STUDENT CONFIDENTIALITY. The Parties understand, agree, and acknowledge that the Dallas ISD and Dallas College each have a legal obligation to maintain the confidentiality and privacy of student records in accordance with applicable law and regulations, specifically the Family Educational Rights and Privacy Act (“FERPA”). Any student educational records shared must be done in compliance with the requirements and exceptions outlined in FERPA. The Parties acknowledge that each must comply with said law and regulations and safeguard student information. The Parties may not re-disclose the information to a third party except as required by law or without prior written consent from the parent/legal guardian or eligible student. The Parties must destroy any student information received from the other Parties when no longer needed for the purposes listed in this Agreement. 1. Dallas College will be provided information as outlined in the data sharing agreement approved by Dallas ISD and Dallas College on July 11, 2016. The data share agreement between Dallas College and Dallas ISD was amended and extended on January 10, 2019. 2. When Dallas ISD and/or Dallas College provide each other with such student information, the party disclosing the student information shall include the following statement all on the cover page: “This document contains personal information from a student’s education records. It is protected by the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g) and may not be re-released without prior written consent of the parent or eligible student.”

STUDENT CONFIDENTIALITY. The Institution has a legal obligation to maintain the confidentiality and privacy of student records in accordance with applicable law and regulations, specifically FERPA. The Providers each acknowledge that they must comply with said law and regulations and safeguard student information. Other than to support the Texas College Bridge Program purposes and requirements, the Providers may not re-disclose the information to a third party without prior written consent from the Institution and/or the parent or eligible student.
STUDENT CONFIDENTIALITY. The Contracting Party and all of its agents and employees shall be bound to the same extent as the School Board of Brevard County in fulfilling the requirements of student confidentiality pursuant to Florida law, ( §1002.22, Florida Statutes) and federal law (including, but not limited to, the requirements of the Family Educational Rights and Privacy Act – FERPA). This means that to the extent the Contracting Party or any agent or employee thereof in the course of performing work pursuant to the Agreement becomes aware of or has access to student identifying information, such information shall be maintained as strictly confidential and shall not be released except under circumstances permitted or required by Florida and federal law and applicable regulations.

UTD and its authorized representatives may not re-disclose the information to a third party without prior written consent from the Dallas ISD, the parent or eligible student. and its authorized representatives must destroy any student information received from the Dallas Independent School District when no longer needed for the purposes listed in this Agreement or upon expiration of the term of the Agreement. Any extended use of the data must be specifically authorized in writing in advance of the expiration of the underlying Agreement and its authorized representatives must maintain the confidentiality of the student records according to commercially reasonable administrative, physical and technical standards that are no less rigorous than the standards by which UTD protects its own confidential information.
STUDENT CONFIDENTIALITY. Provider shall maintain all student records in a secure location preventing access by unauthorized individuals. Only individuals who have been determined to have legitimate educational interests, including the educational interests of the child for whom consent would otherwise be required, shall have access to student records. Provider will maintain an access log delineating date, time, agency, and identity of any individual accessing student records who is not in the direct employ of the Provider. Provider, including its officers, agents, employees, etc., shall not forward to any person other than parent or the Board any student record, including, but not limited to, the student’s identity and shall not release student personally identifiable information, without the written consent of the parent and District. Also, Provider, including its officers, agents, employees, etc., shall not use or disclose student records in a manner inconsistent with the Family Educational Rights and Privacy Act (“FERPA”), any other applicable Federal or State law, or the purposes set forth in this Agreement. Further, Provider shall not disclose to the public the identity of any student who is eligible for, or receiving, SES under this Agreement, without the written permission of the parents of the student. Upon termination of this Agreement, Provider shall turn over to the Board all student records of the District’s eligible students to whom Provider has provided services under this agreement. The duty to maintain the confidentiality of student personally identifiable information shall survive the termination of this Agreement. Provider shall immediately report to the Board any unauthorized use or disclosure of student records or information, by the Provider or its officers, agents, employees, of which the Provider becomes aware.

Supplier must comply with said law and regulations and safeguard student information. Supplier may not disclose student information to a third party without prior written consent from the parent or eligible student. Supplier must destroy any student information received from the District when no longer needed for the purposes of the Agreement.

Parkland and its authorized representatives may only receive student information in compliance with the requirements and exceptions outlined in FERPA. Parkland and its authorized representatives acknowledge that they must comply with said law and regulations and safeguard student information. Parkland and its authorized representatives may not re-disclose the information to a third party without prior written consent from the Dallas ISD, the parent or eligible student. Dallas ISD and Parkland acknowledge and agree that any education records and any data derived from personally identifiable information or records received will be used for the purposed listed in this Agreement and will be integrated into Parkland’s patient health records for the individual as clinically appropriate and required by applicable law. Dallas ISD and Parkland hereby specifically acknowledge and agree that Parkland and its authorized representatives shall maintain the confidentiality of the student information derived from the student records according to commercially reasonable administrative, physical and technical standards that are no less rigorous than the standards by which Parkland protects its own confidential information, including but not limited to, the following: a) Title 42 of the Code of Federal Regulations Part 2 (Confidentiality of Alcohol and Drug Abuse Patient Records); b) Title 42 of the Code of Federal Regulations Part 431, Subpart F (Safeguarding Information on Applicants and Beneficiaries); c) Title 45 of the Code of Federal Regulations Parts 160 and 164 (HIPAA General Administrative Requirements; Security and Privacy); d) Title 2 of the Texas Health and Safety Code, Chapter 181 (Medical Records Privacy); e) Title 7 of the Texas Health and Safety Code Section 576.005 (Texas Mental Health Code, Confidentiality of Records); f) Title 7 of the Texas Health and Safety Code Chapter 611 (Mental Health Records); g) Title 2 of the Texas Health and Safety Code Chapter 85 (Prevention, Control, and Reports of Diseases, Acquired Immune Deficiency Syndrome and Human Immunodeficiency Virus Infection); and Title 25 of the Texas Administrative Code, Chapter 1, Subchapter W (Privacy Policy)..
STUDENT CONFIDENTIALITY. Both parties acknowledge a legal obligation to maintain the confidentiality and privacy of its student records in accordance with applicable law and regulations, specifically the Family Educational Rights and Privacy Act (FERPA). Both parties agree to comply with FERPA and safeguard student information. UNTDSOE may not re-disclose student records to a third party without prior written consent from the Dallas ISD parent or eligible student. UNTDSOE will destroy any student information received from the District when no longer needed for the purposes listed in the Agreement. This agreement shall take effect upon execution by both signatories.

Occasionally, a staff member, along with the School Director, may review the child's file for information that may be pertinent to the child's needs. By no means may the child's family information or the child's information be released to any outside parties, except for the licensing agents and departmental authorities, without prior parental approval.
