STORMWATER MANAGEMENT PLAN. 23. The Subdivider shall submit a detailed stormwater management plan (“Stormwater Management Plan”) to be reviewed and approved by the Municipality, Conservation Authority, Ministry of Environment, Conservation and Parks, County, and Lake Huron Primary Water Supply System. The stormwater management plan shall be designed and constructed in accordance with the current guidelines and standards prescribed by the Municipality and shall be integrated with the stormwater management plan approved under the Phase I Subdivision Agreement and shall be based upon the following documents, which are referred to in the Phase I Subdivision Agreement:

STORMWATER MANAGEMENT PLAN. The Development Property shall be graded and the Project constructed in accordance with the approved stormwater pollution prevention plan (the “SWPPP”). The SWPPP shall conform to City of Waseca requirements and specifications, City Code and applicable law. The SWPPP shall specifically include erosion and sedimentation control measures meeting accepted design criteria, standards and specifications contained in the Minnesota Stormwater Manual or other standards approved by the City Engineer. The Developer shall furnish the City Engineer with satisfactory “as-constructed” plans after completion of construction.
STORMWATER MANAGEMENT PLAN. The final stormwater management plan for the Newbury Mixed-Use Development dated August 10, 2007, as originally approved on November 20, 2007, as amended by the Newbury Market – Topgolf stormwater management plan dated April 2017 and approved on May 8, 2017 as part of the final site plan File #SP-02-17 – Topgolf at Newbury Market, remains in effect, as may be further amended from time-to-time subject to the Township Ordinances and any requirements of any other governmental authority or agency having jurisdiction over stormwater management for the Newbury Mixed-Use Development. In addition, the Developer agrees to execute a Stormwater Operations and Management Agreement (the “O&M Agreement”), in the form and content set forth as Exhibit “D” attached hereto and incorporated herein. The O&M Agreement will be placed of record with the Department of Real Estate of Allegheny County, Pennsylvania.
