any traffic and road laws. The Company furthermore reserves the right to repossess Vehicle at any time if it is established that the Customer has made a misrepresentation to the Company in connection with, or relating to, the conclusion of this Rental Agreement. 2.3. Any cross-border travel with the Vehicle outside of the Republic of South Africa (excluding travel to Zimbabwe, Malawi or Angola, which is expressly forbidden) is to be requested three (3) days prior to the time of booking and is subject to the Company’s prior written agreement where additional fees will apply. It is recorded that any agreement for cross-border travel is subject to the following further conditions:- 2.3.1. permission to travel in approved countries are subject to the road-type being suitable for the Vehicle type rented; the Customer shall be liable for any and all damages or loss and/or costs of recovery of the Vehicle, should the Vehicle be deemed to have been used on an unsuitable road;

No refunds will be made on vehicles returned with more petrol than started in rental application. If ‘CA Car Hire’ has to collect the vehicle from client there will be a charge depending on area. The vehicle will be returned no later than 12:00pm (twelve noon) on the return date, any vehicle returned later will be charge at R150 per hour and an once off admin fee of R650. The vehicle will be returned clean as received by lessee or a penalty of R195 will be charged in extreme cases where vehicle needs a valet R880 will be charged. The vehicle shall be returned to ‘CA Car Hire’ in the same condition as received, for wear and tear excepted and at the location specified in the ‘rental application’. ‘CA Car Hire’ shall at its sole discretion, on the expiry of this contract be entitled to take possession of the vehicle at any location or from whom so ever may be in possession. (Any costs incurred by the ‘CA Car Hire’ to retrieve the vehicle will be for the account of the lessee).
