Review and Comment on Developer or DB Contractor Submittals. The ENGINEER shall assess the number of submittals by Developer or DB Contractor that are subject to review and comment or approval by ENGINEER or STATE and advise STATE whenever the number of submittals exceeds the decision factor thresholds stated in the CDA, FCA or DBA, with a recommendation to STATE on the period of extension of time that should be applied. The ENGINEER shall report to STATE and Developer or DB Contractor the extension of time period within which STATE and the ENGINEER are required to act, following a relief event as defined in the CDA, FCA or DBA. The ENGINEER shall receive responses by Developer or DB Contractor to STATE and the ENGINEER’s comments or objections with respect to a Developer’s or DB Contractor’s Submittal and shall provide to STATE and Developer or DB Contractor within thirty (30) days of receipt of a response by Developer or DB Contractor, a determination as to whether the response or amended submittal is acceptable and recommend further action as appropriate. Where Developer or DB Contractor does not provide a notification or respond to a comment by STATE or the ENGINEER within the specified time, the ENGINEER will prepare a written notice on behalf of STATE as required by the CDA, FCA or DBA. The ENGINEER shall review and comment on all Submittals for which STATE review and comment or approval is required under the CDA, FCA or DBA, unless expressly provided otherwise in Table 2 below, or unless waived in writing by the STATE and Developer or DB Contractor for a specific submittal or type of submittal. The ENGINEER shall implement an electronic document control system and a review and comment logging system that enables tracking of every submittal by Developer or DB Contractor and every review and comment by the ENGINEER and notifications or responses to comments provided by Developer or DB Contractor. The logging system shall be of read-only open access to Developer or DB Contractor and STATE and shall permit review and comment history to be followed.   • Contractor’s Submittals The Contract shall submit with reasonable promptness consistent with the Work Project Schedule and in orderly sequence all Shop Drawings, Samples, or other information required by the Contract Documents, or subsequently required by Change Order. Prior to submitting, the Contractor shall review each submittal for compliance with the Contract Documents and certify its approval by an approval stamp affixed to each copy. Submittal data presented without the Contractor’s certification will be returned without review or comment, and any delay resulting from such certification is the Contractor's responsibility.

  • Contractor Certification for Contractor Employees Introduction Texas Education Code Chapter 22 requires entities that contract with school districts to provide services to obtain criminal history record information regarding covered employees. Contractors must certify to the district that they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a school district. Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing duties related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. Disqualifying criminal history: Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the offense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state. If this box is checked, I further certify that Contractor has taken precautions or imposed conditions to ensure that the employees of Contractor and any subcontractor will not become covered employees. If this box is checked, I further certify that: (1) Contractor has obtained all required criminal history record information regarding its covered employees.
