Table 6A. The discharge violated the TSS maximum daily limit on two occasions and the average monthly limit once. Exceedance of the TSS limits indicates a failure to properly operate and maintain the treatment system. Shell stated that consecutive intense storms with runoff exceeding the plant capacity reduced the settling pond residence time and resulted in TSS exceeding the Permit effluent limits.3 Shell is subject to administrative liabilities for these violations pursuant to Water Code section 13385, subdivision (a)(2). The factors considered in determining the liabilities for exceeding the effluent limits are described below:
