Upon request from the Union the City shall provide the Chief Xxxxxxx with a current seniority list. 1) He/she resigns, quits or retires. 2) He/she is discharged for just cause. 3) He/she is absent for three (3) consecutive working days without notifying his/her immediate supervisor. In proper cases, exceptions may be made by the City Manager. After such absence, the Department Head will send written notification to the employee at his last known address that he/she has lost his/her seniority, and his/her employment has been terminated. 4) He/she fails to report for work within five (5) working days of receipt of notice of recall. 5) Employees on unpaid leave shall have their longevity date adjusted to reflect the loss of time if such unpaid leave shall exceed six months. A) The word layoff means a reduction in working force as a result of a lack of work or economy measures. B) If a layoff becomes necessary, the following procedures will be mandatory: The principle of straight bargaining unit seniority shall govern. An employee may bump down to a lateral classification or to a lesser classification for which the employee is qualified and able to do the job with minimal training. C) Employees to be laid off for an indefinite period of time will be given as much advance notice as possible under the circumstances, but in no event less than seven (7) days notice. D) The Union shall receive a list of employees being laid off at the same time that said employees are notified. E) When the working force is increased after a layoff, employees shall be recalled in the inverse order of their having been laid off. No new employees will be hired by the City as long as there are employees laid off who have seniority, except to fill positions those on layoff are not qualified to fill. F) Any employees with the same seniority date shall be considered in alphabetical order of their last names for any situation bringing about the need of determination by seniority. G) Notice of recall shall be sent to the employee at the employee's last known address by certified mail. If an employee fails to report for work within ten (10) days of mailing of the notice of recall, the employee shall be considered as quit. H) Part-time, temporary, and probationary employees of a given job classification or occupational group shall be laid off first before bargaining unit members in that same classification or group.

  • Vacation Requests Regular employees become eligible for paid vacation leave once they have completed six (6) months of continuous employment. Vacations requests must be submitted by no later than January 31st to be scheduled for the vacation calendar year of April 1 - March 31. Vacation time may be divided into blocks of one to two weeks in duration. Scheduling of vacation shall be in accordance with seniority within a classification. Where an employee chooses to split their vacation, they shall exercise seniority rights in the choice of the first vacation period. Seniority shall prevail in the choice of the second vacation period but only after all other first vacation periods have been selected. Remaining vacation periods will be scheduled in a fair and equitable manner amongst employees within a classification. The approved vacation schedule will be posted at the worksite on or before February 28th in each year. Employees will be limited to booking a maximum of two (2) consecutive weeks of vacation during prime vacation period (June 15 - September 15; and December 15 - January 5), unless further consecutive weeks would not interfere with the vacation preferences of less senior employees. The Employer will make every effort to accommodate requests for vacation of more than two (2) consecutive weeks outside of prime vacation periods. Employees failing to exercise their right to request vacation within the vacation selection time posted by the Employer will forfeit their seniority rights with respect to choice of vacation time. In such cases, the Employer reserves the right to schedule vacation time for the employee. A maximum of two (2) weeks of vacation time may be carried forward from one year to another. Employees who wish to carry vacation forward should notify the Employer by January 31st. If the employee has not requested all of their vacation leave, the Employer reserves the right to schedule the remaining vacation days within the last four (4) months of the calendar year. The Employer may also pay out unused vacation credits at the end of February each calendar year.

  • Request for Transfer Unless the paraeducator and both principals agree, no transfers shall be allowed during a period spanning from 14 calendar days before the first contract work day until after the 20th contract work day. A transfer will not be considered unless the paraeducator is qualified for such vacancy. All transfers shall be initiated by the receiving principal, with copies to the releasing principal or immediate supervisor and the Human Resource Services office. The principal, when making his/her decision, shall consider the following: seniority, educational qualifications, expertise and ability, prior job experience, performance evaluations, and recommendations of previous supervisors. The transfer of the paraeducator will be subject to Board approval.
