We do not, however, make any representations regarding such insurers’ current or future solvency or ability to pay claims; and that the endorsements set out in Part 3 to Schedule 14 of the Agreement are as at today’s date in full force and effect in respect of the Required Insurances. We further confirm that the attached cover notes confirm this position. Ringfencing. During the period between the Effective Date and the Signing Date, 9.1.9.1 Seller has not resolved on any dividends or other distributions (whether by reduction of capital or redemption (Einziehung) or purchase of shares or otherwise) which are to be paid or made by any of the Companies to Seller or any of its Affiliates other than any of the Companies (herein “Seller’s Affiliates”); or 9.1.9.2 Seller has not increased or reduced the share capital of Xxxxx XX Erste or repurchased or redeemed (eingezogen) the Sold Shares; or 9.1.9.3 the Companies have not made any other payments to Seller or Seller’s Affiliates except as disclosed on Schedule 9.1.9.3.
Ringfencing. 1. Ringfencing or ringfenced means the suspension of a sell instruction (repurchase) of your units in a collective investment scheme by the unit trust management company, as per the Collective Investment Scheme legislation. 2. When we are notified that a collective investment scheme manager ringfenced a sell instruction, we will cancel your sell or switch instruction. We will then resubmit your instruction the following business day for trade at the price of that day. Should the instruction be ringfenced again, we will follow the ringfencing process. This means that it could take up to 20 days for the proceeds to be available. 3. We are not responsible for any loss or damages that you may suffer because of the ringfencing.

  • Fencing The SPD shall Fence the demarcated boundary of the Demised Premises at the SPD’s own expense in every respect.

  • Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates. (b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected. (c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)

  • Blasting Blasting shall be permitted only for road construction purposes unless advance permission is obtained from Forest Service. Whenever the Industrial Fire Precaution Level is II or greater, a fire security person equipped with a long handled round point No. 0 or larger shovel and a 5 gallon backpack pump can filled with water, will stay at location of blast for 1 hour after blasting is done. Blasting may be suspended by Forest Service, in areas of high rate of spread and resistance to control. Fuses shall not be used for blasting. Explosive cords shall not be used without permission of Forest Service, which may specify conditions under which such explosives may be used and precautions to be taken.

  • Skidding and Yarding Methods of skid- ding or yarding specified for particular areas, if any, are indicated on Sale Area Map. Outside Clearcutting Units and construction clearings, insofar as ground conditions permit, products shall not be skidded against reserve trees or groups of reproduction and tractors shall be equipped with a winch to facilitate skidding. B6.421 Rigging. Insofar as practicable, needed rigging shall be slung on stumps or trees desig- nated for cutting.
