Termination After Occupancy. A first-year Student cannot terminate this contract after occupancy unless CU Boulder released Student from the live-on requirement under this contract. The following financial consequences will apply to any Student termination after occupancy: The $50 application charge will not be refunded. The $250 deposit will be applied to any charges owed to CU Boulder and any remainder will be refunded. Student must pay all financial responsibilities incurred from the first day of the Available Period of Occupancy through the date of checkout. Student must pay a cancellation charge of 50% of the remaining Rate from the date of checkout through the last day of the Available Period of Occupancy for the semester. The cancellation charge increases to 100% if Student terminates within 30 days of the last date of the Available Period of Occupancy for the semester. CU Boulder will not require Student to pay a cancellation charge if: (1) CU Boulder has determined that termination of this contract is necessary to reasonably accommodate Student’s disability; (2) Student has graduated, withdrawn by taking zero credits (including matriculation, continuing education, and online credits) at the University of Colorado Boulder; (3) Student has decided to attend another University of Colorado campus instead of the University of Colorado Boulder and provided documentation to Housing & Dining to support any of those circumstances; or (4) Housing & Dining approved Student’s petition for release from the cancellation charge requirement. Any other financial responsibilities already paid by Student pursuant to this contract will be refunded or credited to Student’s account to the extent they are refundable.
Termination After Occupancy. A. After check-in a Student is responsible for the full payment of requested stay (as established by the application process) regardless of actual check-out date. Exceptions to this policy will be made on a case-by- case basis, as determined by the Director of Housing or their designee.

For the 0% and 50% refundable plans, the Entrance Fee, less the refund percentage times the Entrance Fee as applicable, shall be amortized by Messiah Village in an amount equivalent to two percent (2%) of the Entrance Fee per month for a period of fifty (50) months from the Designated Occupancy Date or date of Occupancy, whichever is earlier. After the lapse of fifty (50) months, the Entrance Fee shall be amortized in full by Messiah Village, and only the refund percentage times the Entrance Fee as applicable will be refunded subject to the conditions of Section 14.5 below. In the event of termination of this Agreement, during the fifty (50) month amortization period, any unamortized amounts prorated on a monthly basis, less any amounts deducted to cover costs incurred by Messiah Village to refurbish, restore or repair the Residence in the event of unreasonable wear and tear, or to cover costs incurred at the specific request of Resident, or to satisfy unpaid charges, and less any deductions for financial assistance provided Resident by Messiah Village in accordance with Messiah Village’s Benevolent Care Policy, shall be refunded to Resident subject to the conditions of Section 14.5 below. For the 90% refundable plan, ten percent (10%) of the Entrance Fee shall be immediately amortized in full by Messiah Village, and shall not be available as a refund. The refund percentage times the Entrance Fee as applicable will be refunded subject to the conditions of Section 14.5 below. Such refund is subject to deductions for any amounts deducted to cover costs incurred by Messiah Village to refurbish, restore or repair the Residence in the event of unreasonable wear and tear, or to cover costs incurred at the specific request of Resident, or to satisfy unpaid charges, or for financial assistance provided Resident by Messiah Village.
Termination After Occupancy. If Resident terminates this Agreement after having occupied the unit, Resident or Resident's estate shall be entitled to a refund of the unused portion of the Health Care Reserve. The refund of the Entrance Fee is determined based on the entire amount of the Entrance Fee, reduced by 4.167 tenths of a percent (.4167%) per month (5% per year), for each month or portion thereof of occupancy, up to a maximum of twenty five percent (25%) of the entire Entrance Fee. After sixty (60) months of occupancy, seventy five percent (75%) of the entrance fee will be refundable.

In the event of a voluntary termination by Resident after occupancy for any reason, including death, IKF shall refund to Resident 90% of the Entrance Fee paid by Resident less: (i) any amounts due IKF pursuant to Section 615; and (ii) any amount already paid from the Entrance Fee to IKF pursuant to Section 506 herein.

Termination After Occupancy. This license agreement may be terminated in the following manner: Should the student at any time cease to be enrolled as a full- time student at the university, this license agreement may be terminated without notice, such notice being hereby waived. In these cases, adjustment of space charges will be made in accordance with the fee schedule in Appendix A of this license agreement. In limited circumstances, related only to a change in student status from full- to part-time, and only after approval of a prior written request, the assistant vice president of HRL or their designee may permit a part-time student to reside in university residence halls. If the student violates any of the terms and conditions of this license agreement—in particular, those set forth in section 9—the student may be given written notice by the university that the license agreement has been terminated and to vacate the university residence hall pending a determination by disciplinary hearing. Upon disciplinary hearing determination, as implemented in writing by the xxxx of students or designee, this license agreement may be terminated. If the student exhibits behavior or mode of living by which, in the judgment of the assistant vice president of HRL, xxxx of students, or vice president of campus life (or designee of the foregoing), it would be in the best interest of the student, other residents, or the university community for the student to leave the university residence hall, then this license agreement may be terminated unilaterally by the university upon due notice (as defined by the assistant vice president of HRL), and an adjustment of space charges may be assessed. If the license agreement is terminated, as provided in previous sections A, B, or C, the student must vacate the space on the effective date of termination. Upon the student’s failure to take all summary action to vacate, the university shall be entitled to immediate possession of the space and to take all summary action to secure possession without any other or further notice of any kind to the student. The university may then, without notice to the student, enter, take possession of, and reassign the space. The university is further irrevocably authorized on behalf of the student to remove and to store the student’s belongings, without any liability on the part of the university for damage or loss. Termination After Occupancy i) Non-student summer housing contracts cannot be changed or canceled after occupancy of a residential space. Individuals may choose to check out prior to their contract end date; however, your housing fees will not be prorated based on your departure date.
