UNION RECOGNITION AND SCOPE OF AGREEMENT. A. The Company agrees to recognize Unifor Local 87-M, Southern Ontario Newsmedia Guild, as the exclusive bargaining agent for all employees of The Review, a division of Metroland Media Group Ltd, in the following bargaining unit: All employees in the Editorial Department of The Review, a division of Metroland Media Group Ltd., in the Regional Municipality of Niagara, save and except persons exercising managerial functions or employed in a confidential capacity in matters relating to labour relations within the meaning of the Ontario Labour Relations Act. For the purposes of clarity, as of the date of the application for certification, the following positions are excluded on the basis that the incumbents exercise managerial functions or are employed in a confidential capacity in matters relating to labour relations within the meaning of the Ontario Labour Relations Act: Managing Editor, City Editor, News Editor, Sports Editor and Night Editor.
UNION RECOGNITION AND SCOPE OF AGREEMENT. The Company recognizes the Union certified by the National Labor Relations Board as the exclusive representative and bargaining agent with respect to rates of pay, wages, hours and other working conditions for the bargaining unit comprised of all full-time workers at Kirtland Air Force Base within the Union’s work jurisdiction, as certified by the NLRB, and those who may be added by written mutual agreement between the Company and the Union. This agreement excludes all casual employees and confidential employees, whose duties are considered confidential, accounting employees, technical employees, sales employees, professional employees, guards, and supervisors as defined in the Act.

  • PROCUREMENT OF AGREEMENT CONSULTANT represents and warrants that no person or selling agent has been employed or retained by CONSULTANT to solicit or secure this Agreement upon an agreement or upon an understanding for a commission, percentage, a brokerage fee, contingent fee or any other compensation. CONSULTANT further represents and warrants that no payment, gift or thing of value has been made, given or promised to obtain this or any other agreement between the parties. CONSULTANT makes such representations and warranties to induce the COUNTY to enter into this Agreement and the COUNTY relies upon such representations and warranties in the execution hereof. For a breach or violation of such representations or warranties, the COUNTY shall have the right to annul this Agreement without liability, entitling the COUNTY to recover all monies paid hereunder and CONSULTANT shall not make claim for or be entitled to recover, any sum or sums otherwise due under this Agreement. This remedy, if effected, shall not constitute the sole remedy afforded the COUNTY for such falsity or breach, not shall it constitute a waiver of the COUNTY’s right to claim damages or otherwise refuse payment or to take any other action provided for by law or pursuant to this Agreement.

  • Implementation of Agreement Each Party must promptly execute all documents and do all such acts and things as is necessary or desirable to implement and give full effect to the provisions of this Agreement.

  • UNION RECOGNITION AND SECURITY 3.1 The Employer recognizes the Union as the sole bargaining authority for all employees covered by this Agreement and coming within the jurisdiction of the Union. The Union recognizes that the Association is the sole bargaining authority for all subcontractors of the Employer covered by this Agreement and coming within the jurisdiction of the Union.

  • Union Recognition and Rights The Union agrees that any activities relevant to the administration of the Collective Agreement or other Union activities, which must be conducted during working hours, will be carried out in a professional manner with primary consideration to instructional duties. Where the College feels that such activities are interfering inappropriately with instructional duties, the Parties agree to meet and resolve the matter.
