SKILL UTILIZATION. 25.01 (a) The Employer shall assign work, duties and responsibilities to the nurses covered by this Collective Agreement in accordance with the Regulated Health Professions Act.
SKILL UTILIZATION. The Hospital undertakes to encourage Registered Practical Nurses to upgrade their skills to the present level of those being acquired by graduating Further, the Hospital will, where practicable, encourage and permit the utilization of the upgraded skills. Should the Hospital require those skills on the work units, the Hospital will pay for attendance at such training at regular wages and will also pay for tuition and course materials.

b. The Employer shall endeavour not to allow any person not falling within the bargaining unit to perform work normally performed by the nurses covered by this Agreement, for the life of this Agreement.
c. The Employer shall endeavour not to contract out any work normally performed by members of the bargaining unit and shall not do so without prior consultation and discussion with the Union’s Director of Labour Relations for the life of this Agreement.
d. The Employer shall endeavour not to enter into any agreement with any trade Union that restricts or purports to restrict in any way the employment of, and assignment of work to, nurses covered by this Collective Agreement and shall not do so without the prior consultation and discussion with the Union’s Director of Labour Relations for the life of this Agreement.
e. In the event of a fundamental change in the work normally performed by members of the bargaining unit, it is agreed that the parties shall meet to discuss these changes.

26.02 Non bargaining unit employees shall not perform duties normally performed by the nurses covered by this collective agreement which shall directly cause or result, in a lay- off, loss of seniority or service or reduction in benefits to nurses in the bargaining unit. This article does not apply when bargaining unit members are not available to perform the work.
26.03 The employer shall not contract out work usually performed by members of the bargaining unit if, as a result of such contracting out, a lay-off or loss of hours of any nurse within the bargaining unit follows.
26.04 A nurse may bring any skill utilization concern to the attention of a Nurse Manager either verbally or in writing within a forty-eight (48) hour period after the occurrence. The forty-eight (48) hour time limit shall be reasonably extended in the event that the Employee has been on a vacation or any other leave shorter than 2 weeks in duration. The Nurse Manager shall investigate the specific concerns and respond in the same manner. It is understood that such concerns are separate from the grievance procedure. It is the expectation that RPNs are aware of their scope of practice and may take appropriate action to reassign clients and to notify the nurse manager accordingly.
SKILL UTILIZATION. Where the Hospital requires an to utilize skills as approved by the College of Nurses, then such will be providedthe necessary education to perform any such skills in cases where additional training is needed by that

The Employer agrees that prior to any changes to the Policy being implemented, the Parties shall meet to discuss the proposed changes. The Union shall be allowed input regards to such proposed changes. The Employer further agrees that any disputes surrounding the Policy or an employee’s claim that rights have been violated under such Policy, may be the subject of a grievance under the procedure. Such grievance shall be initiated at Step of the grievance procedure.
