SAFETY AND SANITARY CONDITIONS. The Employer shall comply with all appli cable laws concerning safety and sanitary con ditions. The Employer and the Union shall make every effort to see that the safety rules are obeyed.

Adequate dressing rooms and washing facilities shall be furnished by the Port. All toilets, lunchrooms, and working areas shall be kept in a clean and sanitary condition, properly lighted, heated and ventilated; soap, hot water, and towels shall be furnished. Employees shall cooperate with management in the maintenance of a generally well- kept shop, in the proper use of sanitary facilities, and shall wear and properly use all protective equipment provided by the Port. The Port shall furnish all safety equipment as required except for safety shoes. Safety glasses shall be reimbursed consistent with Port policy. The Port shall replace rain gear that is accidentally damaged. In order to assist with the purchase of the appropriate footwear, effective upon ratification of the agreement, the Port shall provide regular employees with the following stipends paid on the first pay period in July for the purchase price or repair of the ANSI approved footwear for the duration of the agreement: 2021 $175 2022 $190 2023 $195 2024 $200 All injuries no matter how slight must be reported by the employee to the Xxxxxxx/ or Manager and Shop Xxxxxxx on the day the injury occurs. In the event of an industrial accident of such nature that does not require an employee to discontinue work but does necessitate further treatment by a doctor at various intervals, the employee will make every effort to schedule such appointments outside of their regular working hours. In the event that the employee is unable to arrange such appointments outside the employee's regular working hours, the employee shall be compensated at their regular shift rate of pay for all time required for treatments during employee's regular working hours. Any employee suffering an industrial accident shall be entitled to a full day's pay for the day on which the accident occurs, provided it shall be medically certified by a physician as a disabling accident. Holiday and/or vacation pay shall not be provided as a duplication of compensation received by an employee on compensated time loss for an industrial injury.

The Union and Company agree to cooperate at all times in protecting the safety of Engineers and to form a Safety Committee with an equal number of representatives on each side to discuss and resolve grievances involving safety. Engineers shall supply their own sheets, pillow cases and towel. The Company shall supply Engineers with clean blankets and soaps. Clean blankets shall be furnished once a tour, provided that the Company shall have no obligation in this connection unless soiled blankets previously issued are returned. Engineers shall not be allowed to transfer from tug to tug in midstream south of the mouth of the Schuylkill River. North of the mouth of the Schuylkill River, transfer of Engineers from tug to tug midstream shall be at the discretion of the Master. Each tug, on an out-of-harbor operation, shall be equipped with an inflatable life raft and suitable grab rails for deck duty. Out of harbor tugs, when engaged in towing barges carrying poisonous volatile chemicals shall not carry less than one (1) gas mask for each crew member. No tug not so equipped shall be sent out-of-harbor. Engineers required to enter tanks (i.e. ballast, fuel) shall be provided quality Tyvek overalls. The Company agrees to provide back supports to all Engineers. The Union agrees that Engineers shall use back supports while performing strenuous duties. New back supports will be provided to Engineers when previously issued supports are returned. The Company agrees to meet with the Union within 60 days of the effective date of this agreement to discuss remedies of vessels electrical limitations.

SAFETY AND SANITARY CONDITIONS. Employees covered hereby, in the performance of their jobs, shall at all times use safety devices and protective equipment which may be furnished to them hereunder and will comply with the safety, sanitary or fire regulations issued by the City. There shall be a safety committee consisting of two Union employees selected by the Union and two management representatives. They shall hold monthly meetings when needed to investigate unsafe conditions, and keep a record of such meetings.
